However, a person who earns less than two thousand dollars annually or who performs work or has work performed on the person’s own property is not a contractor for purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Department”</xhtml:span> means the department of inspections, appeals, and licensing.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Director”</xhtml:span> means the director of the department of inspections, appeals, and licensing.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The state, its boards, commissions, agencies, departments, and its political subdivisions including school districts and other special purpose districts, are not contractors for purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">If a contractor’s registration application shows that the contractor is self-employed, does not pay more than two thousand dollars annually to employ other persons in the business, and does not work with or for other contractors in the same phases of construction, the contractor is exempt from the fee requirements under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">A contractor licensed under <xhtml:span class="iowaCodeRef">chapter 105</xhtml:span> shall register as a contractor under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> in conjunction with the contractor licensing process established by the department. The department shall collect both the registration and licensing applications as part of one combined application. The director shall design the contractor registration application form to exclude from the department’s contractor registration application process those contractors who are also covered by chapter <xhtml:span class="iowaCodeRef">103</xhtml:span> or <xhtml:span class="iowaCodeRef">105</xhtml:span>. Notice of a policy’s cancellation shall be provided to the director by the insurance company.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The contractor shall possess an employer account number or a special contractor number issued by the department of workforce development pursuant to <xhtml:span class="iowaCodeRef">chapter 96</xhtml:span>, the Iowa employment security law.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">An out-of-state contractor shall either file a surety bond, as provided in <xhtml:span class="iowaCodeRef">section 91C.7</xhtml:span>, with the department in the amount of twenty-five thousand dollars or shall provide a statement to the department that the contractor is prequalified to bid on projects for the department of transportation pursuant to <xhtml:span class="iowaCodeRef">section 314.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">88 Acts, ch 1162, §3</xhtml:span>; <xhtml:span class="iowaActsRef">90 Acts, ch 1136, §10</xhtml:span>; <xhtml:span class="iowaActsRef">96 Acts, ch 1186, §23</xhtml:span>; <xhtml:span class="iowaActsRef">2010 Acts, ch 1188, §26, 27</xhtml:span>; <xhtml:span class="iowaActsRef">2017 Acts, ch 90, §2, 3</xhtml:span>; <xhtml:span class="iowaActsRef">2023 Acts, ch 19, §1834</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec91C.3"><xhtml:div class="heading"><xhtml:span class="identifier">91C.3</xhtml:span><xhtml:span class="headnote">Application — information to be provided.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The registration application shall be in the form prescribed by the director, shall be accompanied by the registration fee prescribed pursuant to <xhtml:span class="iowaCodeRef">section 91C.4</xhtml:span>, and shall contain information which is substantially complete and accurate. In addition to the information determined by the director to be necessary for purposes of <xhtml:span class="iowaCodeRef">section 91C.2</xhtml:span>, the application shall include information as to each of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The name, principal place of business, address, and telephone number of the contractor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The name, address, telephone number, and position of each officer of the contractor, if the contractor is a corporation, or each owner if the contractor is not a corporation.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A description of the business, including the principal products and services provided.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Any change in the information provided shall be reported promptly to the director.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">88 Acts, ch 1162, §4</xhtml:span>; <xhtml:span class="iowaActsRef">90 Acts, ch 1136, §11</xhtml:span>; <xhtml:span class="iowaActsRef">2008 Acts, ch 1032, §201</xhtml:span><xhtml:span class="iowaActsRef">2023 Acts, ch 19, §1835, 1836</xhtml:span></xhtml:p></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec91C.4"><xhtml:div class="heading"><xhtml:span class="identifier">91C.4</xhtml:span><xhtml:span class="headnote">Fees.</xhtml:span></xhtml:div><xhtml:p class="para">The director shall prescribe the fee for registration, which fee shall not exceed fifty dollars per year. These records and the complete registration information provided by each contractor are public records and the director shall take steps as necessary to facilitate access to the information by governmental agencies and the general public.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The director shall revoke a registration number when the contractor fails to maintain compliance with the conditions necessary to obtain a registration. The director shall provide a fact-finding interview to assure that the contractor is not in compliance before revoking any registration. Hearings on revocation of registrations shall be held in accordance with <xhtml:span class="iowaCodeRef">section 91C.8</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">88 Acts, ch 1162, §6</xhtml:span>; <xhtml:span class="iowaActsRef">90 Acts, ch 1136, §13</xhtml:span><xhtml:span class="iowaActsRef">2023 Acts, ch 19, §1838</xhtml:span></xhtml:p></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec91C.6"><xhtml:div class="heading"><xhtml:span class="identifier">91C.6</xhtml:span><xhtml:span class="headnote">Rules.</xhtml:span></xhtml:div><xhtml:p class="para">The director shall adopt rules, pursuant to <xhtml:span class="iowaCodeRef">chapter 17A</xhtml:span>, determined to be reasonably necessary for phasing in, administering, and enforcing the system of contractor registration established by <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">88 Acts, ch 1162, §7</xhtml:span>; <xhtml:span class="iowaActsRef">90 Acts, ch 1136, §14</xhtml:span><xhtml:span class="iowaActsRef">2023 Acts, ch 19, §1839</xhtml:span></xhtml:p></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec91C.7"><xhtml:div class="heading"><xhtml:span class="identifier">91C.7</xhtml:span><xhtml:span class="headnote">Contracts <xhtml:span class="em-dash"/> contractor’s bond.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A contractor who is not registered with the director as required by <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> shall not be awarded a contract to perform work for the state or an agency of the state.