  1  4 MODIFYING PROVISIONS RELATING TO THE APPLICATION FOR A
  1  5    CERTIFICATE OF FRANCHISE AUTHORITY APPLICABLE TO THE
  1  6    PROVISION OF CABLE OR VIDEO SERVICES BY AN EXISTING
  1  7    PROVIDER.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1 11    Section 1.  Section 477A.1, subsection 12, Code Supplement
  1 12 2007, is amended to read as follows:
  1 13    12.  "Municipality" means a county or city.
  1 14    Sec. 2.  Section 477A.2, subsection 2, paragraph b, Code
  1 15 Supplement 2007, is amended to read as follows:
  1 16    b.  Upon expiration of a franchise, a person may choose to
  1 17 renegotiate a franchise agreement with a municipality or may
  1 18 choose to obtain a certificate of franchise authority under
  1 19 this chapter.  An application for a certificate of franchise
  1 20 authority pursuant to this subsection may be filed within
  1 21 sixty days prior to the expiration of a municipal franchise
  1 22 agreement.  A certificate of franchise authority obtained
  1 23 pursuant to an application filed prior to the expiration of a
  1 24 municipal franchise agreement shall take effect upon the
  1 25 expiration date of the municipal franchise agreement.
