  1  4 RELATING TO ABUSE OF A HUMAN CORPSE AND PROVIDING PENALTIES.

  1  6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  8    Section 1.  Section 229A.2, subsection 10, paragraph a,
  1  9 Code 2007, is amended to read as follows:
  1 10    a.  A violation of any provision of chapter 709, except
  1 11 section 709.18, subsection 2 or 3.
  1 12    Sec. 2.  Section 709.18, Code 2007, is amended to read as
  1 13 follows:
  1 14    709.18  ABUSE OF A CORPSE.
  1 15    1.  A person commits abuse of a human corpse if the person
  1 16 knowingly and intentionally engages in a sex act, as defined
  1 17 in section 702.17, with a human corpse.  Abuse of a human
  1 18 corpse is a class "D" felony.
  1 19    2.  A person commits abuse of a human corpse if the person
  1 20 mutilates, disfigures, or dismembers a human corpse with the
  1 21 intent to conceal a crime.
  1 22    3.  A person commits abuse of a human corpse if the person
  1 23 hides or buries a human corpse with the intent to conceal a
  1 24 crime.
  1 25    4.  A person who violates this section commits a class "D"
  1 26 felony.
