Section 321.34, subsection 12, paragraph a, 1 2 Code 2003, is amended to read as follows: 1 3 a.TheExcept as provided in paragraph "e", the owner of a 1 4 motor vehicle subject to registration pursuant to section 1 5 321.109, subsection 1, light delivery truck, panel delivery 1 6 truck, pickup, motor home, multipurpose vehicle, motorcycle, 1 7 trailer, or travel trailer may, upon written application to 1 8 the department, order special registration plates with a 1 9 distinguishing processed emblem as authorized by this section 1 10 or as approved by the department. The fee for the issuance of 1 11 special registration plates is twenty=five dollars for each 1 12 vehicle, unless otherwise provided by this section, which fee 1 13 is in addition to the regular annual registration fee. The 1 14 county treasurer shall validate special registration plates 1 15 with a distinguishing processed emblem in the same manner as 1 16 regular registration plates, upon payment of five dollars in 1 17 addition to the regular annual registration fee. 1 18 Sec. 2. Section 321.34, subsection 12, Code 2003, is 1 19 amended by adding the following new paragraph: 1 20 NEW PARAGRAPH. e. Upon written application to the 1 21 department and payment of fees pursuant to this subsection, an 1 22 owner of a motor truck, in addition to an owner referred to in 1 23 paragraph "a", may order special registration plates with a 1 24 cattlemen's processed emblem approved and issued by the 1 25 department. 1 26 Sec. 3. Section 321.34, subsection 12A, unnumbered 1 27 paragraph 1, Code 2003, is amended to read as follows: 1 28 An owner of a vehicle referred to in subsection 12, 1 29 paragraph "a", who applies for any type of special 1 30 registration plates associated with service in the United 1 31 States armed forces shall be issued one set of the special 1 32 registration plates at no charge, but shall be subject to the 1 33 annual registration fee of fifteen dollars, if all of the 1 34 following conditions are met: 1 35 Sec. 4. Section 321.34, subsection 14, Code 2003, is 2 1 amended to read as follows: 2 2 14. PERSONS WITH DISABILITIES SPECIAL PLATES. An owner 2 3 referred to in subsection 12, paragraph "a", or an owner of a 2 4 trailer used to transport a wheelchair who is a person with a 2 5 disability, or who is the parent or guardian of a child who 2 6 resides with the parent or guardian owner and who is a person 2 7 with a disability, as defined in section 321L.1, may, upon 2 8 written application to the department, order special 2 9 registration plates with a persons with disabilities processed 2 10 emblem designed by the department bearing the international 2 11 symbol of accessibility. The special registration plates with 2 12 a persons with disabilities processed emblem shall only be 2 13 issued if the application is accompanied with a statement from 2 14 a physician licensed under chapter 148, 149, 150, or 150A, a 2 15 physician assistant licensed under chapter 148C, an advanced 2 16 registered nurse practitioner licensed under chapter 152, or a 2 17 chiropractor licensed under chapter 151, written on the 2 18 physician's, physician assistant's, nurse practitioner's, or 2 19 chiropractor's stationery, stating the nature of the 2 20 applicant's or the applicant's child's disability and such 2 21 additional information as required by rules adopted by the 2 22 department, including proof of residency of a child who is a 2 23 person with a disability. If the application is approved by 2 24 the department, the special registration plates with a persons 2 25 with disabilities processed emblem shall be issued to the 2 26 applicant. There shall be no fee in addition to the regular 2 27 annual registration fee for the special registration plates 2 28 with a persons with disabilities processed emblem. The 2 29 authorization for special registration plates with a persons 2 30 with disabilities processed emblem shall not be renewed 2 31 without the applicant furnishing evidence to the department 2 32 that the owner of the vehicle or the owner's child is still a 2 33 person with a disability as defined in section 321L.1. An 2 34 owner who has a child who is a person with a disability shall 2 35 provide satisfactory evidence to the department that the child 3 1 with a disability continues to reside with the owner. The 3 2 registration plates with a persons with disabilities processed 3 3 emblem shall be surrendered in exchange for regular 3 4 registration plates as provided in subsection 12 when the 3 5 owner of the vehicle or the owner's child no longer qualifies 3 6 as a person with a disability as defined in section 321L.1 or 3 7 when the owner's child who is a person with a disability no 3 8 longer resides with the owner. 