  1  3                             AN ACT
  1  4 ESTABLISHING A LOW HEAD DAM PUBLIC HAZARD PROGRAM.

  1  6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  8    Section 1.  NEW SECTION.  464A.11  WATER TRAILS AND LOW
  1  9 HEAD DAM PUBLIC HAZARD STATEWIDE PLAN.
  1 10    1.  The department shall establish a water trails and low
  1 11 head dam public hazard program.
  1 12    2.  In administering the water trails and low head dam
  1 13 public hazard program, the department shall conduct a study of
  1 14 waterways for recreational purposes and develop a statewide
  1 15 plan by January 1, 2010.  Elements of the plan shall include
  1 16 but not be limited to:
  1 17    a.  Compiling an inventory of low head dams, including a
  1 18 listing of those low head dams, for the purposes of
  1 19 publicizing hazards through maps and warning signage.
  1 20    b.  Seeking input from the public and experts in various
  1 21 fields, including fisheries, rescue professionals, water
  1 22 recreation, river management, public utilities conservation,
  1 23 and landscape architecture to be used in the recreation and
  1 24 safety components of the plan.
  1 25    c.  Developing standard recommendations for local
  1 26 communities including signage system and placement guidelines,
  1 27 boating access type, placement and construction guidelines,
  1 28 and volunteer recommendations for communities.
  1 29    d.  Recommending design templates for low head dams to
  1 30 reduce incidents of drowning.
  1 31    e.  With input from stakeholders, developing criteria for
  1 32 prioritizing removal or modification of low head dams.
  1 33    f.  With input from stakeholders, developing criteria for
  1 34 prioritizing development of water trails.
  1 35    3.  The department may contract with a university or
  2  1 private consultant in order to assist with development of the
  2  2 plan.
  2  3    Sec. 2.  IMPLEMENTATION.  The department of natural
  2  4 resources is not required to implement section 464A.11, as
  2  5 enacted in this Act, until the department is appropriated
  2  6 moneys necessary to carry out the section.
