id="sec801.1"><xhtml:div class="heading"><xhtml:span class="identifier">801.1</xhtml:span><xhtml:span class="headnote">Short title.</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">Chapters 801 through 819</xhtml:span> shall be known and may be cited as the <xhtml:span class="i">“Iowa Code of Criminal Procedure”</xhtml:span>.</xhtml:p><xhtml:div class="identifier">801.2</xhtml:span><xhtml:span class="headnote">Scope.</xhtml:span></xhtml:div><xhtml:p class="para">The provisions of the Iowa code of criminal procedure shall govern procedure in the courts of Iowa in all criminal proceedings except where a different procedure is specifically provided by law.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C79, <xhtml:span class="iowaCodeRef">81, §801.2</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec801.3"><xhtml:div class="heading"><xhtml:span class="identifier">801.3</xhtml:span><xhtml:span class="headnote">General purposes.</xhtml:span></xhtml:div><xhtml:p class="para">The provisions of the Iowa code of criminal procedure shall be liberally construed to give effect to the general purposes thereof, which shall be to provide for:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Simplicity in criminal procedure.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Fairness in administration of the criminal laws.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Elimination of unjustifiable delay in pretrial, trial, and post-trial proceedings.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Just determination of every criminal proceeding by a fair and impartial trial and review.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The effective apprehension and trial of persons suspected of committing public offenses without violation of fundamental human rights.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C79, <xhtml:span class="iowaCodeRef">81, §801.3</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec801.4"><xhtml:div class="heading"><xhtml:span class="identifier">801.4</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">For the purposes of <xhtml:span class="iowaCodeRef">Title XVI</xhtml:span>,* unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The words <xhtml:span class="i">“accused person”, “accused”, “defendant”,</xhtml:span> and similar words mean an individual, a public or private corporation, a partnership, or an unincorporated or voluntary association.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Attorney general”</xhtml:span> includes an authorized assistant of the attorney general.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Charge”</xhtml:span> means a written statement presented to a court accusing a person of the commission of a public offense, including but not limited to a complaint, information, or indictment.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Complaint”</xhtml:span> means a statement in writing, under oath or affirmation, made before a magistrate or district court clerk or clerk’s designee as the case may be, of the commission of a public offense, and accusing someone of committing the public offense. A complaint shall be substantially in the form provided in the Iowa rules of criminal procedure.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“County attorney”</xhtml:span> includes an authorized assistant of the county attorney.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Court”</xhtml:span> means a place where justice is administered by a magistrate and includes such magistrate while acting in a judicial capacity.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Criminal proceeding”</xhtml:span> is a proceeding in which a person is accused of a public offense.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Indictable offense”</xhtml:span> means an offense other than a simple misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">9</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Indigent person”</xhtml:span> means a person who is indigent as determined in accordance with <xhtml:span class="iowaCodeRef">section 815.9</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">10</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Magistrate”</xhtml:span> means all judges of the district court, including district associate judges and judicial magistrates throughout the state.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">11</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Peace officers”</xhtml:span>, sometimes designated “law enforcement officers”, include:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Sheriffs and their regular deputies who are subject to mandated law enforcement training.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Marshals and police officers of cities.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Peace officer members of the department of public safety as defined in <xhtml:span class="iowaCodeRef">chapter 80</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Parole officers acting pursuant to <xhtml:span class="iowaCodeRef">section 906.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Probation officers acting pursuant to <xhtml:span class="iowaCodeRef">section 602.7202, subsection 4</xhtml:span>, and <xhtml:span class="iowaCodeRef">section 907.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para">Special security officers employed by board of regents institutions as set forth in <xhtml:span class="iowaCodeRef">section 262.13</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">g</xhtml:span></xhtml:div><xhtml:p class="para">Conservation officers as authorized by <xhtml:span class="iowaCodeRef">section 456A.13</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">h</xhtml:span></xhtml:div><xhtml:p class="para">Such employees of the department of transportation as are designated <xhtml:span class="i">“peace officers”</xhtml:span> by resolution of the department under <xhtml:span class="iowaCodeRef">section 321.477</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">i</xhtml:span></xhtml:div><xhtml:p class="para">Employees of an aviation authority designated as <xhtml:span class="i">“peace officers”</xhtml:span> by the authority under <xhtml:span class="iowaCodeRef">section 330A.8, subsection 16</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">j</xhtml:span></xhtml:div><xhtml:p class="para">Such persons as may be otherwise so designated by law.