  1  4 RELATING TO INCLINED OR VERTICAL WHEELCHAIR LIFTS REGULATED BY
  1  5    THE ELEVATOR SAFETY BOARD.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  9    Section 1.  Section 89A.1, subsection 10, Code Supplement
  1 10 2007, is amended to read as follows:
  1 11    10.  "Inclined or vertical wheelchair lift" means a lift
  1 12 used as part of an accessible route in or at a public building
  1 13 to transport a wheelchair as specified in the American society
  1 14 of mechanical engineers safety codes for elevators and
  1 15 escalators, A17.1 standard for platform lifts and stairway
  1 16 chairlifts, A18.1.
  1 17    Sec. 2.  Section 89A.2, Code Supplement 2007, is amended to
  1 18 read as follows:
  1 19    89A.2  SCOPE OF CHAPTER.
  1 20    1.  The provisions of this chapter shall not apply to any
  1 21 of the following:
  1 22    a.  Any conveyance installed in any single private dwelling
  1 23 residence, to conveyances.
  1 24    b.  Material hoists subject to regulation under 875 IAC
  1 25 26.1 and 29 C.F.R. } 1926.552, to lifts.
  1 26    c.  Lifts subject to regulation under chapter 88, to
  1 27 material.
  1 28    d.  Material lift elevators existing in the same location
  1 29 since prior to January 1, 1975, or to conveyances.
  1 30    e.  Conveyances over which an agency of the federal
  1 31 government is asserting similar enforcement jurisdiction.
  1 32    2.  Provisions of this chapter supersede conflicting
  1 33 provisions contained in building codes of this state or any
  1 34 subdivision thereof.
  1 35    Sec. 3.  Section 89A.9, subsection 2, Code Supplement 2007,
  2  1 is amended to read as follows:
  2  2    2.  The operating permit shall indicate the type of
  2  3 equipment for which it is issued, and in the case of elevators
  2  4 shall state whether passenger or freight, and also shall state
  2  5 the contract load and speed for each conveyance.  The permit
  2  6 shall be posted conspicuously in the car of an elevator, or on
  2  7 or near a dumbwaiter, escalator, moving walk, or inclined or
  2  8 vertical wheelchair lift.
