1 4 RELATING TO REQUIREMENTS FOR BLOOD LEAD TESTING AND DENTAL
1 5 SCREENING OF CHILDREN.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 135.17, subsection 2, as enacted by
1 10 2007 Iowa Acts, chapter 146, section 1, is amended by striking
1 11 the subsection and inserting in lieu thereof the following:
1 12 2. Each public and nonpublic school shall, in
1 13 collaboration with the department, do the following:
1 14 a. Assure that the parent or guardian of a student
1 15 enrolled in the school has complied with the requirements of
1 16 subsection 1.
1 17 b. Provide, if a student has not had a dental screening
1 18 performed in accordance with subsection 1, the parent or
1 19 guardian of the student with community dental screening
1 20 referral resources, including contact information for the
1 21 i=smile coordinator, department, or dental society.
1 22 Sec. 2. Section 135.17, subsection 3, as enacted by 2007
1 23 Iowa Acts, chapter 146, section 1, is amended by striking the
1 24 subsection.
1 25 Sec. 3. Section 135.17, subsection 4, as enacted by 2007
1 26 Iowa Acts, chapter 146, section 1, is amended to read as
1 27 follows:
1 28 4. Each By June 30 annually, each local board shall
1 29 furnish the department, within sixty days after the start of
1 30 the school year, with evidence that each person enrolled in
1 31 any public or nonpublic school within the local board's
1 32 jurisdiction has met the dental screening requirement in this
1 33 section.
1 34 Sec. 4. Section 135.105D, subsection 2, paragraph b, Code
1 35 Supplement 2007, is amended by striking the paragraph and
2 1 inserting the following:
2 2 b. The board of directors of each school district and the
2 3 authorities in charge of each nonpublic school shall, in
2 4 collaboration with the department, do the following:
2 5 (1) Assure that the parent or guardian of a student
2 6 enrolled in the school has complied with the requirements of
2 7 paragraph "a".
2 8 (2) Provide, if the parent or guardian cannot provide
2 9 evidence that the child received a blood lead test in
2 10 accordance with paragraph "a", the parent or guardian with
2 11 community blood lead testing program information, including
2 12 contact information for the department.
2 13 Sec. 5. Section 135.105D, subsection 2, paragraph c, Code
2 14 Supplement 2007, is amended by striking the paragraph.
2 15 Sec. 6. Section 135.105D, subsection 3, Code Supplement
2 16 2007, is amended to read as follows:
2 17 3. The board of directors of each school district and the
2 18 authorities in charge of each nonpublic school shall furnish
2 19 the department, in the format specified by the department,
2 20 within sixty days after the first official day start of the
2 21 school calendar, evidence that each child a list of the
2 22 children enrolled in any elementary school has either been
2 23 tested as required in subsection 2 or received a waiver under
2 24 subsection 4 kindergarten. The department shall notify the
2 25 school districts and nonpublic schools of the children who
2 26 have not met the blood lead testing requirements set forth in
2 27 this section and shall work with the school districts,
2 28 nonpublic schools, and the local childhood lead poisoning
2 29 prevention programs to assure that these children are tested
2 30 as required by this section.
