Senate File 2429 - Enrolled PAG LIN 1 1 SENATE FILE 2429 1 2 1 3 AN ACT 1 4 RELATING TO BUDGET REQUIREMENTS BY CERTAIN SMALL CITIES AND 1 5 PROVIDING AN EFFECTIVE DATE. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. BUDGET REQUIREMENTS BY CITIES == DEADLINE 1 10 EXTENSIONS. 1 11 1. As used in this section, "qualified city" means a city 1 12 in this state having a population of seventy=five persons or 1 13 less as shown by the 2000 certified federal census. 1 14 2. Notwithstanding any provision in section 384.22 to the 1 15 contrary, a qualified city that failed to publish an annual 1 16 report for the fiscal year ending June 30, 2005, and failed to 1 17 file a copy of the report with the auditor of state on or 1 18 before December 1, 2005, as provided in section 384.22, may 1 19 publish such annual report and file a copy of the report with 1 20 the auditor of state no later than July 1, 2008, as otherwise 1 21 provided in that section. A qualified city that meets the 1 22 extended publication and filing deadline as provided in this 1 23 subsection shall be deemed to have published the annual report 1 24 and filed a copy of the report with the auditor of state on 1 25 December 1, 2005. 1 26 3. a. Notwithstanding any provision in section 384.16 to 1 27 the contrary, a qualified city that failed to prepare and 1 28 submit a budget as provided in that section for the fiscal 1 29 year beginning July 1, 2006, including by showing income from 1 30 sources other than property taxation and by showing actual 1 31 expenditures and revenues from its annual report as provided 1 32 in section 384.22, or as corrected by a subsequent audit 1 33 report, by March 15, 2006, may comply with the requirements in 1 34 section 384.16 by submitting the budget no later than July 1, 1 35 2008, as otherwise provided by that section. 2 1 b. A qualified city that complies with the requirements of 2 2 paragraph "a" is not required to conduct a hearing as required 2 3 in section 384.16 or 384.18. In addition, the provisions 2 4 allowing persons affected by the budget to file a written 2 5 protest with the county auditor as provided in section 384.19 2 6 are inapplicable. 2 7 c. A qualified city that meets the extended submission 2 8 deadline as provided in this subsection shall be deemed to 2 9 have complied with the requirements of section 384.16 on March 2 10 15, 2006. 2 11 Sec. 2.
