  1  4 RELATING TO AND MAKING APPROPRIATIONS TO THE DEPARTMENT OF
  1  5    CULTURAL AFFAIRS, THE DEPARTMENT OF ECONOMIC DEVELOPMENT,
  1  6    CERTAIN BOARD OF REGENTS INSTITUTIONS, THE DEPARTMENT OF
  1  7    WORKFORCE DEVELOPMENT, AND THE PUBLIC EMPLOYMENT RELATIONS
  1  8    BOARD, AND RELATED MATTERS AND PROVIDING EFFECTIVE DATES.

  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 11
  1 12    Section 1.  DEPARTMENT OF CULTURAL AFFAIRS.  There is
  1 13 appropriated from the general fund of the state to the
  1 14 department of cultural affairs for the fiscal year beginning
  1 15 July 1, 2008, and ending June 30, 2009, the following amounts,
  1 16 or so much thereof as is necessary, to be used for the
  1 17 purposes designated:
  1 18    1.  ADMINISTRATION
  1 19    For salaries, support, maintenance, miscellaneous purposes,
  1 20 and for not more than the following full=time equivalent
  1 21 positions:
  1 22 .................................................. $    255,418
  1 23 ............................................... FTEs       2.35
  1 24    The department of cultural affairs shall coordinate
  1 25 activities with the tourism office of the department of
  1 26 economic development to promote attendance at the state
  1 27 historical building and at this state's historic sites.
  1 28    2.  COMMUNITY CULTURAL GRANTS
  1 29    For planning and programming for the community cultural
  1 30 grants program established under section 303.3:

  1 32    3.  HISTORICAL DIVISION
  1 33    For salaries, support, maintenance, miscellaneous purposes,
  1 34 and for not more than the following full=time equivalent

  2  3    From the moneys appropriated under this subsection, the
  2  4 department shall use $50,000 for purposes of planning
  2  5 commemoration activities for the sesquicentennial anniversary
  2  6 of the civil war and Iowa's participation in the civil war.
  2  7 Such activities may include activities in Iowa, activities
  2  8 through partnerships with other states, and activities on a
  2  9 national level.
  2 10    4.  HISTORIC SITES
  2 11    For salaries, support, maintenance, miscellaneous purposes,
  2 12 and for not more than the following full=time equivalent

  3  2    For administration of the Iowa cultural caucus:
  3  3 .................................................. $     20,000
  3  4    Sec. 2.  GOALS AND ACCOUNTABILITY == ECONOMIC DEVELOPMENT.
  3  5    1.  The goals for the department of economic development
  3  6 shall be to expand and stimulate the state economy, increase
  3  7 the wealth of Iowans, and increase the population of the
  3  8 state.
  3  9    2.  To achieve the goals in subsection 1, the department of
  3 10 economic development shall do all of the following:
  3 11    a.  Concentrate its efforts on programs and activities that
  3 12 result in commercially viable products and services.
  3 13    b.  Adopt practices and services consistent with free
  3 14 market, private sector philosophies.
  3 15    c.  Ensure economic growth and development throughout the
  3 16 state.
  3 17    Sec. 3.  SUSTAINABLE COMMUNITY DEVELOPMENT ==
  3 18 APPROPRIATION.  There is appropriated from any interest or
  3 19 earnings on moneys in the grow Iowa values fund to the
  3 20 department of economic development for the fiscal year
  3 21 beginning July 1, 2008, and ending June 30, 2009, the
  3 22 following amount, or so much thereof as is necessary, to be
  3 23 used for the purposes designated:
  3 24    For the administration of a sustainable community
  3 25 development initiative:
  3 26 .................................................. $    500,000
  3 27    Notwithstanding section 8.33, moneys appropriated in this
  3 28 section that remain unencumbered or unobligated at the close
  3 29 of the fiscal year shall not revert but shall remain available
  3 30 for expenditure for the purposes designated until the close of
  3 31 the succeeding fiscal year.