3 9 Sec. 5. Section 321.34, subsections 16 through 20, Code 3 10 2003, are amended to read as follows: 3 11 16. NATIONAL GUARD SPECIAL PLATES. An owner referred to 3 12 in subsection 12, paragraph "a", who is a member of the 3 13 national guard, as defined in chapter 29A, may, upon written 3 14 application to the department, order special registration 3 15 plates with a national guard processed emblem with the emblem 3 16 designed by the department in cooperation with the adjutant 3 17 general which emblem signifies that the applicant is a member 3 18 of the national guard. The application shall be approved by 3 19 the department in consultation with the adjutant general. 3 20 Special registration plates with a national guard processed 3 21 emblem shall be surrendered, as provided in subsection 12, in 3 22 exchange for regular registration plates upon termination of 3 23 the owner's membership in the active national guard. 3 24 17. PEARL HARBOR SPECIAL PLATES. An owner referred to in 3 25 subsection 12, paragraph "a", who was at Pearl Harbor, Hawaii, 3 26 as a member of the armed services of the United States on 3 27 December 7, 1941, may, upon written application to the 3 28 department, order special registration plates with a Pearl 3 29 Harbor processed emblem. The emblem shall be designed by the 3 30 department in consultation with service organizations. The 3 31 application is subject to approval by the department. 3 32 18. PURPLE HEART SPECIAL PLATES. An owner referred to in 3 33 subsection 12, paragraph "a", who was awarded a purple heart 3 34 medal by the United States government for wounds received in 3 35 military or naval combat against an armed enemy of the United 4 1 States may, upon written application to the department and 4 2 presentation of satisfactory proof of the award of the purple 4 3 heart medal, order special registration plates with a purple 4 4 heart processed emblem. The design of the emblem shall 4 5 include a representation of a purple heart medal and ribbon. 4 6 The application is subject to approval by the department in 4 7 consultation with the adjutant general. 4 8 19. UNITED STATES ARMED FORCES RETIRED SPECIAL PLATES. An 4 9 owner referred to in subsection 12, paragraph "a", who is a 4 10 retired member of the United States armed forces may, upon 4 11 written application to the department and upon presentation of 4 12 satisfactory proof of membership, order special registration 4 13 plates with a United States armed forces retired processed 4 14 emblem. The emblem shall be designed by the department in 4 15 consultation with service organizations. The application is 4 16 subject to approval by the department. For purposes of this 4 17 subsection, a person is considered to be retired if the person 4 18 is recognized by the United States armed forces as retired 4 19 from the United States armed forces. 4 20 20. SILVER OR BRONZE STAR PLATES. An owner referred to in 4 21 subsection 12, paragraph "a", who was awarded a silver or a 4 22 bronze star by the United States government, may, upon written 4 23 application to the department and presentation of satisfactory 4 24 proof of the award of the silver or bronze star, order special 4 25 registration plates with a silver or bronze star processed 4 26 emblem. The emblem shall be designed by the department in 4 27 consultation with the adjutant general. 4 28 Sec. 6. Section 321.34, subsection 21, paragraph a, Code 4 29 2003, is amended to read as follows: 4 30 a. An owner referred to in subsection 12, paragraph "a", 4 31 may, upon written application to the department, order special 4 32 registration plates with an Iowa heritage emblem. The emblem 4 33 shall contain a picture of the American gothic house and the 4 34 words "Iowa Heritage" and shall be designed by the department 4 35 in consultation with the state historical society of Iowa. 5 1 Sec. 7. Section 321.34, subsection 22, paragraph a, Code 5 2 2003, is amended to read as follows: 5 3 a. An owner referred to in subsection 12, paragraph "a", 5 4 upon written application to the department, may order special 5 5 registration plates with an education emblem. The education 5 6 emblem shall be designed by the department in cooperation with 5 7 the department of education. 5 8 EXPLANATION 5 9 Under current law, the only truck owners eligible for 5 10 special registration plates issued by the state department of 5 11 transportation are owners of light delivery trucks, panel 5 12 delivery trucks, and pickups. This bill amends Code section 5 13 321.34 to allow the owner of a motor truck to order special 5 14 registration plates with a cattlemen's processed emblem. The 5 15 cattlemen's plate, which has already been approved for 5 16 issuance by the state department of transportation, would be 5 17 the only special plate available to motor trucks under the 5 18 bill. 5 19 LSB 1536HH 80 5 20 dea/cl/14
