1 An Act changing the annual deadline for establishing the state
2 percent of growth for school district budgets, and providing
3 an effective date.

1 1 Section 1. Section 257.8, subsection 1, Code 2003, is
1 2 amended to read as follows:
1 3 1. STATE PERCENT OF GROWTH. The state percent of growth
1 4 for the budget year beginning July 1, 2002, is one percent.
1 5 The state percent of growth for the budget year beginning July
1 6 1, 2003, is two percent. The state percent of growth for each
1 7 subsequent budget year shall be established by statute which
1 8 shall be enacted within thirty days of the submission during
1 9 the thirty=day period immediately preceding the last calendar
1 10 date on which per=day expenses of office would be payable
1 11 during a regular session of the general assembly as provided
1 12 in section 2.10, in the year preceding the base year of the
1 13 governor's budget under section 8.21. The establishment of
1 14 the state percent of growth for a budget year shall be the
1 15 only subject matter of the bill which enacts the state percent
1 16 of growth for a budget year.
1 17 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 18 immediate importance, takes effect upon enactment.
1 19 EXPLANATION
1 20 This bill changes the deadline by which the state percent
1 21 of growth for school district budgets is annually required to
1 22 be established by statute. Code section 257.8 currently
1 23 provides that the state percent of growth shall be enacted
1 24 within 30 days of the submission of the governor's budget in
1 25 the year preceding the base year. The bill provides that for
1 26 the purposes of determining the state percent of growth for
1 27 the budget year beginning July 1, 2004, and succeeding budget
1 28 years, the deadline shall be changed to enactment during the
1 29 30=day period immediately preceding the last calendar date on
1 30 which per=day expenses of office would be payable during a
1 31 regular session of the general assembly as specified in Code
1 32 section 2.10 in the year preceding the base year. The
1 33 practical effect of this change would be to delay the
1 34 requirement for establishing the state percent of growth from
1 35 the initial 30 days of each legislative session to the final
2 1 30 days.
2 2 The bill takes effect upon enactment.
