1 4 RELATING TO ACCOUNTS AND FEES UNDER THE WATER QUALITY
1 5 PROTECTION FUND.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 455B.183A, subsection 1, Code 2005, is
1 10 amended to read as follows:
1 11 1. A water quality protection fund is created in the state
1 12 treasury under the control of the department. The fund
1 13 consists of moneys appropriated to the fund by the general
1 14 assembly, moneys deposited into the fund from fees described
1 15 in subsection 2, moneys deposited into the fund from fees
1 16 collected pursuant to sections 455B.187 and 455B.190A, and
1 17 other moneys available to and obtained or accepted by the
1 18 department from the United States government or private
1 19 sources for placement in the fund. The fund is divided into
1 20 three accounts, including the administration account, the
1 21 public water supply system account, and the private water
1 22 supply system account. Moneys in the administration public
1 23 water supply system account are appropriated to the department
1 24 for purposes of carrying out the provisions of this division,
1 25 which relate to the administration, regulation, and
1 26 enforcement of the federal Safe Drinking Water Act. Moneys in
1 27 the public water supply system account are appropriated to the
1 28 department, and to support the program to assist supply
1 29 systems, as provided in section 455B.183B. Moneys in the
1 30 private water supply system account are appropriated to the
1 31 department for the purpose of supporting the programs
1 32 established to protect private drinking water supplies as
1 33 provided in sections 455B.187, 455B.188, 455B.190, and
1 34 455B.190A.
1 35 Sec. 2. Section 455B.183A, subsection 2, paragraph b, Code
2 1 2005, is amended to read as follows:
2 2 b. The operation of a public water supply system,
2 3 including any part of the system. The commission shall adopt
2 4 a fee schedule which shall be based on the total number of
2 5 persons served by public water supply systems in this state.
2 6 However, a public water supply system shall be assessed a fee
2 7 of at least twenty=five dollars. A public water supply system
2 8 not owned or operated by a community and serving a transient
2 9 population shall be assessed a fee of twenty=five dollars.
2 10 The commission shall calculate all fees in the schedule to
2 11 produce total revenues equaling three hundred fifty thousand
2 12 dollars for each fiscal year, commencing with the fiscal year
2 13 beginning July 1, 1995, and ending June 30, 1996. For each
2 14 fiscal year, one=half of the fees shall be deposited into the
2 15 administration account and one=half of the fees shall be
2 16 deposited into the public water supply system account. By May
2 17 1 of each year, the department shall estimate the total
2 18 revenue expected to be collected from the overpayment of fees,
2 19 which are all fees in excess of the amount of the total
2 20 revenues which are expected to be collected under the current
2 21 fee schedule, and the total revenue expected to be collected
2 22 from the payment of fees during the next fiscal year. The
2 23 commission shall adjust the fees if the estimate exceeds the
2 24 amount of revenue required to be deposited in the fund account
2 25 pursuant to this paragraph.
