Section 321.109, subsection 1, Code 2003, is 1 2 amended to read as follows: 1 3 1. a. The annual fee for all motor vehicles, including 1 4 multipurpose vehicles and vehicles designated by manufacturers 1 5 as station wagons,and 1993 and subsequent model years for 1 6 multipurpose vehicles,except motor trucks, motor homes, 1 7 ambulances, hearses, motorcycles, and motor bicycles,and 1992 1 8 and older model years for multipurpose vehicles,shall be 1 9 equal to one percent of the value as fixed by the department 1 10 plus forty cents for each one hundred pounds or fraction 1 11 thereof of weight of vehicle, as fixed by the department. The 1 12 weight of a motor vehicle, fixed by the department for 1 13 registration purposes, shall include the weight of a battery, 1 14 heater, bumpers, spare tire, and wheel. Provided, however, 1 15 that for any new vehicle purchased in this state by a 1 16 nonresident for removal to the nonresident's state of 1 17 residence the purchaser may make application to the county 1 18 treasurer in the county of purchase for a transit plate for 1 19 which a fee of ten dollars shall be paid. And provided, 1 20 however, that for any used vehicle held by a registered dealer 1 21 and not currently registered in this state, or for any vehicle 1 22 held by an individual and currently registered in this state, 1 23 when purchased in this state by a nonresident for removal to 1 24 the nonresident's state of residence, the purchaser may make 1 25 application to the county treasurer in the county of purchase 1 26 for a transit plate for which a fee of three dollars shall be 1 27 paid. The county treasurer shall issue a nontransferable 1 28 certificate of registration for which no refund shall be 1 29 allowed; and the transit plates shall be void thirty days 1 30 after issuance. Such purchaser may apply for a certificate of 1 31 title by surrendering the manufacturer's or importer's 1 32 certificate or certificate of title, duly assigned as provided 1 33 in this chapter. In this event, the treasurer in the county 1 34 of purchase shall, when satisfied with the genuineness and 1 35 regularity of the application, and upon payment of a fee of 2 1 ten dollars, issue a certificate of title in the name and 2 2 address of the nonresident purchaser delivering the same to 2 3 the person entitled to the title as provided in this chapter. 2 4The provisions of this subsection relating to multipurpose 2 5 vehicles are effective January 1, 1993, for all 1993 and 2 6 subsequent model years. The annual registration fee for 2 7 multipurpose vehicles that are 1992 model years and older 2 8 shall be in accordance with section 321.124.2 9 b.TheNotwithstanding paragraph "a", the annual 2 10 registration fee for a multipurpose vehicle with permanently 2 11 installed equipment manufactured for and necessary to assist a 2 12 person with a disability who is either the owner or a member 2 13 of the owner's household in entry and exit of the vehicle or 2 14 for a multipurpose vehicle if the vehicle's owner or a member 2 15 of the vehicle owner's household uses a wheelchair as the only 2 16 means of mobility shall be sixty dollars. For purposes of 2 17 this unnumbered paragraph, "uses a wheelchair" does not 2 18 include use of a wheelchair due to a temporary injury or 2 19 medical condition. 