"/><slim:Item idref="sec811.3" title="811.3   Qualification and examination of surety."/><slim:Item idref="sec811.4" title="811.4   Undertaking of bail as liens on real estate."/><slim:Item idref="sec811.5" title="811.5   Bail on appeal."/><slim:Item idref="sec811.6" title="811.6   Forfeiture of bail."/><slim:Item idref="sec811.7" title="811.7   Recommitment after bail."/><slim:Item idref="sec811.8" title="811.8   Surrender of defendant."/><slim:Item idref="sec811.9" title="811.9   Forfeiture of appearance bond and conditions to set aside."/><slim:Item idref="sec811.10" title="811.10   Discharge of surety."/><slim:Item idref="sec811.11" title="811.11   Bail after deferred judgment."/><slim:Item idref="sec811.12" title="811.12   Limitations."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp811"><slim:Heading class="heading"><xhtml:span class="identifier">811</xhtml:span><xhtml:span class="headnote">PRETRIAL AND POST-TRIAL RELEASE — BAIL</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec811.1"><xhtml:div class="heading"><xhtml:span class="identifier">811.1</xhtml:span><xhtml:span class="headnote">Bail and bail restrictions.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Assault”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Charged”</xhtml:span> means the same as <xhtml:span class="term">“charge”</xhtml:span> as defined in <xhtml:span class="iowaCodeRef">section 801.4</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Felonious assault upon an officer”</xhtml:span> means the defendant committed an assault, for which the penalty is a felony, with the knowledge the person against whom the felonious assault was committed was a peace officer or correctional officer, acting in the peace officer’s or correctional officer’s official capacity.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Peace officer”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 801.4</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">All defendants are bailable both before and after conviction, by sufficient surety, or subject to release upon condition or on their own recognizance, except that the following defendants shall not be admitted to bail:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A defendant charged with murder in the first degree of a peace officer in violation of <xhtml:span class="iowaCodeRef">section 707.2</xhtml:span>, if the murder in the first degree was committed with the knowledge the person against whom the murder was committed was a peace officer or correctional officer, acting in the peace officer’s or correctional officer’s official capacity.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A defendant awaiting judgment of conviction and sentencing following either a plea or verdict of guilty of a class “A” felony; forcible felony as defined in <xhtml:span class="iowaCodeRef">section 702.11</xhtml:span>; a felonious assault upon an officer; any class “B” felony included in <xhtml:span class="iowaCodeRef">section 462A.14</xhtml:span> or <xhtml:span class="iowaCodeRef">707.6A</xhtml:span>; any felony included in <xhtml:span class="iowaCodeRef">section 124.401, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span> or <xhtml:span class="i">“b”</xhtml:span>; a second or subsequent offense under <xhtml:span class="iowaCodeRef">section 124.401, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“c”</xhtml:span>; any public offense committed while detained pursuant to <xhtml:span class="iowaCodeRef">section 229A.5</xhtml:span>; or any public offense committed while subject to an order of commitment pursuant to <xhtml:span class="iowaCodeRef">chapter 229A</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A defendant appealing a conviction of a class “A” felony; forcible felony as defined in <xhtml:span class="iowaCodeRef">section 702.11</xhtml:span>; a felonious assault upon an officer; any class “B” or “C” felony included in <xhtml:span class="iowaCodeRef">section 462A.14</xhtml:span> or <xhtml:span class="iowaCodeRef">707.6A</xhtml:span>; any felony included in <xhtml:span class="iowaCodeRef">section 124.401, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span> or <xhtml:span class="i">“b”</xhtml:span>; or a second or subsequent conviction under <xhtml:span class="iowaCodeRef">section 124.401, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“c”</xhtml:span>; any public offense committed while detained pursuant to <xhtml:span class="iowaCodeRef">section 229A.5</xhtml:span>; or any public offense committed while subject to an order of commitment pursuant to <xhtml:span class="iowaCodeRef">chapter 229A</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Notwithstanding paragraphs <xhtml:span class="i">“b”</xhtml:span> and <xhtml:span class="i">“c”</xhtml:span>, a defendant awaiting judgment of conviction and sentencing following either a plea or verdict of guilty of, or appealing a conviction of, any felony offense included in <xhtml:span class="iowaCodeRef">section 708.11, subsection 3</xhtml:span>, or a felony offense under <xhtml:span class="iowaCodeRef">chapter 124</xhtml:span> not provided for in paragraph <xhtml:span class="i">“b”</xhtml:span> or <xhtml:span class="i">“c”</xhtml:span>, is presumed to be ineligible to be admitted to bail unless the court determines that such release reasonably will not result in the person failing to appear as required and will not jeopardize the personal safety of another person or persons.