  1  4 CREATING A SPECIAL GOLD STAR MOTOR VEHICLE REGISTRATION PLATE
  1  5    AND PROVIDING FEES AND AN EFFECTIVE DATE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  9    Section 1.  Section 35A.11, Code 2007, is amended to read
  1 10 as follows:
  1 11    35A.11  VETERANS LICENSE FEE FUND.
  1 12    A veterans license fee fund is created in the state
  1 13 treasury under the control of the commission.  The fund shall
  1 14 include the fees credited by the treasurer of state from the
  1 15 sale of special veteran license plates pursuant to section
  1 16 321.34, subsection 13, paragraph "d".  Notwithstanding section
  1 17 12C.7, interest or earnings on moneys in the veterans license
  1 18 fee fund shall be credited to the veterans license fee fund.
  1 19 Moneys in the fund are appropriated to the commission to be
  1 20 used to fulfill the responsibilities of the commission.  The
  1 21 fund shall include the fees credited by the treasurer of state
  1 22 from the sale of the following special motor vehicle
  1 23 registration plates:
  1 24    1.  Veteran special plates issued pursuant to section
  1 25 321.34, subsection 13, paragraph "d".
  1 26    2.  Gold star special plates issued pursuant to section
  1 27 321.34, subsection 24.
  1 28    Sec. 2.  Section 321.34, Code 2007, is amended by adding
  1 29 the following new subsection:
  1 30    NEW SUBSECTION.  24.  GOLD STAR PLATES.  An owner referred
  1 31 to in subsection 12 who is the surviving spouse, parent,
  1 32 child, or sibling of a deceased member of the United States
  1 33 armed forces who died while serving on active duty during a
  1 34 time of military conflict may order special registration
  1 35 plates bearing a gold star emblem upon written application to
  2  1 the department accompanied by satisfactory supporting
  2  2 documentation as determined by the department.  The gold star
  2  3 emblem shall be designed by the department in cooperation with
  2  4 the commission of veterans affairs.  The special plate fees
  2  5 collected by the director under subsection 12, paragraph "a",
  2  6 from the issuance and annual validation of letter=number
  2  7 designated and personalized gold star plates shall be paid
  2  8 monthly to the treasurer of state and credited to the road use
  2  9 tax fund.  Notwithstanding section 423.43, and prior to the
  2 10 crediting of revenues to the road use tax fund under section
  2 11 423.43, subsection 1, paragraph "b", the treasurer of state
  2 12 shall transfer monthly from those revenues to the veterans
  2 13 license fee fund created in section 35A.11 the amount of the
  2 14 special fees collected in the previous month for gold star
  2 15 plates.
  2 16    Sec. 3.  EFFECTIVE DATE.  This Act takes effect January 1,
  2 17 2008.
