Senate File 2089 - Enrolled PAG LIN 1 1 SENATE FILE 2089 1 2 1 3 AN ACT 1 4 RELATING TO APPLICATIONS FOR ABSENTEE BALLOTS. 1 5 1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 7 1 8 Section 1. Section 53.2, subsection 2, Code Supplement 1 9 2007, is amended to read as follows: 1 10 2. a. The state commissioner shall prescribe a form for 1 11 absentee ballot applications. However, if a registered voter 1 12 submits an application on a sheet of paper no smaller than 1 13 three by five inches in size that includes all of the 1 14 information required in this section, the prescribed form is 1 15 not required. 1 16 b. Absentee ballot applications may include instructions 1 17 to send the application directly to the county commissioner of 1 18 elections. However, no absentee ballot application shall be 1 19 preaddressed or printed with instructions to send the 1 20 applications to anyone other than the appropriate 1 21 commissioner. 1 22 c. No absentee ballot application shall be preaddressed or 1 23 printed with instructions to send the ballot to anyone other 1 24 than the voter. 1 25 Sec. 2. Section 53.2, subsection 4, Code Supplement 2007, 1 26 is amended to read as follows: 1 27 4. Each application shall contain the name and signature 1 28 of the registered voter, the registered voter's date of birth, 1 29 the address at which the voter is registered to vote, and the 1 30 name or date of the election for which the absentee ballot is 1 31 requested, and such other information as may be necessary to 1 32 determine the correct absentee ballot for the registered 1 33 voter. If insufficient information has been provided, either 1 34 on the prescribed form or on an application created by the 1 35 applicant, the commissioner shall, by the best means 2 1 available, obtain the additional necessary information. 2 2 Sec. 3. Section 53.3, Code 2007, is amended to read as 2 3 follows: 2 4 53.3RECEIPT REQUIREDREQUIREMENTS FOR CERTAIN ABSENTEE 2 5 BALLOT APPLICATIONS == PRESCRIBED FORM == RECEIPT. 2 6 1. When an application for an absentee ballot is solicited 2 7 by, or collected for return to the commissioner by, a person 2 8 acting as an actual or implied agent for a political party, 2 9 candidate, or committee, as defined by chapter 68A, the person 2 10 shall provide the applicant with the form prescribed by the 2 11 state commissioner. 2 12 2. a. When an application for an absentee ballot is 2 13 solicited by, and returned to the commissioner by, a person 2 14 acting as an actual or implied agent for a political party, 2 15 candidate, or committee, as defined by chapter 68A, the person 2 16 shall issue to the applicant a receipt for the completed 2 17 application. 2 18 b. The receipt shall contain the following information: 2 191.(1) The name of the applicant. 2 202.(2) The date and time the completed application was 2 21 received from the applicant. 2 223.(3) The name and date of the election for which the 2 23 application is being completed. 2 244.(4) The name of the political party, candidate, or 2 25 committee for whom the person is soliciting and returning the 2 26 application for the absentee ballot. 2 275.(5) The name of the person acting as an actual or 2 28 implied agent for the political party, candidate, or 2 29 committee. 2 306.(6) A statement that the application will be delivered 2 31 to the appropriate commissioner within seventy=two hours of 2 32 the date and time the completed application was received from 2 33 the applicant or no later than five p.m. on the Friday before 2 34 the election, whichever is earlier. 2 357.(7) A statement that an absentee ballot will be mailed 3 1 to the applicant within twenty=four hours after the ballot for 3 2 the election is available. 3 3 c.
