  1  1    Section 1.  NEW SECTION.  231C.3A  ADMINISTRATIVE HEARING
  1  2 == TENANT APPEALS.
  1  3    If the department determines that a tenant of an assisted
  1  4 living program requires a level of care that is higher than
  1  5 the level of care the program is certified or accredited to
  1  6 provide, the tenant may request an administrative hearing
  1  7 before the department of inspections and appeals to review the
  1  8 determination.  The findings of the administrative hearing
  1  9 shall be final and shall not be subject to further review
  1 10 pursuant to chapter 17A.
  1 11                           EXPLANATION
  1 12    This bill provides a mechanism for a tenant of an assisted
  1 13 living program to request an administrative hearing to review
  1 14 a determination by the department of elder affairs that the
  1 15 tenant requires a higher level of care than the program is
  1 16 certified or accredited to provide.  The findings of the
  1 17 administrative hearing are final and not subject to further
  1 18 review.