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">12</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="i">“Prosecuting attorney”,</xhtml:span> sometimes designated <xhtml:span class="term">“prosecutor”</xhtml:span>, means any attorney who is authorized by law to appear on the behalf of the state in a criminal case, and includes the attorney general, an assistant attorney general, the county attorney, an assistant county attorney, or a special or substitute prosecutor whose appearance is approved by a court having jurisdiction to try the defendant for the offense with which the defendant is charged. In the case of prosecution for a municipal ordinance violation, <xhtml:span class="term">“prosecuting attorney”</xhtml:span> means a city attorney or an assistant city attorney.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">13</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Prosecution”</xhtml:span> means the commencement, including the filing of a complaint, and continuance of a criminal proceeding, and pursuit of that proceeding to final judgment on behalf of the state or other political subdivision.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C51, §2778, 2822, 2823, 2830; R60, §4439, 4440, 4447, 4530; C73, §4108, 4109, 4111; C97, §5097, 5099, 5101; C24, 27, 31, 35, 39, §<xhtml:span class="b">13403, 13405, 13458;</xhtml:span> C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, §748.1, 748.3, 754.1; C79, <xhtml:span class="iowaCodeRef">81</xhtml:span>, <xhtml:span class="iowaCodeRef">S81, §801.4</xhtml:span>; <xhtml:span class="iowaActsRef">81 Acts, ch 117, §1240</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">83 Acts, ch 186, §10129, 10130, 10201</xhtml:span>; <xhtml:span class="iowaActsRef">84 Acts, ch 1019, §1, 2</xhtml:span>; <xhtml:span class="iowaActsRef">89 Acts, ch 182, §11</xhtml:span>; <xhtml:span class="iowaActsRef">90 Acts, ch 1233, §43</xhtml:span></xhtml:p></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">*This provision does not include <xhtml:span class="iowaCodeRef">chapters 709A</xhtml:span>, <xhtml:span class="iowaCodeRef">718A</xhtml:span>, <xhtml:span class="iowaCodeRef">822</xhtml:span>, <xhtml:span class="iowaCodeRef">904</xhtml:span>, <xhtml:span class="iowaCodeRef">913</xhtml:span>, and <xhtml:span class="iowaCodeRef">914</xhtml:span>, which were moved into Title XVI by the Code editor. <xhtml:span class="iowaCodeRef">Chapters 709A</xhtml:span>, <xhtml:span class="iowaCodeRef">718A</xhtml:span>, <xhtml:span class="iowaCodeRef">822</xhtml:span>, <xhtml:span class="iowaCodeRef">904</xhtml:span>, <xhtml:span class="iowaCodeRef">913</xhtml:span>, and <xhtml:span class="iowaCodeRef">914</xhtml:span> contain the applicable provisions pertaining to those chapters. </xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec801.5"><xhtml:div class="heading"><xhtml:span class="identifier">801.5</xhtml:span><xhtml:span class="headnote">Applicability to offenses committed before the effective date.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Except as provided in <xhtml:span class="iowaCodeRef">subsections 2 and 3</xhtml:span> of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, <xhtml:span class="iowaCodeRef">Title XVI</xhtml:span>* does not apply to offenses committed before January 1, 1978. Prosecutions for offenses committed before that date are governed by the prior law, which is continued in effect for that purpose, as if this title* were not in force. For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, an offense is committed before said date if any of the elements of the offense occurred before that date.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">In any case pending on or commenced after said date, involving an offense committed before that date:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Upon the request of the defendant a defense or mitigation under this title,* whether specifically provided for herein or based upon the failure of said statutes to define an applicable offense, shall apply; and</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Upon the request of the defendant and the approval of the court:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Procedural provisions of this title* shall apply insofar as they are justly applicable; and</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The court may impose a sentence or suspended imposition of a sentence under the provisions of this title* applicable to the offense and the offender.</xhtml:p></xhtml:div></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Provisions of this title* governing the release or discharge of prisoners, probationers, and parolees shall apply to persons under sentence for offenses committed before January 1, 1978, except that the minimum or maximum period of their detention or supervision shall in no case be increased, nor shall the provisions of this title* affect the substantive or procedural validity of any judgment of conviction entered before said date, regardless of the fact that appeal time has not run or that an appeal is pending.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C79, <xhtml:span class="iowaCodeRef">81, §801.5</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">*This provision does not include <xhtml:span class="iowaCodeRef">chapters 709A</xhtml:span>, <xhtml:span class="iowaCodeRef">718A</xhtml:span>, <xhtml:span class="iowaCodeRef">822</xhtml:span>, <xhtml:span class="iowaCodeRef">904</xhtml:span>, <xhtml:span class="iowaCodeRef">913</xhtml:span>, and <xhtml:span class="iowaCodeRef">914</xhtml:span>, which were moved into Title XVI by the Code editor. <xhtml:span class="iowaCodeRef">Chapters 709A</xhtml:span>, <xhtml:span class="iowaCodeRef">718A</xhtml:span>, <xhtml:span class="iowaCodeRef">822</xhtml:span>, <xhtml:span class="iowaCodeRef">904</xhtml:span>, <xhtml:span class="iowaCodeRef">913</xhtml:span>, and <xhtml:span class="iowaCodeRef">914</xhtml:span> contain the applicable provisions pertaining to those chapters. </xhtml:div></xhtml:div></slim:Section></slim:Level></slim:Body></slim:Document>
