and the material, taken as a whole, lacks serious literary, scientific, political or artistic value.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Place of business”</xhtml:span> means the premises of a business required to obtain a sales or use tax permit pursuant to <xhtml:span class="iowaCodeRef">chapter 423</xhtml:span>, the premises of a nonprofit or not-for-profit organization, and the premises of an establishment which is open to the public at large or where entrance is limited by a cover charge or membership requirement.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">Unless otherwise provided, <xhtml:span class="term">“prohibited sexual act”</xhtml:span> means any of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A sex act as defined in <xhtml:span class="iowaCodeRef">section 702.17</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">An act of bestiality involving a minor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Fondling or touching the pubes or genitals of a minor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Fondling or touching the pubes or genitals of a person by a minor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Sadomasochistic abuse of a minor for the purpose of arousing or satisfying the sexual desires of a person who may view a visual depiction of the abuse.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para">Sadomasochistic abuse of a person by a minor for the purpose of arousing or satisfying the sexual desires of a person who may view a visual depiction of the abuse.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">g</xhtml:span></xhtml:div><xhtml:p class="para">Nudity of a minor for the purpose of arousing or satisfying the sexual desires of a person who may view a visual depiction of the nude minor.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Promote”</xhtml:span> means to procure, manufacture, issue, sell, give, provide, lend, mail, deliver, transfer, transmute, transmit, publish, distribute, circulate, disseminate, present, exhibit, or advertise, or to offer or agree to do any of these acts.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">9</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Sadomasochistic abuse”</xhtml:span> means the infliction of physical or mental pain upon a person or the condition of a person being fettered, bound or otherwise physically restrained.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">10</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Sex act”</xhtml:span> means any sexual contact, actual or simulated, either natural or deviate, between two or more persons, or between a person and an animal, by penetration of the penis into the vagina or anus, or by contact between the mouth or tongue and genitalia or anus, or by contact between a finger of one person and the genitalia of another person or by use of artificial sexual organs or substitutes therefor in contact with the genitalia or anus.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">11</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Visual depiction”</xhtml:span> means but is not limited to any picture, slide, photograph, digital or electronic image, negative image, undeveloped film, motion picture, videotape, digital or electronic recording, live transmission, or other pictorial or three-dimensional representation.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C75, 77, §725.1; <xhtml:span class="iowaActsRef">2022 Acts, ch 1138, §33</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec728.2"><xhtml:div class="heading"><xhtml:span class="identifier">728.2</xhtml:span><xhtml:span class="headnote">Dissemination and exhibition of obscene material to minors.</xhtml:span></xhtml:div><xhtml:p class="para">Any person eighteen years of age or older, other than the parent or guardian of the minor, who knowingly disseminates or exhibits obscene material to a minor, including the exhibition of obscene material so that it can be observed by a minor on or off the premises where it is displayed, is guilty of a public offense and shall upon conviction be guilty as follows:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">For a first offense, a serious misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">For a second offense, an aggravated misdemeanor with a mandatory minimum term of confinement of one year. No portion of the mandatory minimum term of confinement imposed by <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall be deferred or suspended.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">For a third or subsequent offense, a class “D” felony with a mandatory minimum term of confinement of three years. However, second and subsequent violations of <xhtml:span class="iowaCodeRef">this section</xhtml:span> by a person who has been previously convicted of violating <xhtml:span class="iowaCodeRef">this section</xhtml:span> are class “D” felonies. <xhtml:span class="iowaActsRef">89 Acts, ch 263, §2</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec728.5"><xhtml:div class="heading"><xhtml:span class="identifier">728.5</xhtml:span><xhtml:span class="headnote">Public indecent exposure in certain establishments.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">An owner, manager, or person who exercises direct control over a place of business required to obtain a sales or use tax permit shall be guilty of a serious misdemeanor under any of the following circumstances:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">If such person allows or permits the actual or simulated public performance of any sex act upon or in such place of business.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">If such person allows or permits the exposure of the genitals or buttocks or female breast of any person who acts as a waiter or waitress.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">If such person allows or permits the exposure of the genitals or female breast nipple of any person who acts as an entertainer, whether or not the owner of the place of business in which the activity is performed employs or pays any compensation to such person to perform such activity.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">If such person allows or permits any person to remain in or upon the place of business who exposes to public view the person’s genitals, pubic hair, or anus.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">If such person advertises that any activity prohibited by <xhtml:span class="iowaCodeRef">this section</xhtml:span> is allowed or permitted in such place of business.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para">If such person allows or permits a minor to engage in or otherwise perform in a live act intended to arouse or satisfy the sexual desires or appeal to the prurient interests of patrons.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">However, if such person allows or permits a minor to participate in any act included in <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>, paragraphs <xhtml:span class="i">“a”</xhtml:span> through <xhtml:span class="i">“d”</xhtml:span>, the person shall be guilty of an aggravated misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"> Except for <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“f”</xhtml:span>, the provisions of <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall not apply to a theater, concert hall, art center, museum, or similar establishment which is primarily devoted to the arts or theatrical performances and in which any of the circumstances contained in <xhtml:span class="iowaCodeRef">this section</xhtml:span> were permitted or allowed as part of such art exhibits or performances.