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C51, §3211 – 3213; <xhtml:span class="iowaActsRef">2024 Acts, ch 1154, §25</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">Bail bonds, see <xhtml:span class="iowaCourtRulesRef">R.Cr.P. 2.37</xhtml:span> – Form 1 </xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec811.1A"><xhtml:div class="heading"><xhtml:span class="identifier">811.1A</xhtml:span><xhtml:span class="headnote">Detention hearing.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">When a defendant is awaiting sentencing after conviction for a felony or is pursuing an appeal in such a case following sentencing, and the defendant would otherwise be eligible to be admitted to bail under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, but it appears by clear and convincing evidence that if released the defendant is likely to pose a danger to another person or to the property of others, the defendant may be detained under the authority of <xhtml:span class="iowaCodeRef">this section</xhtml:span> and in the manner provided in <xhtml:span class="iowaCodeRef">subsection 2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The following procedures shall apply to a detention hearing:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The prosecuting attorney may initiate a detention hearing by a verified ex parte written motion. Upon such motion, the district court may issue a warrant for the immediate arrest of the defendant, if the defendant is not in custody.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The defendant shall be brought before the district court within twenty-four hours after arrest, or if the defendant is in custody, the defendant shall be brought before the district court within twenty-four hours of the prosecuting attorney’s filing of the motion. The detention hearing shall be held within seventy-two hours of the defendant’s arrest, or if the defendant is in custody, the detention hearing shall be held within seventy-two hours of the filing of the motion.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">The defendant shall be entitled to representation by counsel, including appointed counsel if indigent, and shall be entitled to the right of cross-examination and to present information, to testify, and to present witnesses in the defendant’s own behalf, but shall not be entitled to being admitted to bail.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Testimony of the defendant given during the hearing shall not be admissible on the issue of guilt in any other judicial proceeding, except that such testimony shall be admissible in proceedings under <xhtml:span class="iowaCodeRef">section 811.2, subsection 8</xhtml:span>, and <xhtml:span class="iowaCodeRef">section 811.8</xhtml:span>, and in perjury proceedings.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Appeals from orders of detention may be taken in the manner provided under <xhtml:span class="iowaCodeRef">section 811.2, subsection 7</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para">If the trial court issues an order of detention, the order shall be accompanied by a written finding of fact and the reasons for the detention order.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">g</xhtml:span></xhtml:div><xhtml:p class="para">For the purposes of such proceedings, the trial court is not divested of jurisdiction by the filing of a notice of appeal.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2004 Acts, ch 1084, §4</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec811.2"><xhtml:div class="heading"><xhtml:span class="identifier">811.2</xhtml:span><xhtml:span class="headnote">Conditions of release — penalty for failure to appear.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span><xhtml:span class="headnote">Conditions for release of defendant.</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">All bailable defendants shall be ordered released from custody pending judgment or entry of deferred judgment on their personal recognizance, or upon the execution of an unsecured appearance bond in an amount specified by the magistrate unless the magistrate determines in the exercise of the magistrate’s discretion, that such a release will not reasonably assure the appearance of the defendant as required or that release will jeopardize the personal safety of another person or persons. When such determination is made, the magistrate shall, either in lieu of or in addition to the above methods of release, impose the first of the following conditions of release which will reasonably assure the appearance of the person for trial or deferral of judgment and the safety of other persons, or, if no single condition gives that assurance, any combination of the following conditions:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Place the defendant in the custody of a designated person or organization agreeing to supervise the defendant.