  3 32    Sec. 4.  DEPARTMENT OF ECONOMIC DEVELOPMENT.  There is
  3 33 appropriated from the general fund of the state to the
  3 34 department of economic development for the fiscal year
  3 35 beginning July 1, 2008, and ending June 30, 2009, the
  4  1 following amounts, or so much thereof as is necessary, to be
  4  2 used for the purposes designated:
  4  3    1.  ADMINISTRATION DIVISION
  4  4    a.  General administration
  4  5    For salaries, support, maintenance, miscellaneous purposes,
  4  6 and programs; for transfer to the Iowa state commission grant
  4  7 program; and for not more than the following full=time
  4  8 equivalent positions:
  4  9 .................................................. $  2,175,661
  4 10 ............................................... FTEs      28.75
  4 11    From the money appropriated under this subsection, the
  4 12 department shall use $50,000 for administration of the
  4 13 generation Iowa commission.
  4 14    b.  The department shall work with businesses and
  4 15 communities to continually improve the economic development
  4 16 climate along with the economic well=being and quality of life
  4 17 for Iowans.  The administration division shall coordinate with
  4 18 other state agencies to ensure that all state departments are
  4 19 attentive to the needs of an entrepreneurial culture.
  4 20    2.  BUSINESS DEVELOPMENT DIVISION
  4 21    a.  Business development operations
  4 22    For business development operations and programs, the film
  4 23 office, international trade, export assistance, workforce
  4 24 recruitment, and the partner state program; for transfer to
  4 25 the strategic investment fund; for transfer to the value=added
  4 26 agricultural products and processes financial assistance fund;
  4 27 for salaries, support, maintenance, miscellaneous purposes;
  4 28 and for not more than the following full=time equivalent
  4 29 positions:
  4 30 .................................................. $  6,611,963
  4 31 ............................................... FTEs      62.00
  4 32    The department shall utilize 1.00 of the full=time
  4 33 equivalent positions authorized under this subsection for
  4 34 marketing and compliance activities of the targeted small
  4 35 business program.
  5  1    b.  The department shall establish a strong and aggressive
  5  2 marketing image to showcase Iowa's workforce, existing
  5  3 industry, and potential.  A priority shall be placed on
  5  4 recruiting new businesses, business expansion, and retaining
  5  5 existing Iowa businesses.  Emphasis shall also be placed on
  5  6 entrepreneurial development through helping to secure capital
  5  7 for entrepreneurs, and developing networks and a business
  5  8 climate conducive to entrepreneurs and small business.
  5  9    c.  A business creating jobs with economic development
  5 10 assistance through moneys appropriated in this subsection
  5 11 shall be subject to contract provisions stating that new and
  5 12 retained jobs shall be filled by individuals who are citizens
  5 13 of the United States who reside within the United States or
  5 14 any person authorized to work in the United States pursuant to
  5 15 federal law, including legal resident aliens in the United
  5 16 States.  Any vendor who receives such public moneys shall
  5 17 adhere to such contract provisions and provide periodic
  5 18 assurances as the state shall require that the jobs are filled
  5 19 solely by citizens of the United States who reside within the
  5 20 United States or any person authorized to work in the United
  5 21 States pursuant to federal law, including legal resident
  5 22 aliens in the United States.
  5 23    d.  From the moneys appropriated in this subsection, the
  5 24 department may provide financial assistance in the form of a
  5 25 grant to a community economic development entity for
  5 26 conducting a local workforce recruitment effort designed to
  5 27 recruit former citizens of the state and former students at
  5 28 colleges and universities in the state to meet the needs of
  5 29 local employers.
  5 30    e.  From the moneys appropriated in this subsection, the
  5 31 department may provide financial assistance to early=stage
  5 32 industry companies being established by women entrepreneurs.
  5 33    f.  From the moneys appropriated in this subsection, the
  5 34 department may provide financial assistance in the form of
  5 35 grants, loans, or forgivable loans for advanced research and
  6  1 commercialization projects involving value=added agriculture,
  6  2 advanced technology, or biotechnology.
  6  3    g.  Notwithstanding section 8.33, moneys appropriated in
  6  4 this subsection that remain unencumbered or unobligated at the
  6  5 close of the fiscal year shall not revert but shall remain
  6  6 available for expenditure for the purposes designated until
  6  7 the close of the succeeding fiscal year.
