Senate File 2124 PAG LIN 1 1 SENATE FILE 2124 1 2 1 3 AN ACT 1 4 RELATING TO EDUCATION FUNDING, PROVIDING FOR THE ESTABLISH= 1 5 MENT OF THE STATE PERCENT OF GROWTH FOR PURPOSES OF THE 1 6 STATE SCHOOL FOUNDATION PROGRAM, PROVIDING FOR ALLOCATIONS 1 7 FOR TEXTBOOK AND SUPPLY ACQUISITION, PROVIDING FOR A 1 8 REDUCTION IN AREA EDUCATION AGENCY FUNDING, MAKING 1 9 APPROPRIATIONS, AND PROVIDING AN APPLICABILITY DATE. 1 10 1 11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 12 1 13 Section 1. Section 257.8, subsection 1, Code Supplement 1 14 2003, is amended to read as follows: 1 15 1. STATE PERCENT OF GROWTH.The state percent of growth 1 16 for the budget year beginning July 1, 2003, is two percent.1 17 The state percent of growth for the budget year beginning July 1 18 1, 2004, is two percent. The state percent of growth for the 1 19 budget year beginning July 1, 2005, is two percent. The state 1 20 percent of growth for the budget year beginning July 1, 2006, 1 21 and each subsequent budget year shall be established by 1 22 statute which shall be enacted within thirty days of the 1 23 submission inthe year precedingthe base year of the 1 24 governor's budget under section 8.21. The establishment of 1 25 the state percent of growth for a budget year shall be the 1 26 only subject matter of the bill which enacts the state percent 1 27 of growth for a budget year. 1 28 Sec. 2. Section 257.16, Code 2003, is amended by adding 1 29 the following new subsection: 1 30 NEW SUBSECTION. 5. a. Notwithstanding subsection 1, the 1 31 amount appropriated from the general fund of the state for 1 32 state foundation and supplementary aid for the fiscal period 1 33 beginning July 1, 2004, and ending June 30, 2006, shall be the 1 34 following: 1 35 (1) For the fiscal year beginning July 1, 2004, the sum of 2 1 one billion eight hundred eighty=one million six hundred 2 2 eighty=eight thousand six hundred twenty=eight dollars. Of 2 3 the amount appropriated pursuant to this subparagraph, ten 2 4 million dollars shall be used by school districts to assist 2 5 with the purchase of public school textbooks and supplies. 2 6 The amount allocated shall be distributed to school districts 2 7 on a per pupil basis, and shall be used exclusively for 2 8 textbook and supply acquisition for public schools. If any 2 9 portion of the moneys received by a school district for 2 10 textbook and supply acquisition remains unexpended at the end 2 11 of the budget year, the remainder shall be carried over to the 2 12 subsequent budget year and added to the school district's 2 13 textbook and supply acquisition budget for that year. 2 14 (2) For the fiscal year beginning July 1, 2005, the sum of 2 15 one billion nine hundred twenty=six million five hundred 2 16 twelve thousand nine hundred ninety=four dollars. Of the 2 17 amount appropriated pursuant to this subparagraph, ten million 2 18 dollars shall be used by school districts to assist with the 2 19 purchase of public school textbooks and supplies. The amount 2 20 allocated shall be distributed to school districts on a per 2 21 pupil basis, and shall be used exclusively for textbook and 2 22 supply acquisition for public schools. If any portion of the 2 23 moneys received by a school district for textbook and supply 2 24 acquisition remains unexpended at the end of the budget year, 2 25 the remainder shall be carried over to the subsequent budget 2 26 year and added to the school district's textbook and supply 2 27 acquisition budget for that year. 2 28 b. If the amounts appropriated in this subsection are less 2 29 than the amounts otherwise required pursuant to subsection 1, 2 30 the difference shall be deducted from the payments that 2 31 otherwise would have been required to be made to each school 2 32 district in the same ratio that the budget enrollment of the 2 33 school district for the appropriate budget year bears to the 2 34 total budget enrollment in the state for that budget year. 2 35 Sec. 3. Section 257.35, Code Supplement 2003, is amended 3 1 by adding the following new subsections: 3 2 NEW SUBSECTION. 4. Notwithstanding subsection 1, and in 3 3 addition to the reduction applicable pursuant to subsection 2, 3 4 the state aid for area education agencies and the portion of 3 5 the combined district cost calculated for these agencies for 3 6 the fiscal year beginning July 1, 2004, and each succeeding 3 7 fiscal year, shall be reduced by the department of management 3 8 by eleven million seven hundred ninety=eight thousand seven 3 9 hundred three dollars. The reduction for each area education 3 10 agency shall be equal to the reduction that the agency 3 11 received in the fiscal year beginning July 1, 2003. 3 12 NEW SUBSECTION. 5. Notwithstanding section 257.37, an 3 13 area education agency may use the funds determined to be 3 14 available under this section in a manner which the area 3 15 education agency determines is appropriate to best maintain 3 16 the level of required area education agency special education 3 17 services. An area education agency may also use unreserved 3 18 fund balances for media services or education services in a 3 19 manner which the area education agency determines is 3 20 appropriate to best maintain the level of required area 3 21 education agency special education services. 3 22 Sec. 4. Notwithstanding the thirty=day deadline and 3 23 restrictions for the enactment of the state percent of growth 3 24 provided in section 257.8, subsection 1, such deadline and 3 25 restrictions shall not apply to the Act enacted which 3 26 establishes the state percent of growth during the 2004 3 27 Regular Session of the Eightieth General Assembly. 3 28 Sec. 5. APPLICABILITY. This Act is applicable for 3 29 computing state aid under the state school foundation program 3 30 for the school budget years beginning July 1, 2004, and July 3 31 1, 2005. 3 32 3 33 3 34 3 35 JEFFREY M.
