NEW SECTION. 8.60A RESTORATION OF DESIGNATED 1 2 MONEYS USED FOR OTHER PURPOSES. 1 3 1. State fees that are received during a fiscal year 1 4 beginning on or after July 1, 2003, that are deposited into a 1 5 specific account or fund to be used for a specific purpose 1 6 shall not be transferred or appropriated from that account or 1 7 fund for purposes other than the specified purpose, except as 1 8 provided in subsection 2. 1 9 2. The Act that transfers or appropriates dedicated moneys 1 10 as described in subsection 1 shall contain a provision that 1 11 provides for the restoring of the transferred or appropriated 1 12 moneys over a period not to exceed five fiscal years with at 1 13 least twenty percent being restored in any fiscal year. The 1 14 period for the restoration shall begin with the first fiscal 1 15 year following the fiscal year for which the transfer or 1 16 appropriation is made. 1 17 3. The funds to which subsection 1 apply include, but are 1 18 not limited to the following: 1 19 a. Title guaranty fund created in section 16.91. 1 20 b. Special conservation fund created in section 321G.7. 1 21 c. Waste tire management fund created in section 455D.11C. 1 22 d. Groundwater protection fund created in section 455E.11. 1 23 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 1 24 immediate importance, takes effect upon enactment. 1 25 EXPLANATION 1 26 This bill provides that when fees which are dedicated for a 1 27 specific purpose are transferred or appropriated from a 1 28 specific account or fund for another purpose, those fees are 1 29 to be restored. The restoration would be made to the account 1 30 or fund over a period not to exceed five fiscal years with at 1 31 least 20 percent restored in each fiscal year. The 1 32 restoration schedule would be contained in the same Act in 1 33 which the transfer or appropriation is made. 1 34 The bill identifies four funds to which this requirement 1 35 specifically applies. These are the title guaranty fund, 2 1 special conservation fund (snowmobile and all=terrain vehicle 2 2 fees), waste tire management fund, and groundwater protection 2 3 fund.