  6  8    3.  COMMUNITY DEVELOPMENT DIVISION
  6  9    a.  Community development programs
  6 10    For salaries, support, maintenance, miscellaneous purposes,
  6 11 community economic development programs, tourism operations,
  6 12 community assistance, plans for Iowa green corps and summer
  6 13 youth programs, the mainstreet and rural mainstreet programs,
  6 14 the school=to=career program, the community development block
  6 15 grant, and housing and shelter=related programs, and for not
  6 16 more than the following full=time equivalent positions:
  6 17 .................................................. $  6,448,716
  6 18 ............................................... FTEs      58.26
  6 19    b.  The department shall encourage development of
  6 20 communities and quality of life to foster economic growth.
  6 21 The department shall prepare communities for future growth and
  6 22 development through development, expansion, and modernization
  6 23 of infrastructure.
  6 24    c.  The department shall develop public=private
  6 25 partnerships with Iowa businesses in the tourism industry,
  6 26 Iowa tour groups, Iowa tourism organizations, and political
  6 27 subdivisions in this state to assist in the development of
  6 28 advertising efforts.  The department shall, to the fullest
  6 29 extent possible, develop cooperative efforts for advertising
  6 30 with contributions from other sources.
  6 31    d.  Notwithstanding section 8.33, moneys appropriated in
  6 32 this subsection that remain unencumbered or unobligated at the
  6 33 close of the fiscal year shall not revert to any fund but
  6 34 shall remain available for expenditure for the designated
  6 35 purposes during the succeeding fiscal year.
  7  1    4.  For allocating moneys for the world food prize:
  7  2 .................................................. $  1,000,000
  7  3    5.  For use as matching funds for the United States
  7  4 department of housing and urban development's main street
  7  5 challenge grants for historic building preservation:
  7  6 .................................................. $    200,000
  7  7    Sec. 5.  VISION IOWA PROGRAM == FTE AUTHORIZATION.  For
  7  8 purposes of administrative duties associated with the vision
  7  9 Iowa program, the department of economic development is
  7 10 authorized an additional 2.25 full=time equivalent positions
  7 11 above those otherwise authorized in this Act.
  7 12    Sec. 6.  COUNCILS OF GOVERNMENTS.
  7 13    1.  There is appropriated from loan repayments on loans
  7 14 made under the former rural community 2000 program, sections
  7 15 15.281 through 15.288, Code 2001, to the department of
  7 16 economic development for the fiscal year beginning July 1,
  7 17 2008, and ending June 30, 2009, any funds available in the
  7 18 rural community 2000 fund.
  7 19    2.  There is appropriated from any interest or earning on
  7 20 moneys in the grow Iowa values fund created in section 15G.108
  7 21 to the department of economic development for the fiscal year
  7 22 beginning July 1, 2008, and ending June 30, 2009, the sum of:
  7 23 .................................................. $    160,000
  7 24    3.  Moneys appropriated under subsections 1 and 2 of this
  7 25 section shall be used for providing financial assistance to
  7 26 Iowa's councils of governments that provide technical and
  7 27 planning assistance to local governments.
  7 28    Sec. 7.  INSURANCE ECONOMIC DEVELOPMENT.  From the moneys
  7 29 collected by the division of insurance in excess of the
  7 30 anticipated gross revenues under section 505.7, subsection 3,
  7 31 during the fiscal year beginning July 1, 2008, $100,000 shall
  7 32 be transferred to the department of economic development for
  7 33 insurance economic development and international insurance
  7 34 economic development.
  7 35    Sec. 8.  COMMUNITY DEVELOPMENT LOAN FUND.  Notwithstanding
  8  1 section 15E.120, subsection 5, there is appropriated from the
  8  2 Iowa community development loan fund all the moneys available
  8  3 during the fiscal year beginning July 1, 2008, and ending June
  8  4 30, 2009, to the department of economic development for the
  8  5 community development program to be used by the department for
  8  6 the purposes of the program.