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A surety bond filed pursuant to <xhtml:span class="iowaCodeRef">section 91C.2</xhtml:span> shall be executed by a surety company authorized to do business in this state, and the bond shall be continuous in nature until canceled by the surety with not less than thirty days’ written notice to the contractor and to the department indicating the surety’s desire to cancel the bond. The surety company shall not be liable under the bond for any contract commenced after the cancellation of the bond. The department may increase the bond amount after a hearing.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Release of the bond shall be conditioned upon the payment of all taxes, including contributions due under the unemployment compensation insurance system, penalties, interest, and related fees, which may accrue to the state of Iowa. If at any time during the term of the bond, the department of revenue or the department determines that the amount of the bond is not sufficient to cover the tax liabilities accruing to the state of Iowa, the director shall require the bond to be increased by an amount the director deems sufficient to cover the tax liabilities accrued and accruing.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The department of revenue and the department shall adopt rules for the collection of the forfeiture. Notice shall be provided to the surety and to the contractor. Notice to the contractor shall be mailed to the contractor’s last known address and to the contractor’s registered agent for service of process, if any, within the state. The contractor or surety shall have the opportunity to apply to the director of revenue for a hearing within thirty days after the giving of such notice. Upon the failure to timely request a hearing, the bond shall be forfeited. If, after the hearing upon timely request, the department of revenue or the department finds that the contractor has failed to pay the total of all taxes payable, the department of revenue or the department shall order the bond forfeited. The amount of the forfeiture shall be the amount of taxes payable or the amount of the bond, whichever is less. For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span><xhtml:span class="term">“taxes payable”</xhtml:span> means all tax, penalties, interest, and fees that the department of revenue has previously determined to be due to the state by assessment or in an appeal of an assessment, including contributions to the unemployment compensation insurance system.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">If it is determined that <xhtml:span class="iowaCodeRef">this section</xhtml:span> may cause denial of federal funds which would otherwise be available, or is otherwise inconsistent with requirements of federal law, <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall be suspended, but only to the extent necessary to prevent denial of the funds or to eliminate the inconsistency with federal requirements.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">The bond required by <xhtml:span class="iowaCodeRef">this section</xhtml:span> may be attached by the director for collection of fees and penalties due to the department.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">88 Acts, ch 1162, §8</xhtml:span>; <xhtml:span class="iowaActsRef">2024 Acts, ch 1043, §41</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec91C.8"><xhtml:div class="heading"><xhtml:span class="identifier">91C.8</xhtml:span><xhtml:span class="headnote">Investigations <xhtml:span class="em-dash"/> enforcement <xhtml:span class="em-dash"/> administrative penalties.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The director and inspectors of the department have jurisdiction for investigation and enforcement in cases where contractors may be in violation of the requirements of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or rules adopted pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">If, upon investigation, the director or the director’s authorized representative believes that a contractor has violated any of the following, the director shall with reasonable promptness issue a citation to the contractor:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The requirement that a contractor be registered.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The requirement that the contractor’s registration information be substantially complete and accurate.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">The requirement that an out-of-state contractor file a bond with the department.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Each citation shall be in writing and shall describe with particularity the nature of the violation, including a reference to the provision of the statute alleged to have been violated.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">If a citation is issued, the director shall, within seven days, notify the contractor by service in the same manner as an original notice or by certified mail of the administrative penalty, if any, proposed to be assessed and that the contractor has fifteen working days within which to notify the director that the contractor wishes to contest the citation or proposed assessment of penalty.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The administrative penalties which may be imposed under <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall be not more than five hundred dollars in the case of a first violation and not more than five thousand dollars for each violation in the case of a second or subsequent violation. All administrative penalties collected pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> shall be deposited in the general fund of the state.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">If, within fifteen working days from the receipt of the notice, the contractor fails to notify the director that the contractor intends to contest the citation or proposed assessment of penalty, the citation and the assessment, as proposed, shall be deemed a final order of the employment appeal board and not subject to review by any court or agency.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">If the contractor notifies the director that the contractor intends to contest the citation or proposed assessment of penalty, the director shall immediately advise the employment appeal board established by <xhtml:span class="iowaCodeRef">section 10A.601</xhtml:span>. The employment appeal board shall review the action of the director and shall thereafter issue an order, based on findings of fact, affirming, modifying, or vacating the director’s citation or proposed penalty or directing other appropriate relief, and the order shall become final sixty days after its issuance.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para">The director shall notify the department of revenue upon final agency action regarding the citation and assessment of penalty against a registered contractor.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">9</xhtml:span></xhtml:div><xhtml:p class="para">Judicial review of any order of the employment appeal board issued pursuant to <xhtml:span class="iowaCodeRef">this section</xhtml:span> may be sought in accordance with the terms of <xhtml:span class="iowaCodeRef">chapter 17A</xhtml:span>.  If no petition for judicial review is filed within sixty days after service of the order of the employment appeal board, the appeal board’s findings of fact and order shall be conclusive in connection with any petition for enforcement which is filed by the director after the expiration of the sixty-day period.
