1 4 AUTHORIZING SCHOOL DISTRICTS TO DEDUCT AND PAY FEES FOR
1 5 MEMBERSHIP IN NOT=FOR=PROFIT PROFESSIONAL EDUCATION
1 6 ASSOCIATIONS.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. Section 279.59, Code 2003, is amended to read
1 11 as follows:
1 12 279.59 ACCESS BY PROFESSIONAL EDUCATION ASSOCIATIONS.
1 13 1. The board of directors of a school district shall
1 14 provide not=for=profit, professional education associations
1 15 that offer membership to teachers or administrators equal
1 16 access to teacher or administrator mailboxes for distribution
1 17 of professional literature.
1 18 2. Notwithstanding section 20.9, a school district may,
1 19 upon a teacher's or administrator's written request, deduct
1 20 from the salary or wages of the teacher or administrator an
1 21 amount specified by the teacher or administrator for payment
1 22 of dues or membership fees for the teacher's or
1 23 administrator's membership in a not=for=profit, professional
1 24 education association. If a written request is granted, all
1 25 other written requests for salary or wage deductions for
1 26 payment of dues or membership fees for membership in the same
1 27 not=for=profit, professional education association shall also
1 28 be granted. The teacher or administrator may withdraw the
1 29 request for the deduction at any time by giving the school
1 30 district thirty days' written notice.
1 31 3. For purposes of this section, unless the context
1 32 otherwise requires, "professional education association" means
1 33 an association in which the majority of members are
1 34 practitioners licensed in accordance with chapter 272.