  8  7    Sec. 9.  WORKFORCE DEVELOPMENT FUND.  There is appropriated
  8  8 from the workforce development fund account created in section
  8  9 15.342A to the workforce development fund created in section
  8 10 15.343 for the fiscal year beginning July 1, 2008, and ending
  8 11 June 30, 2009, the following amount, for the purposes of the
  8 12 workforce development fund, and for not more than the
  8 13 following full=time equivalent positions:
  8 14 .................................................. $  4,000,000
  8 15 ............................................... FTEs       4.00
  8 16    Sec. 10.  WORKFORCE DEVELOPMENT ADMINISTRATION.  From funds
  8 17 appropriated or transferred to or receipts credited to the
  8 18 workforce development fund created in section 15.343, up to
  8 19 $400,000 for the fiscal year beginning July 1, 2008, and
  8 20 ending June 30, 2009, may be used for the administration of
  8 21 workforce development activities including salaries, support,
  8 22 maintenance, and miscellaneous purposes, and for not more than
  8 23 4.00 full=time equivalent positions.
  8 24    Sec. 11.  JOB TRAINING FUND.  Notwithstanding section
  8 25 15.251, all remaining moneys in the job training fund on July
  8 26 1, 2008, and any moneys appropriated or credited to the fund
  8 27 during the fiscal year beginning July 1, 2008, shall be
  8 28 transferred to the workforce development fund established
  8 29 pursuant to section 15.343.
  8 30    Sec. 12.  IOWA STATE UNIVERSITY.
  8 31    1.  There is appropriated from the general fund of the
  8 32 state to Iowa state university of science and technology for
  8 33 the fiscal year beginning July 1, 2008, and ending June 30,
  8 34 2009, the following amount, or so much thereof as is
  8 35 necessary, to be used for small business development centers,
  9  1 the science and technology research park, and the institute
  9  2 for physical research and technology, and for not more than
  9  3 the following full=time equivalent positions:
  9  4 .................................................. $  2,949,625
  9  5 ............................................... FTEs      56.63
  9  6    2.  Of the moneys appropriated in subsection 1, Iowa state
  9  7 university of science and technology shall allocate at least
  9  8 $1,060,000 for purposes of funding small business development
  9  9 centers.  Iowa state university of science and technology may
  9 10 allocate moneys appropriated in subsection 1 to the various
  9 11 small business development centers in any manner necessary to
  9 12 achieve the purposes of this subsection.
  9 13    3.  Iowa state university of science and technology shall
  9 14 do all of the following:
  9 15    a.  Direct expenditures for research toward projects that
  9 16 will provide economic stimulus for Iowa.
  9 17    b.  Provide emphasis to providing services to Iowa=based
  9 18 companies.
  9 19    4.  It is the intent of the general assembly that the
  9 20 industrial incentive program focus on Iowa industrial sectors
  9 21 and seek contributions and in=kind donations from businesses,
  9 22 industrial foundations, and trade associations, and that
  9 23 moneys for the institute for physical research and technology
  9 24 industrial incentive program shall be allocated only for
  9 25 projects which are matched by private sector moneys for
  9 26 directed contract research or for nondirected research.  The
  9 27 match required of small businesses as defined in section
  9 28 15.102, subsection 4, for directed contract research or for
  9 29 nondirected research shall be $1 for each $3 of state funds.
  9 30 The match required for other businesses for directed contract
  9 31 research or for nondirected research shall be $1 for each $1
  9 32 of state funds.  The match required of industrial foundations
  9 33 or trade associations shall be $1 for each $1 of state funds.
  9 34    Iowa state university of science and technology shall
  9 35 report annually to the joint appropriations subcommittee on
 10  1 economic development and the legislative services agency the
 10  2 total amount of private contributions, the proportion of
 10  3 contributions from small businesses and other businesses, and
 10  4 the proportion for directed contract research and nondirected
 10  5 research of benefit to Iowa businesses and industrial sectors.
 10  6    Notwithstanding section 8.33, moneys appropriated in this
 10  7 section that remain unencumbered or unobligated at the close
 10  8 of the fiscal year shall not revert but shall remain available
 10  9 for expenditure for the purposes designated until the close of
 10 10 the succeeding fiscal year.
 10 11    Sec. 13.  UNIVERSITY OF IOWA.
 10 12    1.  There is appropriated from the general fund of the
 10 13 state to the state university of Iowa for the fiscal year
 10 14 beginning July 1, 2008, and ending June 30, 2009, the
 10 15 following amount, or so much thereof as is necessary, to be
 10 16 used for the state university of Iowa research park and for
 10 17 the advanced drug development program at the Oakdale research
 10 18 park, including salaries, support, maintenance, equipment,
 10 19 miscellaneous purposes, and for not more than the following
 10 20 full=time equivalent positions:
 10 21 .................................................. $    259,206
 10 22 ............................................... FTEs       6.00
 10 23    2.  The state university of Iowa shall do all of the
 10 24 following:
 10 25    a.  Direct expenditures for research toward projects that
 10 26 will provide economic stimulus for Iowa.
