"/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp901A"><slim:Heading class="heading"><xhtml:span class="identifier">901A</xhtml:span><xhtml:span class="headnote">SEXUALLY PREDATORY OFFENSES</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec901A.1"><xhtml:div class="heading"><xhtml:span class="identifier">901A.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, the term <xhtml:span class="term">“sexually predatory offense”</xhtml:span> means any serious or aggravated misdemeanor or felony which constitutes:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A violation of any provision of <xhtml:span class="iowaCodeRef">chapter 709</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Sexual exploitation of a minor in violation of <xhtml:span class="iowaCodeRef">section 728.12, subsection 1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Enticing a minor in violation of <xhtml:span class="iowaCodeRef">section 710.10, subsection 1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Pandering involving a minor in violation of <xhtml:span class="iowaCodeRef">section 725.3, subsection 2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Any offense involving an attempt to commit an offense contained in <xhtml:span class="iowaCodeRef">this section</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para">An offense under prior law of this state or an offense committed in another jurisdiction which would constitute an equivalent offense under paragraphs <xhtml:span class="i">“a”</xhtml:span> through <xhtml:span class="i">“e”</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, the term <xhtml:span class="term">“prior conviction”</xhtml:span> includes a plea of guilty, deferred judgment, deferred or suspended sentence, or adjudication of delinquency, regardless of whether a prior conviction occurred before, on, or after March 31, 2000.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, the term <xhtml:span class="term">“sexually violent offense”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 229A.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">96 Acts, ch 1082, §3</xhtml:span>; <xhtml:span class="iowaActsRef">97 Acts, ch 23, §79</xhtml:span>; <xhtml:span class="iowaActsRef">2000 Acts, ch 1030, §1, 2, 4</xhtml:span>; <xhtml:span class="iowaActsRef">2001 Acts, ch 17, §5</xhtml:span>; <xhtml:span class="iowaActsRef">2002 Acts, ch 1139, §23, 27</xhtml:span>; <xhtml:span class="iowaActsRef">2010 Acts, ch 1193, §68, 78</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec901A.2"><xhtml:div class="heading"><xhtml:span class="identifier">901A.2</xhtml:span><xhtml:span class="headnote">Enhanced sentencing.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A person convicted of a sexually predatory offense which is a serious or aggravated misdemeanor, who has a prior conviction for a sexually predatory offense, shall be sentenced to and shall serve twice the maximum period of incarceration for the offense, notwithstanding any other provision of the Code to the contrary, prior to being eligible for parole or work release. A person sentenced under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall not have the person’s sentence reduced under <xhtml:span class="iowaCodeRef">chapter 903A</xhtml:span> or otherwise by more than fifteen percent.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person convicted of a sexually predatory offense which is a serious or aggravated misdemeanor, who has two or more prior convictions for sexually predatory offenses, shall be sentenced to and shall serve a period of incarceration of ten years, notwithstanding any other provision of the Code to the contrary. A person sentenced under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall not have the person’s sentence reduced under <xhtml:span class="iowaCodeRef">chapter 903A</xhtml:span> or otherwise by more than fifteen percent.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Except as otherwise provided in <xhtml:span class="iowaCodeRef">subsection 5</xhtml:span>, a person convicted of a sexually predatory offense which is a felony, who has a prior conviction for a sexually predatory offense, shall be sentenced to and shall serve twice the maximum period of incarceration for the offense, or twenty-five years, whichever is greater, notwithstanding any other provision of the Code to the contrary. A person sentenced under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall not have the person’s sentence reduced under <xhtml:span class="iowaCodeRef">chapter 903A</xhtml:span> or otherwise by more than fifteen percent.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Except as otherwise provided in <xhtml:span class="iowaCodeRef">subsection 5</xhtml:span>, a person convicted of a sexually predatory offense which is a felony who has previously been sentenced under <xhtml:span class="iowaCodeRef">subsection 3</xhtml:span> shall be sentenced to life in prison on the same terms as a class “A” felon under <xhtml:span class="iowaCodeRef">section 902.1</xhtml:span>, notwithstanding any other provision of the Code to the contrary. In order for a person to be sentenced under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>, the prosecuting attorney shall allege and prove that <xhtml:span class="iowaCodeRef">this section</xhtml:span> is applicable to the person.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">A person who has been convicted of a violation of <xhtml:span class="iowaCodeRef">section 709.3, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“b”</xhtml:span>, shall, upon a second conviction for a violation of <xhtml:span class="iowaCodeRef">section 709.3, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“b”</xhtml:span>, be committed to the custody of the director of the Iowa department of corrections for the rest of the person’s life. In determining whether a conviction is a first or second conviction under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>, a prior conviction for a criminal offense committed in another jurisdiction which would constitute a violation of <xhtml:span class="iowaCodeRef">section 709.3, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“b”</xhtml:span>, if committed in this state, shall be considered a conviction under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>. The terms and conditions applicable to sentences for class “A” felons under <xhtml:span class="iowaCodeRef">chapters 901 through 909</xhtml:span> shall apply to persons sentenced under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">A person who has been placed in a transitional release program, released with supervision, or discharged pursuant to <xhtml:span class="iowaCodeRef">chapter 229A</xhtml:span>, and who is subsequently convicted of a sexually predatory offense or a sexually violent offense, shall be sentenced to life in prison on the same terms as a class “A” felon under <xhtml:span class="iowaCodeRef">section 902.1</xhtml:span>, notwithstanding any other provision of the Code to the contrary. The terms and conditions applicable to sentences for class “A” felons under <xhtml:span class="iowaCodeRef">chapters 901 through 909</xhtml:span> shall apply to persons sentenced under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>. However, if the person commits a sexually violent offense which is a misdemeanor offense under <xhtml:span class="iowaCodeRef">chapter 709</xhtml:span>, the person shall be sentenced to life in prison, with eligibility for parole as provided in <xhtml:span class="iowaCodeRef">chapter 906</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">A person sentenced under the provisions of <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall not be eligible for deferred judgment, deferred sentence, or suspended sentence.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para">In addition to any other sentence imposed on a person convicted of a sexually predatory offense pursuant to <xhtml:span class="iowaCodeRef">subsection 1, 2, or 3</xhtml:span>, the person shall be sentenced to an additional term of parole or work release not to exceed two years. The board of parole shall determine whether the person should be released on parole or placed in a work release program. The sentence of parole supervision shall commence immediately upon the person’s release by the board of parole and shall be under the terms and conditions as set out in <xhtml:span class="iowaCodeRef">chapter 906</xhtml:span>. Violations of parole or work release shall be subject to the procedures set out in <xhtml:span class="iowaCodeRef">chapter 904</xhtml:span> or <xhtml:span class="iowaCodeRef">908</xhtml:span> or rules adopted under those chapters.
