  1  4 RELATING TO AMUSEMENT RIDE SAFETY INSPECTION FEES AND SPECIAL
  1  5    INSPECTORS AUTHORIZED BY THE DIVISION OF LABOR SERVICES
  1  6    IN THE DEPARTMENT OF WORKFORCE DEVELOPMENT AND PROVIDING
  1  7    AN EFFECTIVE DATE.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1 11    Section 1.  Section 88A.3, Code 2007, is amended to read as
  1 12 follows:
  1 13    88A.3  RULES.
  1 14    The commissioner shall adopt and issue rules for the safe
  1 15 installation, repair, maintenance, use, operation, and
  1 16 inspection of amusement devices, amusement rides, concession
  1 17 booths, and related electrical equipment at carnivals and
  1 18 fairs to the extent necessary for the protection of the
  1 19 public.  The rules shall be based upon on generally accepted
  1 20 engineering standards and shall be concerned with, but not
  1 21 necessarily limited to, engineering force stresses, safety
  1 22 devices, and preventive maintenance.  Whenever such If
  1 23 standards are available in suitable form they, the standards
  1 24 may be incorporated by reference.  The rules shall provide for
  1 25 the reporting of accidents and injuries incurred from the
  1 26 operation of amusement devices or rides, concession booths, or
  1 27 related electrical equipment.
  1 28    The commissioner may modify or repeal any rule adopted
  1 29 under the provisions of this chapter.
  1 30    Sec. 2.  Section 88A.4, Code 2007, is amended to read as
  1 31 follows:
  1 32    88A.4  PERMIT AND INSPECTION FEES == NONLIABILITY AND
  1 33 SPECIAL INSPECTORS.
  1 34    Annual inspection fees under this chapter shall be as
  1 35 follows:
  2  1    1.  Permit fees.
  2  2    a.  One through ten rides, or devices or concessions,
  2  3 twenty thirty dollars.
  2  4    b.  Eleven or more rides, or devices or concessions, thirty
  2  5 forty dollars.
  2  6    2.  Mechanical and electrical inspection fees for amusement
  2  7 rides and devices.
  2  8    a.  For rides which are designed for seventy=five pounds or
  2  9 less per passenger unit, sixty seventy=five dollars for each
  2 10 inspection.
  2 11    b.  For rides which are designed for seventy=five pounds or
  2 12 more and for which the manufacturer's recommended assembly
  2 13 time is less than forty work hours, ninety one hundred ten
  2 14 dollars for each inspection.
  2 15    c.  For rides for which the manufacturer's recommended
  2 16 assembly time is forty work hours or more, one hundred twenty
  2 17 two hundred fifty dollars for each inspection.
  2 18    3.  Electrical inspection of concession booths, and
  2 19 amusement devices fees, thirty=five forty dollars each.
  2 20    4.  Special inspectors authorization fee, twenty=five
  2 21 dollars each.  The special inspectors authorization shall
  2 22 allow a person to perform inspections only on rides, devices,
  2 23 and concession booths of an operator who makes the request for
  2 24 the special inspectors authorization.  The failure of a
  2 25 special inspector to inform the commissioner of violations
  2 26 shall not subject the commissioner to liability for any
  2 27 damages incurred.
  2 28    Sec. 3.  EFFECTIVE DATE.  The portion of the section of
  2 29 this Act amending section 88A.4, subsections 1 through 3,
  2 30 takes effect January 1, 2009.
