  1  1    Section 1.  Section 89A.3, Code 2003, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  6.  The commissioner shall adopt rules
  1  4 permitting elevators, which are permitted for residential use,
  1  5 to be used in an eligible church or house of worship where the
  1  6 elevators are only used to transport a restricted number of
  1  7 persons with special needs.  The rules shall provide that an
  1  8 elevator installed pursuant to this subsection shall be
  1  9 inspected by a licensed inspector upon the installation of the
  1 10 elevator, and each year thereafter, at the cost of the owner
  1 11 of the elevator.  For purposes of this subsection, an
  1 12 "eligible church or house of worship" means a church or house
  1 13 of worship located in a building constructed prior to July 1,
  1 14 2004, and with a building capacity of one thousand or fewer
  1 15 persons.
  1 16                           EXPLANATION
  1 17    This bill requires the labor commissioner to adopt rules
  1 18 allowing residential elevators in eligible churches where the
  1 19 elevators are only used to transport a restricted number of
  1 20 persons with special needs.  The bill further provides that
  1 21 once an elevator has been installed as permitted by the bill,
  1 22 it shall be subject to inspection by a licensed inspector upon
  1 23 installation, and each year thereafter, at the owner's cost.
  1 24 The bill defines eligible churches as churches in buildings
  1 25 constructed prior to July 1, 2004, with a building capacity of
  1 26 1,000 or fewer persons.
