OF CRIMINAL RECORDS</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec901C.1"><xhtml:div class="heading"><xhtml:span class="identifier">901C.1</xhtml:span><xhtml:span class="headnote">Definition.</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires, <xhtml:span class="term">“expunge”</xhtml:span> and <xhtml:span class="term">“expungement”</xhtml:span> mean the same as expunged in <xhtml:span class="iowaCodeRef">section 907.1</xhtml:span>.</xhtml:p><xhtml:div class="headnote">Not-guilty verdicts and criminal-charge dismissals <xhtml:span class="em-dash"/> expungement.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Except as provided in paragraph <xhtml:span class="i">“b”</xhtml:span>, upon application of a defendant or a prosecutor in a criminal case, or upon the court’s own motion in a criminal case, the court shall enter an order expunging the record of such criminal case if the court finds that the defendant has established that all of the following have occurred, as applicable:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The criminal case contains one or more criminal charges in which an acquittal was entered for all criminal charges, or in which all criminal charges were otherwise dismissed.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">All court costs, fees, and other financial obligations ordered by the court or assessed by the clerk of the district court have been paid.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A minimum of one hundred eighty days have passed since entry of the judgment of acquittal or of the order dismissing the case relating to all criminal charges, unless the court finds good cause to waive this requirement for reasons including but not limited to the fact that the defendant was the victim of identity theft or mistaken identity.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The case was not dismissed due to the defendant being found not guilty by reason of insanity.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The defendant was not found incompetent to stand trial in the case.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The court shall not enter an order expunging the record of a criminal case under paragraph <xhtml:span class="i">“a”</xhtml:span> unless all the parties in the case have had time to object on the grounds that one or more of the relevant conditions in paragraph <xhtml:span class="i">“a”</xhtml:span> have not been established.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The record in a criminal case expunged under <xhtml:span class="iowaCodeRef">this section</xhtml:span> is a confidential record exempt from public access under <xhtml:span class="iowaCodeRef">section 22.7</xhtml:span> but shall be made available by the clerk of the district court, upon request and without court order, to the defendant or to an agency or person granted access to the deferred judgment docket under <xhtml:span class="iowaCodeRef">section 907.4, subsection 2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This section</xhtml:span> does not apply to dismissals related to a deferred judgment under <xhtml:span class="iowaCodeRef">section 907.9</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This section</xhtml:span> applies to all public offenses, as defined under <xhtml:span class="iowaCodeRef">section 692.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The court shall advise the defendant of the provisions of <xhtml:span class="iowaCodeRef">this section</xhtml:span> upon either the acquittal or the dismissal of all criminal charges in a case.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">The supreme court may prescribe rules governing the procedures applicable to the expungement of the record of a criminal case under <xhtml:span class="iowaCodeRef">this section</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This section</xhtml:span> shall apply to all relevant criminal cases that occurred prior to, on, or after January 1, 2016.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2015 §901C.2</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec901C.3"><xhtml:div class="heading"><xhtml:span class="identifier">901C.3</xhtml:span><xhtml:span class="headnote">Misdemeanor <xhtml:span class="em-dash"/> expungement.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Upon application of a defendant convicted of a misdemeanor offense in the county where the conviction occurred, the court shall enter an order expunging the record of such a criminal case, as a matter of law, if the defendant has proven all of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">More than eight years have passed since the date of the conviction.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The defendant has no pending criminal charges.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">The defendant has not previously been granted two deferred judgments.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">The defendant has paid all court costs, fees, fines, restitution, and any other financial obligations ordered by the court or assessed by the clerk of the district court.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The following misdemeanors shall not be expunged:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A conviction under <xhtml:span class="iowaCodeRef">section 123.46</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A simple misdemeanor conviction under <xhtml:span class="iowaCodeRef">section 123.47, subsection 3</xhtml:span>, or similar local ordinance. </xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A conviction under <xhtml:span class="iowaCodeRef">section 321.218</xhtml:span>, <xhtml:span class="iowaCodeRef">321A.32</xhtml:span>, or <xhtml:span class="iowaCodeRef">321J.21</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">A conviction under <xhtml:span class="iowaCodeRef">section 321J.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">A conviction for a sex offense as defined in <xhtml:span class="iowaCodeRef">section 692A.101</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para">A conviction for involuntary manslaughter under <xhtml:span class="iowaCodeRef">section 707.5</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">g</xhtml:span></xhtml:div><xhtml:p class="para">A conviction for assault under <xhtml:span class="iowaCodeRef">section 708.2, subsection 3</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">h</xhtml:span></xhtml:div><xhtml:p class="para">A conviction under <xhtml:span class="iowaCodeRef">section 708.2A</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">i</xhtml:span></xhtml:div><xhtml:p class="para">A conviction for harassment under <xhtml:span class="iowaCodeRef">section 708.7</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">j</xhtml:span></xhtml:div><xhtml:p class="para">A conviction for stalking under <xhtml:span class="iowaCodeRef">section 708.11</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">k</xhtml:span></xhtml:div><xhtml:p class="para">A conviction for removal of an officer’s communication or control device under <xhtml:span class="iowaCodeRef">section 708.12</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div <xhtml:span class="iowaCodeRef">chapter 901A</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">w</xhtml:span></xhtml:div><xhtml:p class="para">A conviction for a comparable offense listed in <xhtml:span class="CFRRef">49 C.F.R. §383.51(b)</xhtml:span> (table 1) or <xhtml:span class="CFRRef">49 C.F.R. §383.51(e)</xhtml:span> (table 4).</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">x</xhtml:span></xhtml:div><xhtml:p class="para">A conviction under prior law of an offense comparable to an offense enumerated in <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A person shall be granted an expungement of a record under <xhtml:span class="iowaCodeRef">this section</xhtml:span> one time in the person’s lifetime. However, the one application may request the expungement of records relating to more than one misdemeanor offense if the misdemeanor offenses arose from the same transaction or occurrence, and the application contains the misdemeanor offenses to be expunged.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The expunged record under <xhtml:span class="iowaCodeRef">this section</xhtml:span> is a confidential record exempt from public access under <xhtml:span class="iowaCodeRef">section 22.7</xhtml:span> but shall be made available by the clerk of the district court upon court order.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Notwithstanding <xhtml:span class="iowaCodeRef">section 692.2</xhtml:span>, after receipt of notice from the clerk of the district court that a record of conviction has been expunged under <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>, the record of conviction shall be removed from the criminal history data files maintained by the department of public safety if such a record was maintained in the criminal history data files.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">The supreme court may prescribe rules governing the procedures applicable to the expungement of a criminal case under <xhtml:span class="iowaCodeRef">this section</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This section</xhtml:span> applies to a misdemeanor conviction that occurred prior to, on, or after July 1, 2019.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2019 Acts, ch 140, §2</xhtml:span>; <xhtml:span class="iowaActsRef">2022 Acts, ch 1132, §16</xhtml:span></xhtml:div></xhtml:div></slim:Section></slim:Level></slim:Body></slim:Document>
