<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp91B" name="91B"><slim:About class="header"><slim:Property type="string" name="version"/></slim:About><slim:TOC><slim:Item idref="sec91B.1" title="91B.1   Files — access by employees."/><slim:Item idref="sec91B.2" title="91B.2   Information provided by employers about current or former employees — immunity."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp91B"><slim:Heading class="heading"><xhtml:span class="identifier">91B</xhtml:span><xhtml:span class="headnote">PERSONNEL INFORMATION</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec91B.1"><xhtml:div class="heading"><xhtml:span class="identifier">91B.1</xhtml:span><xhtml:span class="headnote">Files — access by employees.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">An employee, as defined in <xhtml:span class="iowaCodeRef">section 91A.2</xhtml:span>, shall have access to and shall be permitted to obtain a copy of the employee’s personnel file maintained by the employee’s employer, as defined in <xhtml:span class="iowaCodeRef">section 91A.2</xhtml:span>, including but not limited to performance evaluations, disciplinary records, and other information concerning employer-employee relations.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">However, an employee’s access to a personnel file is subject to all of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The employer and employee shall agree on the time the employee may have access to the employee’s personnel file, and a representative of the employer may be present.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">An employee shall not have access to employment references written for the employee.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">An employer may charge a reasonable fee for each page of a copy made by the employer for an employee of an item in the employee’s personnel file. For purposes of this paragraph, <xhtml:span class="term">“reasonable fee”</xhtml:span> means an amount equivalent to an amount charged per page for copies made by a commercial copying business.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">90 Acts, ch 1033, §1</xhtml:span>; <xhtml:span class="iowaActsRef">98 Acts, ch 1022, §1</xhtml:span>; <xhtml:span class="iowaActsRef">2008 Acts, ch 1032, §201</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec91B.2"><xhtml:div class="heading"><xhtml:span class="identifier">91B.2</xhtml:span><xhtml:span class="headnote">Information provided by employers about current or former employees — immunity.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">An employer or an employer’s representative who, upon request by or authorization of a current or former employee or upon request made by a person who in good faith is believed to be a representative of a prospective employer of a current or former employee, provides work-related information about a current or former employee, is immune from civil liability unless the employer or the employer’s representative acted unreasonably in providing the work-related information.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, an employer acts unreasonably if any of the following are present:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The work-related information violates a civil right of the current or former employee.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The work-related information knowingly is provided to a person who has no legitimate and common interest in receiving the work-related information.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">The work-related information is not relevant to the inquiry being made, is provided with malice, or is provided with no good faith belief that it is true.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, <xhtml:span class="i">“employer”</xhtml:span> and <xhtml:span class="i">“employee”</xhtml:span> are defined as provided in <xhtml:span class="iowaCodeRef">section 91A.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">97 Acts, ch 179, §1</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section></slim:Level></slim:Body></slim:Document>
