  1  4 RELATING TO THE DISPOSAL AND RECYCLING OF USED OIL FILTERS.

  1  6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  8    Section 1.  Section 455D.13, Code 2007, is amended to read
  1  9 as follows:
  1 10    455D.13  LAND DISPOSAL OF WASTE USED OIL AND USED OIL
  1 11 FILTERS PROHIBITED == COLLECTION AND RECYCLING.
  1 12    1.  A sanitary landfill shall not accept waste used oil for
  1 13 final disposal beginning July 1, 1990.
  1 14    2.  A person offering for sale or selling oil or oil
  1 15 filters at retail in the state shall do the following:
  1 16    a.  Accept at the point of sale, waste used oil and used
  1 17 oil filters from customers, or post notice of locations where
  1 18 a customer may dispose of waste used oil and used oil filters.
  1 19    b.  Post written notice that it is unlawful to dispose of
  1 20 waste used oil in a sanitary landfill.
  1 21    Sec. 2.  Section 455D.13, Code 2007, is amended by adding
  1 22 the following new subsection:
  1 23    NEW SUBSECTION.  3.  A business that generates used oil
  1 24 filters or collects used oil filters from a person shall not
  1 25 dispose of the oil filters in a sanitary landfill and shall
  1 26 source=separate and recycle the oil filters.