 10 27    b.  Provide emphasis to providing services to Iowa=based
 10 28 companies.
 10 29    3.  Notwithstanding section 8.33, moneys appropriated in
 10 30 this section that remain unencumbered or unobligated at the
 10 31 close of the fiscal year shall not revert but shall remain
 10 32 available for expenditure for the purposes designated until
 10 33 the close of the succeeding fiscal year.
 10 34    Sec. 14.  UNIVERSITY OF NORTHERN IOWA.
 10 35    1.  There is appropriated from the general fund of the
 11  1 state to the university of northern Iowa for the fiscal year
 11  2 beginning July 1, 2008, and ending June 30, 2009, the
 11  3 following amount, or so much thereof as is necessary, to be
 11  4 used for the metal casting institute, for the MyEntreNet
 11  5 internet application, and for the institute of decision
 11  6 making, including salaries, support, maintenance,
 11  7 miscellaneous purposes, and for not more than the following
 11  8 full=time equivalent positions:
 11  9 .................................................. $    578,608
 11 10 ............................................... FTEs       6.75
 11 11    2.  The university of northern Iowa shall do all of the
 11 12 following:
 11 13    a.  Direct expenditures for research toward projects that
 11 14 will provide economic stimulus for Iowa.
 11 15    b.  Provide emphasis to providing services to Iowa=based
 11 16 companies.
 11 17    3.  Notwithstanding section 8.33, moneys appropriated in
 11 18 this section that remain unencumbered or unobligated at the
 11 19 close of the fiscal year shall not revert but shall remain
 11 20 available for expenditure for the purposes designated until
 11 21 the close of the succeeding fiscal year.
 11 22    Sec. 15.  BOARD OF REGENTS REPORT.  The state board of
 11 23 regents shall submit a report on the progress of regents
 11 24 institutions in meeting the strategic plan for technology
 11 25 transfer and economic development to the secretary of the
 11 26 senate, the chief clerk of the house of representatives, and
 11 27 the legislative services agency by January 15, 2009.
 11 28    Sec. 16.  DEPARTMENT OF WORKFORCE DEVELOPMENT.  There is
 11 29 appropriated from the general fund of the state to the
 11 30 department of workforce development for the fiscal year
 11 31 beginning July 1, 2008, and ending June 30, 2009, the
 11 32 following amounts, or so much thereof as is necessary, for the
 11 33 purposes designated:
 11 34    1.  DIVISION OF LABOR SERVICES
 11 35    For the division of labor services, including salaries,
 12  1 support, maintenance, miscellaneous purposes, and for not more
 12  2 than the following full-time equivalent positions:
 12  3 .................................................. $  3,849,581
 12  4 ............................................... FTEs      68.15
 12  5    From the contractor registration fees, the division of
 12  6 labor services shall reimburse the department of inspections
 12  7 and appeals for all costs associated with hearings under
 12  8 chapter 91C, relating to contractor registration.
 12  9    2.  DIVISION OF WORKERS' COMPENSATION
 12 10    For salaries, support, maintenance, miscellaneous purposes,
 12 11 and for not more than the following full-time equivalent
 12 12 positions:
 12 13 .................................................. $  2,885,774
 12 14 ............................................... FTEs      30.00
 12 15    The division of workers' compensation shall continue
 12 16 charging a $65 filing fee for workers' compensation cases.
 12 17 The filing fee shall be paid by the petitioner of a claim.
 12 18 However, the fee can be taxed as a cost and paid by the losing
 12 19 party, except in cases where it would impose an undue hardship
 12 20 or be unjust under the circumstances.  The moneys generated by
 12 21 the filing fee allowed under this subsection are appropriated
 12 22 to the department of workforce development to be used for
 12 23 purposes of administering the division of workers'
 12 24 compensation.
