  1  4 RELATING TO THE REGULATION OF HOSPITALS AND HEALTH CARE
  1  5    FACILITIES BY THE DEPARTMENT OF INSPECTIONS AND APPEALS,
  1  6    INCLUDING INVESTIGATIONS OF COMPLAINTS AGAINST HEALTH CARE
  1  7    FACILITIES AND RULES RELATING TO AUTHENTICATION OF CERTAIN
  1  8    ORDERS BY PRACTITIONERS, AND PROVIDING AN IMMEDIATE
  1  9    EFFECTIVE DATE.

  1 11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 12
  1 13    Section 1.  Section 135B.7A, Code 2007, is amended to read
  1 14 as follows:
  1 15    135B.7A  PROCEDURES == ORDERS.
  1 16    The department shall adopt rules that require hospitals to
  1 17 establish procedures for authentication of medication and
  1 18 standing all verbal orders by a practitioner within a period
  1 19 not to exceed thirty days following a patient's discharge.
  1 20    Sec. 2.  Section 135C.38, subsection 1, paragraph a, Code
  1 21 2007, is amended to read as follows:
  1 22    a.  Upon receipt of a complaint made in accordance with
  1 23 section 135C.37, the department or resident advocate committee
  1 24 shall make a preliminary review of the complaint.  Unless the
  1 25 department or committee concludes that the complaint is
  1 26 intended to harass a facility or a licensee or is without
  1 27 reasonable basis, it the department or committee shall within
  1 28 twenty working days of receipt of the complaint make or cause
  1 29 to be made an on=site inspection of the health care facility
  1 30 which is the subject of the complaint. within the time period
  1 31 determined pursuant to the following guidelines, which period
  1 32 shall commence on the date of receipt of the complaint:
  1 33    (1)  For nursing facilities, an on=site inspection shall be
  1 34 initiated as follows:
  1 35    (a)  Within two working days for a complaint determined by
  2  1 the department or committee to be an alleged immediate
  2  2 jeopardy situation.
  2  3    (b)  Within ten working days for a complaint determined by
  2  4 the department or committee to be an alleged high=level,
  2  5 nonimmediate jeopardy situation.
  2  6    (c)  Within forty=five calendar days for a complaint
  2  7 determined by the department or committee to be an alleged
  2  8 nonimmediate jeopardy situation, other than a high=level
  2  9 situation.
  2 10    (2)  For all other types of health care facilities, an
  2 11 on=site inspection shall be initiated as follows:
  2 12    (a)  Within two working days for a complaint determined by
  2 13 the department or committee to be an alleged immediate
  2 14 jeopardy situation.
  2 15    (b)  Within twenty working days for a complaint determined
  2 16 by the department or committee to be an alleged high=level,
  2 17 nonimmediate jeopardy situation.
  2 18    (c)  Within forty=five calendar days for a complaint
  2 19 determined by the department or committee to be an alleged
  2 20 nonimmediate jeopardy situation, other than a high=level
  2 21 situation.
  2 22    Sec. 3.  2001 Iowa Acts, chapter 93, section 2, is
  2 23 repealed.
  2 24    Sec. 4.  EFFECTIVE DATE.  The section of this Act repealing
  2 25 2001 Iowa Acts, chapter 93, section 2, being deemed of
  2 26 immediate importance, takes effect upon enactment.