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C79, <xhtml:span class="iowaCodeRef">81, §728.5</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">92 Acts, ch 1029, §1</xhtml:span>; Such application for injunction is optional and not mandatory and shall not be construed as a prerequisite to criminal prosecution for a violation of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C75, 77, §725.4; C79, <xhtml:span class="iowaCodeRef">81, §728.6</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec728.7"><xhtml:div class="heading"><xhtml:span class="identifier">728.7</xhtml:span><xhtml:span class="headnote">Exemptions for public libraries and educational institutions.</xhtml:span></xhtml:div><xhtml:p class="para">Nothing in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> prohibits the use of appropriate material for educational purposes in any accredited school, or any public library, or in any educational program in which the minor is participating. Nothing in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> prohibits the attendance of minors at an exhibition or display of art works or the use of any materials in any public library.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C75, 77, §725.5; C79, <xhtml:span class="iowaCodeRef">81, §728.7</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec728.8"><xhtml:div class="heading"><xhtml:span class="identifier">728.8</xhtml:span><xhtml:span class="headnote">Suspension of licenses or permits.</xhtml:span></xhtml:div><xhtml:p class="para">Any person who knowingly permits a violation of <xhtml:span class="iowaCodeRef">section 728.2</xhtml:span>, <xhtml:span class="iowaCodeRef">728.3</xhtml:span>, or <xhtml:span class="iowaCodeRef">728.5, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“f”</xhtml:span>, to occur on premises under the person’s control shall have all permits and licenses issued to the person under state or local law as a prerequisite for doing business on such premises revoked for a period of six months. The county attorney shall notify all agencies responsible for issuing licenses and permits of any conviction under <xhtml:span class="iowaCodeRef">section 728.2</xhtml:span>, <xhtml:span class="iowaCodeRef">728.3</xhtml:span>, or <xhtml:span class="iowaCodeRef">728.5, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“f”</xhtml:span>.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C75, 77, §725.6; C79, <xhtml:span class="iowaCodeRef">81, §728.8</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">92 Acts, ch 1029, §2</xhtml:span>; <xhtml:span class="iowaActsRef">97 Acts, ch 125, §4</xhtml:span>; <xhtml:span class="iowaActsRef">2011 Acts, ch 34, §148</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec728.9"><xhtml:div class="heading"><xhtml:span class="identifier">728.9</xhtml:span><xhtml:span class="headnote">Evidence considered.</xhtml:span></xhtml:div><xhtml:p class="para">At a trial for violation of <xhtml:span class="iowaCodeRef">section 728.2</xhtml:span> or <xhtml:span class="iowaCodeRef">728.3</xhtml:span> the court may consider the material, and receive into evidence in addition to other competent evidence, the offered testimony of experts pertaining to:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The artistic, literary, political or scientific value, if any, of the challenged material.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The degree of public acceptance within the community of the material or material of similar character.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The intent of the author, artist, producer, publisher or manufacturer in creating the material.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The advertising promotion and other circumstances relating to the sale of the material.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C75, 77, §725.7; C79, <xhtml:span class="iowaCodeRef">81, §728.9</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec728.10"><xhtml:div class="heading"><xhtml:span class="identifier">728.10</xhtml:span><xhtml:span class="headnote">Affirmative defense.</xhtml:span></xhtml:div><xhtml:p class="para">In any prosecution for disseminating or exhibiting obscene material to minors, it is an affirmative defense that the defendant had reasonable cause to believe that the minor involved was eighteen years old or more and the minor exhibited to the defendant a draft card, driver’s license, birth certificate or other official or apparently official document purporting to establish that such minor was eighteen years old or more or was accompanied by a parent or spouse eighteen years of age or more.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C75, 77, §725.8; C79, <xhtml:span class="iowaCodeRef">81, §728.10</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec728.11"><xhtml:div class="heading"><xhtml:span class="identifier">728.11</xhtml:span><xhtml:span class="headnote">Uniform application.</xhtml:span></xhtml:div><xhtml:p class="para">In order to provide for the uniform application of the provisions of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> relating to obscene material applicable to minors within this state, it is intended that the sole and only regulation of obscene material shall be under the provisions of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, and no municipality, county or other governmental unit within this state shall make any law, ordinance or regulation relating to the availability of obscene materials. All such laws, ordinances or regulations shall be or become void, unenforceable and of no effect on January 1, 1978. Nothing in <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall restrict the zoning authority of cities and counties.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C75, 77, §725.9; C79, <xhtml:span class="iowaCodeRef">81, §728.11</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec728.12"><xhtml:div class="heading"><xhtml:span class="identifier">728.12</xhtml:span><xhtml:span class="headnote">Sexual exploitation of a minor.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">It shall be unlawful to employ, use, persuade, induce, entice, coerce, solicit, knowingly permit, or otherwise cause or attempt to cause a minor or a law enforcement officer or agent posing as a minor to engage in a prohibited sexual act or in the simulation of a prohibited sexual act. A person must know, or have reason to know, or intend that the act or simulated act may be photographed, filmed, or otherwise preserved in a visual depiction. A person who commits a violation of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> commits a class “B” felony. Notwithstanding <xhtml:span class="iowaCodeRef">section 902.9</xhtml:span>, the court may assess a fine of not more than fifty thousand dollars for each offense under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> in addition to imposing any other authorized sentence.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">It shall be unlawful to knowingly promote any material visually depicting a live performance of a minor engaging in a prohibited sexual act or in the simulation of a prohibited sexual act. A person who commits a violation of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> commits a class “C” felony. Notwithstanding <xhtml:span class="iowaCodeRef">section 902.9</xhtml:span>, the court may assess a fine of not more than twenty-five thousand dollars for each offense under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> in addition to imposing any other authorized sentence.