 12 25    3.  WORKFORCE DEVELOPMENT OPERATIONS
 12 26    For the operation of field offices, the workforce
 12 27 development board, and new Iowans centers, and for not more
 12 28 than the following full=time equivalent positions:
 12 29 .................................................. $ 12,403,106
 12 30 ............................................... FTEs      88.04
 12 31    Of the moneys appropriated in this subsection, the
 12 32 department shall allocate $12,225,928 for the operation of
 12 33 field offices.  The department shall not reduce the number of
 12 34 field offices below the number of field offices being operated
 12 35 as of January 1, 2008.
 13  1    The department of workforce development shall maintain new
 13  2 Iowans centers that offer one-stop services to deal with the
 13  3 multiple issues related to immigration and employment.  The
 13  4 centers shall be designed to support workers, businesses, and
 13  5 communities with information, referrals, job placement
 13  6 assistance, translation, language training, and resettlement,
 13  7 as well as technical and legal assistance on such issues as
 13  8 forms and documentation.  Through the coordination of local,
 13  9 state, and federal service providers, and through the
 13 10 development of partnerships with public, private, and
 13 11 nonprofit entities with established records of international
 13 12 service, these centers shall seek to provide a seamless
 13 13 service delivery system for new Iowans.
 13 14    4.  INTEGRATED BASIC EDUCATION AND SKILLS TRAINING (I=BEST)
 13 15    For purposes of conducting integrated basic education and
 13 16 skills training demonstration projects with eligible community
 13 17 colleges to bring English as a second language and adult basic
 13 18 education instructors together with professional=technical
 13 19 instructors in the same classroom to provide students with
 13 20 contextualized remediation and English language services and
 13 21 occupational training at the same time, including salaries,
 13 22 support, maintenance, miscellaneous purposes, and for not more
 13 23 than the following full=time equivalent position:
 13 24 .................................................. $    500,000
 13 25 ............................................... FTEs       1.00
 13 26    The full=time equivalent position authorized in this
 13 27 subsection is allocated for purposes of employing one
 13 28 coordinator who, with the support of the department of
 13 29 education and other interested agencies, awards grants to five
 13 30 of Iowa's eligible community colleges in approved programs in
 13 31 career tracks that assist in solving the workforce shortage.
 13 32    5.  OFFENDER REENTRY PROGRAM
 13 33    For the development and administration of an offender
 13 34 reentry program to provide offenders with employment skills,
 13 35 and for not more than the following full=time equivalent
 14  1 positions:
 14  2 .................................................. $    375,000
 14  3 ............................................... FTEs       2.00
 14  4    The department shall partner with the department of
 14  5 corrections to provide staff within the correctional
 14  6 facilities to improve offenders' abilities to find and retain
 14  7 productive employment.
 14  8    6.  For purposes of administration of a security employee
 14  9 pilot project training program, if enacted by the 2008 session
 14 10 of the eighty=second general assembly:

 14 12    7.  NONREVERSION OF MONEYS
 14 13    Notwithstanding section 8.33, moneys appropriated in this
 14 14 section that remain unencumbered or unobligated at the close
 14 15 of the fiscal year shall not revert but shall remain available
 14 16 for expenditure for the purposes designated until the close of
 14 17 the succeeding fiscal year.
 14 18    Sec. 17.  ACCOUNTABILITY == AUDIT.
 14 19    1.  By January 15, 2009, the department of workforce
 14 20 development shall submit a written report to the chairpersons
 14 21 and ranking members of the joint appropriations subcommittee
 14 22 on economic development which shall include a list of
 14 23 contracts held by the department and accountability measures
 14 24 in effect for each contract.
 14 25    2.  The auditor of state shall annually conduct an audit of
 14 26 the department of workforce development and shall report the
 14 27 findings of such annual audit, including the accountability of
 14 28 programs of the department, to the chairpersons and ranking
 14 29 members of the joint appropriations subcommittee on economic
 14 30 development.  The department shall pay for the costs
 14 31 associated with the audit.
 14 32    3.  The legislative services agency shall conduct an annual
 14 33 review of salaries paid to employees of entities organized
 14 34 under chapter 28E and salaries paid under a contract with the
 14 35 department of workforce development.  The legislative services
 15  1 agency shall report its findings to the chairpersons and
 15  2 ranking members of the joint appropriations subcommittee on
 15  3 economic development.
