  2    instrumentality of two or more political subdivisions of the
  3    state formed by a joint intergovernmental agreement.

  1  1    Section 1.  Section 452A.17, subsection 1, paragraph a,
  1  2 Code 2003, is amended by adding the following new
  1  3 subparagraph:
  1  4    NEW SUBPARAGRAPH.  (11)  A separate legal or administrative
  1  5 entity formed under chapter 28E by political subdivisions of
  1  6 the state which is used for a public purpose.
  1  7                           EXPLANATION
  1  8    This bill allows entities formed under Code chapter 28E by
  1  9 political subdivisions of the state to receive a refund of the
  1 10 motor fuel and special fuel taxes paid when the fuel is used
  1 11 for public purposes.