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">It shall be unlawful to knowingly purchase or possess a visual depiction of a minor engaging in a prohibited sexual act or the simulation of a prohibited sexual act.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A visual depiction containing pictorial representations of different minors shall be prosecuted and punished as separate offenses for each pictorial representation of a different minor in the visual depiction. </xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Violations of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> involving multiple visual depictions of the same minor shall be prosecuted and punished as separate offenses for each pictorial representation of the same minor.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits a violation of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> commits a class “D” felony for a first offense and a class “C” felony for a second or subsequent offense.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>, an offense is considered a second or subsequent offense if, prior to the person’s having been convicted under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>, the person has a prior conviction or deferred judgment under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> or has a prior conviction or deferred judgment in another jurisdiction for a substantially similar offense. The court shall judicially notice the statutes of other states that define offenses substantially similar to the offenses defined in <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> and that therefore can be considered corresponding statutes.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Nothing in <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall be construed to require proof of the actual identity of the identifiable minor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>, <xhtml:span class="term">“visual depiction of a minor”</xhtml:span> includes any visual depiction that has been created, adapted, or modified to give the appearance that an identifiable minor is engaged in a prohibited sexual act or the simulation of a prohibited sexual act. The processor shall not report to the county attorney visual depictions involving mere nudity of the minor, but shall report visual depictions involving a prohibited sexual act. <xhtml:span class="iowaCodeRef">This section</xhtml:span> shall not be construed to require a processor to review all visual depictions delivered to the processor within the processor’s professional capacity or employment.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, <xhtml:span class="term">“prohibited sexual act”</xhtml:span> means any of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A sex act as defined in <xhtml:span class="iowaCodeRef">section 702.17</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">An act of bestiality involving a minor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Fondling or touching the pubes or genitals of a minor for the purpose of arousing or satisfying the sexual desires of a person who may view a visual depiction of the act.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Fondling or touching the pubes or genitals of a person by a minor for the purpose of arousing or satisfying the sexual desires of a person who may view a visual depiction of the act.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Sadomasochistic abuse of a minor for the purpose of arousing or satisfying the sexual desires of a person who may view a visual depiction of the abuse.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para">Sadomasochistic abuse of a person by a minor for the purpose of arousing or satisfying the sexual desires of a person who may view a visual depiction of the abuse.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">g</xhtml:span></xhtml:div><xhtml:p class="para">Nudity of a minor for the purpose of arousing or satisfying the sexual desires of a person who may view a visual depiction of the nude minor.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A person who violates <xhtml:span class="iowaCodeRef">this section</xhtml:span> is guilty of a simple misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">89 Acts, ch 263, §4</xhtml:span>; <xhtml:span class="iowaActsRef">94 Acts, ch 1128, §2</xhtml:span>; <xhtml:span class="iowaActsRef">2012 Acts, ch 1057, §9</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec728.15"><xhtml:div class="heading"><xhtml:span class="identifier">728.15</xhtml:span><xhtml:span class="headnote">Telephone dissemination of obscene material to minors.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this section</xhtml:span>, <xhtml:span class="i">“person”</xhtml:span> excludes any information-access service provider that merely provides transmission capacity without control over the content of the transmission.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A person shall not knowingly disseminate obscene material by the use of telephones or telephone facilities to a minor or a law enforcement officer or agent posing as a minor.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">It shall be a defense in any prosecution for a violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> by a person accused of knowingly disseminating obscene material by the use of telephones or telephone facilities to a minor that the person accused has taken either of the following measures to restrict access to the obscene material:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The person accused has done all of the following:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Required the person receiving the obscene material to use an authorized access or identification code, as provided by the information provider, before transmission of the obscene material begins.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Previously issued the code by mailing it to the applicant after taking reasonable measures to ascertain that the applicant was eighteen years of age or older.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Established a procedure to immediately cancel the code of any person after receiving notice, in writing or by telephone, that the code has been lost, stolen, or used by persons under the age of eighteen years or that the code is no longer desired.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The person accused has required payment by credit card before transmission of the obscene material.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Any list of applicants or recipients compiled or maintained by an information-access service provider for purposes of compliance with <xhtml:span class="iowaCodeRef">subsection 2</xhtml:span> is confidential and shall not be sold or otherwise disseminated except upon order of the court.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> is an aggravated misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> by a person who has been previously convicted of a violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> is a class “D” felony.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">89 Acts, ch 263, §5</xhtml:span>;