 15  4    4.  The department of management shall work with the
 15  5 department of workforce development to accurately reflect the
 15  6 number of employees within the department of workforce
 15  7 development funded by state and federal sources.  The
 15  8 department of management shall issue a report to the joint
 15  9 appropriations subcommittee on economic development regarding
 15 10 such employees and identifying the relative sources of funding
 15 11 by January 15, 2009.
 15 12    Sec. 18.  EMPLOYMENT SECURITY CONTINGENCY FUND.  There is
 15 13 appropriated from the special employment security contingency
 15 14 fund to the department of workforce development for the fiscal
 15 15 year beginning July 1, 2008, and ending June 30, 2009, the
 15 16 following amounts, or so much thereof as is necessary, for the
 15 17 purposes designated:
 15 18    For the division of workers' compensation, salaries,
 15 19 support, maintenance, and miscellaneous purposes:
 15 20 .................................................. $    471,000
 15 21    Any remaining additional penalty and interest revenue may
 15 22 be allocated and used to accomplish the mission of the
 15 23 department.
 15 24    Sec. 19.  UNEMPLOYMENT COMPENSATION RESERVE FUND.
 15 25 Notwithstanding section 96.9, subsection 8, paragraph "e",
 15 26 there is appropriated from interest earned on the unemployment
 15 27 compensation reserve fund to the department of workforce
 15 28 development for the fiscal year beginning July 1, 2008, and
 15 29 ending June 30, 2009, the following amount for the operation
 15 30 of field offices:
 15 31 .................................................. $  6,500,000
 15 32    Sec. 20.  PUBLIC EMPLOYMENT RELATIONS BOARD.  There is
 15 33 appropriated from the general fund of the state to the public
 15 34 employment relations board for the fiscal year beginning July
 15 35 1, 2008, and ending June 30, 2009, the following amount, or so
 16  1 much thereof as is necessary, for the purposes designated:
 16  2    For salaries, support, maintenance, miscellaneous purposes,
 16  3 and for not more than the following full=time equivalent
 16  4 positions:
 16  5 .................................................. $  1,233,283
 16  6 ............................................... FTEs      11.00
 16  7    Sec. 21.  VALUE=ADDED AGRICULTURAL PRODUCTS AND PROCESSES
 16  8 FINANCIAL ASSISTANCE FUND MONEYS.  The office of renewable
 16  9 fuels and coproducts may apply to the department of economic
 16 10 development for moneys in the value=added agricultural
 16 11 products and processes financial assistance fund for deposit
 16 12 in the renewable fuels and coproducts fund created in section
 16 13 159A.7.
 16 14    Sec. 22.  IOWA FINANCE AUTHORITY AUDIT.  The auditor of
 16 15 state is requested to review the audit of the Iowa finance
 16 16 authority performed by the auditor hired by the authority.
 16 17    Sec. 23.  APPLICATION FOR DEPARTMENT OF ECONOMIC
 16 18 DEVELOPMENT MONEYS.  For the fiscal year beginning July 1,
 16 19 2008, any entity that was specifically identified in 2001 Iowa
 16 20 Acts, chapter 188, to receive funding from the department of
 16 21 economic development, excluding any entity identified to
 16 22 receive a direct appropriation beginning July 1, 2008, may
 16 23 apply to the department for assistance through the appropriate
 16 24 program.  The department shall provide application criteria
 16 25 necessary to implement this section.
 16 26    Sec. 24.  SHELTER ASSISTANCE FUND.  In providing moneys
 16 27 from the shelter assistance fund to homeless shelter programs
 16 28 in the fiscal year beginning July 1, 2008, and ending June 30,
 16 29 2009, the department of economic development shall explore the
 16 30 potential of allocating moneys to homeless shelter programs
 16 31 based in part on their ability to move their clients toward
 16 32 self=sufficiency.
 16 33    Sec. 25.  UNEMPLOYMENT COMPENSATION PROGRAM.
 16 34 Notwithstanding section 96.9, subsection 4, paragraph "a",
 16 35 moneys credited to the state by the secretary of the treasury
 17  1 of the United States pursuant to section 903 of the Social
 17  2 Security Act shall be appropriated to the department of
 17  3 workforce development and shall be used by the department for
 17  4 the administration of the unemployment compensation program
 17  5 only.  This appropriation shall not apply to any fiscal year
 17  6 beginning after December 31, 2008.
