provided, that to constitute kidnapping the act must be accompanied by one or more of the following:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The intent to hold such person for ransom.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The intent to use such person as a shield or hostage.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The intent to inflict serious injury upon such person, or to subject the person to a sexual abuse.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The intent to secretly confine such person.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The intent to interfere with the performance of any government function.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C51, §2588; R60, §4211; C73, §3869; C97, §4765; S13, §4750-b; C24, 27, 31, 35, 39, §<xhtml:span class="b">12981, 12983;</xhtml:span> C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, §706.1, 706.3; C79, <xhtml:span class="iowaCodeRef">81, §710.1</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec710.2"><xhtml:div class="heading"><xhtml:span class="identifier">710.2</xhtml:span><xhtml:span class="headnote">Kidnapping in the first degree.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Kidnapping is kidnapping in the first degree when the person kidnapped, as a consequence of the kidnapping, suffers serious injury, or is intentionally subjected to torture or sexual abuse.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Kidnapping in the first degree is a class “A” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of determining whether the person should register as a sex offender pursuant to the provisions of <xhtml:span class="iowaCodeRef">chapter 692A</xhtml:span>, the fact finder shall make a determination as provided in <xhtml:span class="iowaCodeRef">section 692A.126</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C51, §2588; A person is confined when the person’s freedom to move about is substantially restricted by force, threat, or deception. False imprisonment is a serious misdemeanor.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C79, <xhtml:span class="iowaCodeRef">81, §710.7</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec710.8"><xhtml:div class="heading"><xhtml:span class="identifier">710.8</xhtml:span><xhtml:span class="headnote">Harboring a runaway child prohibited — penalty.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this section</xhtml:span> and <xhtml:span class="iowaCodeRef">section 710.9</xhtml:span> unless the context otherwise requires:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Criminal act”</xhtml:span> means the violation of any federal or state law.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Harbor”</xhtml:span> means to provide aid, support, or shelter.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Runaway child”</xhtml:span> means a person under eighteen years of age who is voluntarily absent from the person’s home without the consent of the person’s parent, guardian, or custodian.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person shall not harbor a runaway child with the intent of committing a criminal act involving the child or with the intent of enticing or forcing the runaway child to commit a criminal act.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A person shall not harbor a runaway child with the intent of allowing the runaway child to remain away from home against the wishes of the child’s parent, guardian, or custodian. However, the provisions of <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> do not apply to a shelter care home which is licensed or approved by the department of health and human services.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">A person convicted of a violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> is guilty of an aggravated misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">85 Acts, ch 183, §1</xhtml:span>; <xhtml:span class="iowaActsRef">96 Acts, ch 1219, §75</xhtml:span><xhtml:span class="iowaActsRef">2023 Acts, ch 19, §1303</xhtml:span></xhtml:p></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec710.9"><xhtml:div class="heading"><xhtml:span class="identifier">710.9</xhtml:span><xhtml:span class="headnote">Civil liability for harboring a runaway child.</xhtml:span></xhtml:div><xhtml:p class="para">A parent, guardian, or custodian of a runaway child has a right of action against a person who harbored the runaway child in violation of <xhtml:span class="iowaCodeRef">section 710.8</xhtml:span> for expenses sustained in the search for the child, for damages sustained due to physical or emotional distress due to the absence of the child, and for punitive damages.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">85 Acts, ch 183, §2</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec710.10"><xhtml:div class="heading"><xhtml:span class="identifier">710.10</xhtml:span><xhtml:span class="headnote">Enticing a minor.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A person commits a class “C” felony when, without authority and with the intent to commit sexual abuse or sexual exploitation upon a minor under the age of thirteen, the person entices or attempts to entice a person reasonably believed to be under the age of thirteen including a law enforcement officer or agent posing as a minor under the age of thirteen.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person commits a class “D” felony when, without authority and with the intent to commit an illegal sex act upon or sexual exploitation of a minor under the age of sixteen, the person entices or attempts to entice a person reasonably believed to be under the age of sixteen including a law enforcement officer or agent posing as a minor under the age of sixteen.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A person commits a class “D” felony when, without authority and with the intent to commit an illegal act upon a minor under the age of sixteen, the person entices a person reasonably believed to be under the age of sixteen including a law enforcement officer or agent posing as a minor under the age of sixteen.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">A person commits an aggravated misdemeanor when, without authority and with the intent to commit an illegal act upon a minor under the age of sixteen, the person attempts to entice a person reasonably believed to be under the age of sixteen including a law enforcement officer or agent posing as a minor under the age of sixteen. A person convicted under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall not be subject to the registration requirements under <xhtml:span class="iowaCodeRef">chapter 692A</xhtml:span> unless the finder of fact determines that the illegal act was sexually motivated.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">A person shall not be convicted of a violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> unless the person commits an overt act evidencing a purpose to entice.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of determining jurisdiction under <xhtml:span class="iowaCodeRef">section 803.1</xhtml:span>, an offense is considered committed in this state if the communication to entice or attempt to entice a person believed to be a minor who is present in this state originates from another state, or the communication to entice or attempt to entice a person believed to be a minor is sent from this state.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, methods of enticement include but are not limited to personal contact and communication by any means including through the mail, telephone, internet, or any social media, and include text messages, instant messages, and electronic mail.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">85 Acts, ch 183, §3</xhtml:span>; <xhtml:span class="iowaActsRef">86 Acts, ch 1238, §29</xhtml:span>; <xhtml:span class="iowaActsRef">96 Acts, ch 1082, §2</xhtml:span>; <xhtml:span class="iowaActsRef">2001 Acts, ch 17, §3</xhtml:span>; <xhtml:span class="iowaActsRef">2010 Acts, ch 1129, §1</xhtml:span>; <xhtml:span class="iowaActsRef">2014 Acts, ch 1097, §5</xhtml:span>; <xhtml:span class="iowaActsRef">2023 Acts, ch 74, §1</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec710.11"><xhtml:div class="heading"><xhtml:span class="identifier">710.11</xhtml:span><xhtml:span class="headnote">Purchase or sale of individual.</xhtml:span></xhtml:div><xhtml:p class="para">A person commits a class “C” felony when the person purchases or sells or attempts to purchase or sell an individual to another person. <xhtml:span class="iowaCodeRef">This section</xhtml:span> does not apply to a surrogate mother arrangement.
