1 An Act relating to the amount of territory that may be annexed by
2 involuntary petition.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 368.11, subsection 3, Code Supplement
1 2 2003, is amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. o. In the case of an annexation, a
1 4 statement estimating the amount of land located in the
1 5 annexing city that is currently vacant or undeveloped.
1 6 Sec. 2. Section 368.17, Code 2003, is amended by adding
1 7 the following new subsection:
1 8 NEW SUBSECTION. 8. An involuntary annexation if the
1 9 territory to be annexed exceeds five hundred acres or if the
1 10 total amount of territory annexed by the city pursuant to
1 11 section 368.11 for the calendar year in which the petition is
1 12 being considered by the committee would exceed five hundred
1 13 acres when combined with the amount of territory to be
1 14 annexed. However, the committee may approve a petition under
1 15 such circumstances if the committee determines that there is
1 16 an insufficient amount of land available for development
1 17 purposes within the annexing city's corporate limits.
1 18 EXPLANATION
1 19 This bill limits annexations by involuntary petition to no
1 20 more than 500 acres per city per calendar year unless the
1 21 local committee considering the annexation determines that
1 22 there is an insufficient amount of land available for
1 23 development purposes within the annexing city's corporate
1 24 limits. The bill also requires that the involuntary petition
1 25 contain a statement estimating the amount of land located in
1 26 the annexing city that is currently vacant or undeveloped.
