class="heading"><xhtml:span class="identifier">708</xhtml:span><xhtml:span class="headnote">ASSAULT</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec708.1"><xhtml:div class="heading"><xhtml:span class="identifier">708.1</xhtml:span><xhtml:span class="headnote">Assault defined.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">An assault as defined in <xhtml:span class="iowaCodeRef">this section</xhtml:span> is a general intent crime.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person commits an assault when, without justification, the person does any of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Any act which is intended to cause pain or injury to, or which is intended to result in physical contact which will be insulting or offensive to another, coupled with the apparent ability to execute the act.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Any act which is intended to place another in fear of immediate physical contact which will be painful, injurious, insulting, or offensive, coupled with the apparent ability to execute the act.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Intentionally points any firearm toward another, or displays in a threatening manner any dangerous weapon toward another.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:div class="subparaDiv"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Intentionally points a laser emitting a visible light beam toward another person with the intent to cause pain or injury to another, or toward an aircraft. </xhtml:p></xhtml:div><xhtml:div class="subparaDiv"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of this paragraph <xhtml:span class="i">“d”</xhtml:span>:</xhtml:p><xhtml:span class="subparaSubdiv"><xhtml:div class="heading"><xhtml:span class="identifier">i</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Aircraft”</xhtml:span> means any contrivance intended for and capable of transporting persons through the airspace.</xhtml:p></xhtml:span><xhtml:span class="subparaSubdiv"><xhtml:div class="heading"><xhtml:span class="identifier">ii</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Laser”</xhtml:span> means a device that emits a visible light beam amplified by the stimulated emission of radiation and any light which simulates the appearance of a laser.</xhtml:p></xhtml:span></xhtml:div></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">This paragraph does not apply to any of the following:</xhtml:p><xhtml:div class="subparaDiv"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A law enforcement officer who uses a laser in discharging or attempting to discharge the officer’s official duties.</xhtml:p></xhtml:div><xhtml:div class="subparaDiv"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A health care professional who uses a laser in providing services within the scope of practice of that professional or any other person who is licensed or authorized by law to use a laser or who uses a laser in the performance of the person’s official duties.</xhtml:p></xhtml:div><xhtml:div class="subparaDiv"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A person who uses a laser to play laser tag, paintball, and other similar games using light-emitting diode technology.</xhtml:p></xhtml:div></xhtml:div></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"> An act described in <xhtml:span class="iowaCodeRef">subsection 2</xhtml:span> shall not be an assault under the following circumstances:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">If the person doing any of the enumerated acts, and such other person, are voluntary participants in a sport, social or other activity, not in itself criminal, and such act is a reasonably foreseeable incident of such sport or activity, and does not create an unreasonable risk of serious injury or breach of the peace.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"> If the person doing any of the enumerated acts is employed by a school district or accredited nonpublic school, or is an area education agency staff member who provides services to a school or school district, and intervenes in a fight or physical struggle, or other disruptive situation, that takes place in the presence of the employee or staff member performing employment duties in a school building, on school grounds, or at an official school function regardless of the location, whether the fight or physical struggle or other disruptive situation is between students or other individuals, if the degree and the force of the intervention is reasonably necessary to restore order and to protect the safety of those class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, with the intent to inflict a serious injury upon another, is guilty of an aggravated misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, and who causes bodily injury or mental illness, is guilty of a serious misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, and uses or displays a dangerous weapon in connection with the assault, is guilty of an aggravated misdemeanor. <xhtml:span class="iowaCodeRef">This subsection</xhtml:span> does not apply if <xhtml:span class="iowaCodeRef">section 708.6</xhtml:span> or <xhtml:span class="iowaCodeRef">708.8</xhtml:span> applies.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits a violation of <xhtml:span class="iowaCodeRef">subsection 3</xhtml:span> against another person who the person knows or reasonably should know is a pregnant person is guilty of a class “D” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, without the intent to inflict serious injury, but who causes serious injury, is guilty of a class “D” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, and who uses any object to penetrate the genitalia or anus of another person, is guilty of a class “C” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">Any other assault, except as otherwise provided, is a simple misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">For the purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, <xhtml:span class="term">“domestic abuse assault”</xhtml:span> means an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, which is domestic abuse as defined in <xhtml:span class="iowaCodeRef">section 236.2, subsection 2</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>, <xhtml:span class="i">“b”</xhtml:span>, <xhtml:span class="i">“c”</xhtml:span>, or <xhtml:span class="i">“d”</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">On a first offense of domestic abuse assault, the person commits:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A simple misdemeanor for a domestic abuse assault, except as otherwise provided.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A serious misdemeanor, if the domestic abuse assault causes bodily injury or mental illness.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">An aggravated misdemeanor, if the domestic abuse assault is committed with the intent to inflict a serious injury upon another, or if the person uses or displays a dangerous weapon in connection with the assault. This paragraph does not apply if <xhtml:span class="iowaCodeRef">section 708.6</xhtml:span> or <xhtml:span class="iowaCodeRef">708.8</xhtml:span> applies.