2 20 Sec. 2. Section 321.113, subsection 5, paragraph a, Code 2 21 2003, is amended to read as follows: 2 22 a. If a 1993 model year or older motor vehicle, other than 2 23 a multipurpose vehicle, has been titled in the same person's 2 24 name since the vehicle was new or the title to the vehicle was 2 25 transferred prior to January 1, 2002, the part of the 2 26 registration fee that is based on the value of the vehicle 2 27 shall be ten percent of the rate as fixed when the motor 2 28 vehicle was new. 2 29 Sec. 3. Section 321.113, subsection 5, paragraph b, 2 30 unnumbered paragraph 1, Code 2003, is amended to read as 2 31 follows: 2 32 If the title of a 1993 model year or older motor vehicle is 2 33 transferred to a new owner or if such a motor vehicle is 2 34 brought into the state on or after January 1, 2002, or if a 2 35 vehicle is a 1993 model year or older multipurpose vehicle, 3 1 the registration fee shall not be based on the weight and list 3 2 price of the motor vehicle, but shall be as follows: 3 3 Sec. 4. Section 321.113, subsection 5, paragraph b, Code 3 4 2003, is amended by adding the following new unnumbered 3 5 paragraph: 3 6 NEW UNNUMBERED PARAGRAPH. Notwithstanding subsection 1, 3 7 the reduced fees in this paragraph "b" apply to all 1993 model 3 8 year or older multipurpose vehicles, including multipurpose 3 9 vehicles described in section 321.109, subsection 1, paragraph 3 10 "b". 3 11 Sec. 5. Section 321.124, subsection 3, unnumbered 3 12 paragraph 1, Code 2003, is amended to read as follows: 3 13 The annual registration fee for motor homesand 1992 and 3 14 older model years for multipurpose vehiclesis as follows: 3 15 Sec. 6. Section 321.124, subsection 3, paragraph h, Code 3 16 2003, is amended by striking the paragraph. 3 17 Sec. 7. Section 422.9, subsection 2, paragraph h, Code 3 18 Supplement 2003, is amended to read as follows: 3 19 h. To the extent not otherwise included pursuant to 3 20 section 164 of the Internal Revenue Code, add the amount of 3 21 the annual registration fee paid for a multipurpose vehicle 3 22 pursuant to section321.124, subsection 3, paragraph "h"3 23 321.113, subsection 5, paragraph "b", which is based upon the 3 24 value of the vehicle. For purposes of this paragraph, sixty 3 25 percent of the amount of the registration fee is based upon 3 26 the value of the multipurpose vehicle. 3 27 Sec. 8. Section 422.35, subsection 15, Code Supplement 3 28 2003, is amended to read as follows: 3 29 15. To the extent not otherwise included pursuant to 3 30 section 164 of the Internal Revenue Code, subtract the amount 3 31 of the annual registration fee paid for a multipurpose vehicle 3 32 pursuant to section321.124, subsection 3, paragraph "h"3 33 321.113, subsection 5, paragraph "b", which is based upon the 3 34 value of the vehicle. For purposes of this subsection, sixty 3 35 percent of the amount of the registration fee is based upon 4 1 the value of the vehicle. 4 2 Sec. 9. EFFECTIVE DATE. This Act takes effect January 1, 4 3 2005, for new registrations and for registration periods 4 4 beginning on or after that date. 4 5 EXPLANATION 4 6 This bill standardizes registration fees for all 1993 model 4 7 year and older multipurpose vehicles. Multipurpose vehicles 4 8 transport up to 10 persons and are constructed on a truck 4 9 chassis or otherwise designed for occasional off=road use. 4 10 Under current law, the fee for 1993 model year and newer 4 11 multipurpose vehicles is determined under the same formula 4 12 used for other motor vehicles, but the fee for 1992 model year 4 13 and older multipurpose vehicles is $55. The bill makes the 4 14 flat fees applicable to most other 1993 model year and older 4 15 motor vehicles applicable to multipurpose vehicles. Under the 4 16 bill, the registration fee would be $27 for model year 1990= 4 17 1993 multipurpose vehicles, $23 for model year 1970=1982 4 18 vehicles, and $16 for model year 1969 and older vehicles. The 4 19 graduated fee reduction would also apply to multipurpose 4 20 vehicles specially equipped for wheelchair accessibility. 4 21 Those vehicles are currently assessed a registration fee of 4 22 $60, regardless of the age of the vehicle. 4 23 The bill makes corresponding amendments relating to 4 24 deductibility of multipurpose vehicle registration fees for 4 25 income tax purposes. 4 26 The new registration fees take effect January 1, 2005. 4 27 LSB 5154YH 80 4 28 dea/pj/5