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Place restrictions on the travel, association or place of abode of the defendant during the period of release.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Require the execution of an appearance bond in a specified amount and the deposit with the clerk of the district court or a public officer designated under <xhtml:span class="iowaCodeRef">section 602.1211, subsection 4</xhtml:span>, in cash or other qualified security, of a sum not to exceed ten percent of the amount of the bond, the deposit to be returned to the person who deposited the specified amount with the clerk upon the performance of the appearances as required in <xhtml:span class="iowaCodeRef">section 811.6</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Require the execution of a bail bond with sufficient surety, or the deposit of cash in lieu of bond. However, except as provided in <xhtml:span class="iowaCodeRef">section 811.1</xhtml:span>, bail initially given remains valid until final disposition of the offense or entry of an order deferring judgment. If the amount of bail is deemed insufficient by the court before whom the offense is pending, the court may order an increase of bail and the defendant must provide the additional undertaking, written or in cash, to secure release.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Impose any other condition deemed reasonably necessary to assure appearance as required, or the safety of another person or persons including a condition requiring that the defendant return to custody after specified hours, or a condition that the defendant have no contact with the victim or other persons specified by the court.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Any bailable defendant who is charged with unlawful possession, manufacture, delivery, or distribution of a controlled substance or other drug under <xhtml:span class="iowaCodeRef">chapter 124</xhtml:span> and is ordered released shall be required, as a condition of that release, to submit to a substance use disorder evaluation and follow any recommendations proposed in the evaluation for appropriate substance use disorder treatment. However, if a bailable defendant is charged with manufacture, delivery, possession with the intent to manufacture or deliver, or distribution of methamphetamine, its salts, optical isomers, and salts of its optical isomers, the defendant shall, in addition to a substance use disorder evaluation, remain under supervision and be required to undergo random drug tests as a condition of release.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span><xhtml:span class="headnote">Determination of conditions.</xhtml:span></xhtml:div><xhtml:p class="para">In determining which conditions of release will reasonably assure the defendant’s appearance and the safety of another person or persons, the magistrate shall, on the basis of available information, take into account the nature and circumstances of the offense charged, the defendant’s family ties, employment, financial resources, character and mental condition, the length of the defendant’s residence in the community, the defendant’s record of convictions, including the defendant’s failure to pay any fine, surcharge, or court costs, and the defendant’s record of appearance at court proceedings or of flight to avoid prosecution or failure to appear at court proceedings.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span><xhtml:span class="headnote">Release at initial appearance.</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This chapter</xhtml:span> does not preclude the release of an arrested person as authorized by <xhtml:span class="iowaCodeRef">section 804.21</xhtml:span>, unless the arrested person is charged with manufacture, delivery, possession with the intent to manufacture or deliver, or distribution of methamphetamine.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span><xhtml:span class="headnote">Statement to all defendants.</xhtml:span></xhtml:div><xhtml:p class="para">When a defendant appears before a magistrate pursuant to <xhtml:span class="iowaCourtRulesRef">rule of criminal procedure 2.2</xhtml:span> or <xhtml:span class="iowaCourtRulesRef">2.3</xhtml:span>, the defendant shall be informed of the defendant’s right to have said conditions of release reviewed. If the defendant indicates that the defendant desires such a review and is indigent and unable to retain legal counsel, the magistrate shall appoint an attorney to represent the defendant for the purpose of such review. Unless the conditions of release are amended and the defendant is thereupon released, the magistrate shall set forth in writing the reasons for requiring conditions imposed. A defendant who is ordered released by a magistrate other than a district court judge or district associate judge on a condition which required that the defendant return to custody after specified hours, shall, upon application, be entitled to review by the magistrate who imposed the condition in the same manner as a defendant who remains in full-time custody. In the event that the magistrate who imposed conditions of release is not available, any other magistrate in the judicial district may review such conditions.