  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 6A.4, subsection 6, Code 2003, is
  1  2 amended to read as follows:
  1  3    6.  CITIES.  Upon all cities within their corporate
  1  4 boundaries for public purposes which are reasonable and
  1  5 necessary as an incident to the powers and duties conferred
  1  6 upon cities.
  1  7    Sec. 2.  Section 364.4, subsection 1, Code 2003, is amended
  1  8 to read as follows:
  1  9    1.  Acquire, hold, and dispose of property outside the city
  1 10 in the same manner as within.  However, the power of a city to
  1 11 acquire property outside the city does not include the power
  1 12 to acquire property outside the city by eminent domain.
  1 13                           EXPLANATION
  1 14    This bill provides that the power of a city to acquire
  1 15 property outside the city does not include the power to
  1 16 acquire property outside the city by eminent domain.
