1 An Act relating to filing deadlines for school district petitions
2 to join an area education agency or for release from a
3 contract with an area education agency following approval of a
4 reorganization or dissolution proposal and including effective
5 date and retroactive applicability provisions.
6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 273.22, subsection 7, Code 2003, is
1 2 amended to read as follows:
1 3 7. Not later than fifteen days after the state board
1 4 notifies an area education agency of its approval of the area
1 5 education agency's reorganization plan or dissolution
1 6 proposal, the area education agency shall notify the school
1 7 districts located within the area education agency boundaries,
1 8 the school districts and area education agencies that are
1 9 contiguous to its boundaries, and any other school district
1 10 under contract with the area education agency, of the state
1 11 board's approval of the plan or proposal. A petition to join
1 12 an area education agency or for release from a contract with
1 13 an area education agency, in accordance with subsections 4
1 14 through 6, shall be filed not later than by April 1 or within
1 15 sixty days after the following state board approves approval
1 16 of a reorganization plan in accordance with section 273.21,
1 17 subsection 4, or a dissolution proposal in accordance with
1 18 this chapter section 273.27, subsection 3, whichever is later.
1 19 Sec. 2. EFFECTIVE DATE AND APPLICABILITY PROVISIONS. This
1 20 Act takes effect upon enactment and is retroactively
1 21 applicable to July 1, 2002, and is applicable on and after
1 22 that date.
1 23 EXPLANATION
1 24 This bill permits a school district to file a petition to
1 25 join an area education agency or for release from a contract
1 26 with an area education agency by April 1 or within 60 days
1 27 following state board of education approval of a
1 28 reorganization or dissolution proposal, whichever is later.
1 29 Currently, a school district has 60 days to file a petition.
1 30 The bill takes effect upon enactment and applies retroactively
1 31 to July 1, 2002.
