  1 An Act relating to the service standard for issuance of driver's
  2    licenses and nonoperator's identification cards by authorizing
  3    waivers or refunds of fees.

  1  1    Section 1.  NEW SECTION.  321.192  WAIVERS OR REFUNDS OF
  1  2 FEES.
  1  3    1.  Notwithstanding the fee requirements for issuance of a
  1  4 driver's license or nonoperator's identification card pursuant
  1  5 to section 321.190 or 321.191, the department may waive or
  1  6 refund fees pursuant to rules adopted by the department.  The
  1  7 department may waive payment of, or refund to an applicant,
  1  8 all or a portion of the fees for renewal of a license or
  1  9 identification card or for a duplicate license or
  1 10 identification card if the department determines that the
  1 11 service standard for timely issuance has not been met or an
  1 12 error on the license or identification card requires the
  1 13 applicant to return to the driver's license station.  The
  1 14 decision of the department not to waive or refund a fee is
  1 15 final agency action and not subject to review under chapter
  1 16 17A.
  1 17    2.  Subsection 1 does not apply to licenses issued by a
  1 18 county pursuant to chapter 321M.
  1 19                           EXPLANATION
  1 20    This bill creates new Code section 321.192, which
  1 21 authorizes the state department of transportation to waive
  1 22 payment of, or to refund, all or a portion of fees for renewal
  1 23 or duplication of a driver's license or nonoperator's
  1 24 identification card, pursuant to rules adopted by the
  1 25 department, if the department's standard for timely issuance
  1 26 is not met, or if an applicant is required to return to the
  1 27 driver's license station due to an error on the license or
  1 28 identification card.  The provision is only applicable to
  1 29 licenses and cards issued at driver's license stations
  1 30 operated by the department, and not to licenses and cards
  1 31 issued by counties under Code chapter 321M.