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span><xhtml:span class="headnote">Statement of conditions when defendant is released.</xhtml:span></xhtml:div><xhtml:p class="para">A magistrate authorizing the release of a defendant under <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall issue a written order containing a statement of the conditions imposed if any, shall inform the defendant of the penalties applicable to violation of the conditions of release and shall advise the defendant that a warrant for the defendant’s arrest will be issued immediately upon such violation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span><xhtml:span class="headnote">Amendment of release conditions.</xhtml:span></xhtml:div><xhtml:p class="para">A magistrate ordering the release of the defendant on any conditions specified in <xhtml:span class="iowaCodeRef">this section</xhtml:span> may at any time amend the order to impose additional or different conditions of release, provided that, if the imposition of different or additional conditions results in the detention of the defendant as a result of the defendant’s inability to meet such conditions, the provisions of <xhtml:span class="iowaCodeRef">subsection 3</xhtml:span> of <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall apply.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span><xhtml:span class="headnote">Appeal from conditions of release.</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A defendant who is detained, or whose release on a condition requiring the defendant to return to custody after specified hours is continued, after review of the defendant’s application pursuant to <xhtml:span class="iowaCodeRef">subsection 3 or 5</xhtml:span> of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, by a magistrate, other than a district judge or district associate judge having original jurisdiction of the offense with which the defendant is charged, may make application to a district judge or district associate judge having jurisdiction to amend the order. Said motion shall be promptly set for hearing and a record made thereof.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">In any case in which a court denied a motion under paragraph <xhtml:span class="i">“a”</xhtml:span> of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> to amend an order imposing conditions of release, or a defendant is detained after conditions of release have been imposed or amended upon such a motion, an appeal may be taken from the district court. The appeal shall be determined summarily, without briefs, on the record made. However, the defendant may elect to file briefs and may be heard in oral argument, in which case the prosecution shall have a right to respond as in an ordinary appeal from a criminal conviction. The appellate court may, on its own motion, order the parties to submit briefs and set the time in which such briefs shall be filed. Any order so appealed shall be affirmed if it is supported by the proceeding below. If the order is not so supported, the court may remand the case for a further hearing or may, with or without additional evidence, order the defendant released pursuant to <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> of <xhtml:span class="iowaCodeRef">this section</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span><xhtml:span class="headnote">Failure to appear — penalty.</xhtml:span></xhtml:div><xhtml:p class="para">Any person who, having been released pursuant to <xhtml:span class="iowaCodeRef">this section</xhtml:span>, willfully fails to appear before any court or magistrate as required shall, in addition to the forfeiture of any security given or pledged for the person’s release, if the person was released in connection with a charge which constitutes a felony, or while awaiting sentence or pending appeal after conviction of any public offense, be guilty of a class “D” felony. If the defendant was released before conviction or acquittal in connection with a charge which constitutes any public offense not a felony, the defendant shall be guilty of a serious misdemeanor. If the person was released for appearance as a material witness, the person shall be guilty of a simple misdemeanor. If the defendant fails to appear at the time and place when the defendant’s personal appearance is lawfully required, or to surrender in execution of the judgment, the court must direct an entry of the failure to be made of record, and the undertaking of the defendant’s bail, or the money deposited, is thereupon forfeited. As a part of the entry, except as provided in <xhtml:span class="iowaCourtRulesRef">rule of criminal procedure 2.72</xhtml:span>, the court shall direct the clerk of the district court of the county to give thirty days’ notice in writing to the defendant and the defendant’s sureties to appear and show cause, if any, why judgment should not be entered for the amount of bail. If such appearance is not made, judgment shall be entered by the court.
