1 1 Section 1. Section 321.34, Code Supplement 2003, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 24. DISTINGUISHED SERVICE CROSS SPECIAL
1 4 PLATES. The owner of a motor vehicle referred to in
1 5 subsection 12 who has been awarded the distinguished service
1 6 cross may, upon written application to the department and
1 7 presentation of satisfactory proof of the award of the
1 8 distinguished service cross as established by the Congress of
1 9 the United States, order special registration plates with a
1 10 distinguished service cross processed emblem. The emblem
1 11 shall be designed by the department in consultation with the
1 12 adjutant general and shall signify that the owner was awarded
1 13 the distinguished service cross. The application is subject
1 14 to approval by the department, in consultation with the
1 15 adjutant general. The special plates shall be issued at no
1 16 charge and are subject to an annual registration fee of
1 17 fifteen dollars. The county treasurer shall validate the
1 18 special plates in the same manner as regular registration
1 19 plates are validated under this section.
1 20 The surviving spouse of a person who was issued special
1 21 plates under this subsection may continue to use the special
1 22 plates subject to registration of the special plates in the
1 23 surviving spouse's name and upon payment of the annual
1 24 registration fee. If the surviving spouse remarries, the
1 25 surviving spouse shall return the special plates to the
1 26 department and the department shall issue regular registration
1 27 plates to the surviving spouse.
1 28 EXPLANATION
1 29 This bill establishes a special motor vehicle registration
1 30 plate for recipients of the distinguished service cross. The
1 31 state department of transportation, in consultation with the
1 32 adjutant general, shall design the emblem and approve
1 33 applications for the special plate. The plates are to be
1 34 issued free of charge, and the annual registration fee will be
1 35 $15. A surviving spouse may continue to use the special
2 1 plates by registering them in the surviving spouse's name and
2 2 paying the annual $15 registration fee, but the plates must be
2 3 exchanged for regular plates if the surviving spouse
2 4 remarries.