 17  7    Sec. 26.  2007 Iowa Acts, chapter 207, section 13,
 17  8 subsection 3, is amended to read as follows:
 17  9    3.  Notwithstanding section 8.33, moneys appropriated in
 17 10 this section that remain unencumbered or unobligated at the
 17 11 close of the fiscal year shall not revert but shall remain
 17 12 available for expenditure for the purposes designated until
 17 13 the close of the succeeding fiscal year beginning July 1,
 17 14 2008.
 17 15    Sec. 27.  2007 Iowa Acts, chapter 207, section 14,
 17 16 unnumbered paragraph 3, is amended to read as follows:
 17 17    Notwithstanding section 8.33, moneys appropriated in this
 17 18 section that remain unencumbered or unobligated at the close
 17 19 of the fiscal year shall not revert but shall remain available
 17 20 for expenditure for the purposes designated until the close of
 17 21 the succeeding fiscal year beginning July 1, 2008.
 17 22    Sec. 28.  2007 Iowa Acts, chapter 207, section 15,
 17 23 subsection 4, is amended to read as follows:
 17 24    4.  Notwithstanding section 8.33, moneys appropriated in
 17 25 this section that remain unencumbered or unobligated at the
 17 26 close of the fiscal year shall not revert but shall remain
 17 27 available for expenditure for the purposes designated until
 17 28 the close of the succeeding fiscal year beginning July 1,
 17 29 2008.
 17 30    Sec. 29.  2007 Iowa Acts, chapter 207, section 16,
 17 31 unnumbered paragraph 4, is amended to read as follows:
 17 32    Notwithstanding section 8.33, moneys appropriated in this
 17 33 section that remain unencumbered or unobligated at the close
 17 34 of the fiscal year shall not revert but shall remain available
 17 35 for expenditure for the purposes designated until the close of
 18  1 the succeeding fiscal year beginning July 1, 2008.
 18  2    Sec. 30.  WORKFORCE INNOVATION PLAN.
 18  3    1.  The Iowa workforce development board shall develop, in
 18  4 cooperation and consultation with the association of Iowa
 18  5 workforce partners and the employers council of Iowa, a
 18  6 statewide workforce innovation plan by January 1, 2009.  The
 18  7 board may consult other state agencies or organizations as
 18  8 necessary.  The plan shall be submitted to the general
 18  9 assembly and the governor by January 15, 2009.
 18 10    2.  The statewide workforce innovation plan shall include
 18 11 all of the following:
 18 12    a.  Recommendations for coordinating the workforce delivery
 18 13 system in a more efficient, cost=effective manner while
 18 14 improving services for customers.
 18 15    b.  Recommendations regarding the collocation and
 18 16 integration of all workforce and job training programs.
 18 17    c.  Recommendations for improving the effectiveness of the
 18 18 regional workforce system.
 18 19    3.  As part of the plan, the department of workforce
 18 20 development shall set a goal of having at least one certified
 18 21 one=stop center in each of the fifteen workforce regions by
 18 22 the year 2012.
 18 23    Sec. 31.  Section 15.109, Code 2007, is amended by adding
 18 24 the following new subsection:
 18 25    NEW SUBSECTION.  4.  Establish a sustainable community
 18 26 development initiative.  The purpose of the initiative is to
 18 27 improve the sustainability of Iowa communities by ensuring
 18 28 long=term economic growth and fostering environmentally
 18 29 conscious growth and development.  In establishing the
 18 30 initiative, the department shall:
 18 31    a.  Create a plan to ensure that all of the department's
 18 32 current community growth and development programs, efforts,
 18 33 and initiatives incorporate an environmentally conscious
 18 34 approach and policies that promote sustainability.
 18 35    b.  Cooperate with local governments by providing
 19  1 information, technical assistance, and financial incentives to
 19  2 communities pursuing sustainable growth.
 19  3    Sec. 32.  EFFECTIVE DATE.  The sections of this Act
 19  4 amending 2007 Iowa Acts, chapter 207, sections 13, 14, 15, and
 19  5 16, being deemed of immediate importance, take effect upon
 19  6 enactment.