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">An aggravated misdemeanor, if the domestic abuse assault is committed by knowingly impeding the normal breathing or circulation of the blood of another by applying pressure to the throat or neck of the other person or by obstructing the nose or mouth of the other person.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">A class “D” felony, if the domestic abuse assault is committed against a person who is known to be, or reasonably should be known to be, pregnant, and that is a violation of paragraph <xhtml:span class="i">“c”</xhtml:span> or <xhtml:span class="i">“d”</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Except as otherwise provided in <xhtml:span class="iowaCodeRef">subsection 2</xhtml:span>, on a second domestic abuse assault, a person commits:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A serious misdemeanor, if the first offense was classified as a simple misdemeanor, and the second offense would otherwise be classified as a simple misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">An aggravated misdemeanor, if the first offense was classified as a simple or aggravated misdemeanor, and the second offense would otherwise be classified as a serious misdemeanor, or the first offense was classified as a serious or aggravated misdemeanor, and the second offense would otherwise be classified as a simple or serious misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A class “D” felony if the first offense was classified as a class “D” felony, and the second offense would otherwise be classified as an aggravated misdemeanor.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">On a third or subsequent offense of domestic abuse assault, a person commits a class “D” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">For a domestic abuse assault committed by knowingly impeding the normal breathing or circulation of the blood of another by applying pressure to the throat or neck of the other person or by obstructing the nose or mouth of the other person, and causing bodily injury, the person commits a class “D” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">For the purpose of determining if a violation charged is a second or subsequent offense, deferred judgments issued pursuant to <xhtml:span class="iowaCodeRef">section 907.3</xhtml:span> for violations of <xhtml:span class="iowaCodeRef">section 708.2</xhtml:span> or <xhtml:span class="iowaCodeRef">this section</xhtml:span>, which were issued on domestic abuse assaults, and convictions or the equivalent of deferred judgments for violations in any other states under statutes substantially corresponding to <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall be counted as previous offenses. The courts shall judicially notice the statutes of other states which define offenses substantially equivalent to the offenses defined in <xhtml:span class="iowaCodeRef">this section</xhtml:span> and can therefore be considered corresponding statutes. Each previous violation on which conviction or deferral of judgment was entered prior to the date of the offense charged shall be considered and counted as a separate previous offense.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">An offense shall be considered a prior offense regardless of whether it was committed upon the same victim.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A person convicted of violating <xhtml:span class="iowaCodeRef">subsection 2 or 3</xhtml:span> shall serve a minimum term of two days of the sentence imposed by law, and shall not be eligible for suspension of the minimum sentence. The minimum term shall be served on consecutive days. The court shall not impose a fine in lieu of the minimum sentence, although a fine may be imposed in addition to the minimum sentence. <xhtml:span class="iowaCodeRef">This section</xhtml:span> does not prohibit the court from sentencing and the person from serving the maximum term of confinement or from paying the maximum fine permitted pursuant to <xhtml:span class="iowaCodeRef">chapters 902</xhtml:span> and <xhtml:span class="iowaCodeRef">903</xhtml:span>, and does not prohibit the court from entering a deferred judgment or sentence pursuant to <xhtml:span class="iowaCodeRef">section 907.3</xhtml:span>, if the person has not previously received a deferred sentence or judgment for a violation of <xhtml:span class="iowaCodeRef">section 708.2</xhtml:span> or <xhtml:span class="iowaCodeRef">this section</xhtml:span> which was issued on a domestic abuse assault.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A person convicted of a violation referred to in <xhtml:span class="iowaCodeRef">subsection 4</xhtml:span> shall be sentenced as provided under <xhtml:span class="iowaCodeRef">section 902.13</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para">If a person is convicted for, receives a deferred judgment for, or pleads guilty to a violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, the court shall modify the no-contact order issued upon initial appearance in the manner provided in <xhtml:span class="iowaCodeRef">section 664A.5</xhtml:span>, regardless of whether the person is placed on probation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">9</xhtml:span></xhtml:div><xhtml:p class="para">The clerk of the district court shall provide notice and copies of a judgment entered under <xhtml:span class="iowaCodeRef">this section</xhtml:span> to the applicable law enforcement agencies and the twenty-four hour dispatcher for the law enforcement agencies, in the manner provided for protective orders under <xhtml:span class="iowaCodeRef">section 236.5</xhtml:span>. The clerk shall provide notice and copies of modifications of the judgment in the same manner.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">10</xhtml:span></xhtml:div><xhtml:p class="para">In addition to the mandatory minimum term of confinement imposed by <xhtml:span class="iowaCodeRef">subsection 7</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>, the court shall order a person convicted under <xhtml:span class="iowaCodeRef">subsection 2 or 3</xhtml:span> to participate in a batterers’ treatment program as required under <xhtml:span class="iowaCodeRef">section 708.2B</xhtml:span>. In addition, as a condition of deferring judgment or sentence pursuant to <xhtml:span class="iowaCodeRef">section 907.3</xhtml:span>, the court shall order the person to participate in a batterers’ treatment program. In addition, a person convicted of, or receiving a deferred judgment for, an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, which is domestic abuse, as defined in <xhtml:span class="iowaCodeRef">section 236.2, subsection 2</xhtml:span>, paragraph <xhtml:span class="i">“e”</xhtml:span>, may be ordered by the court to participate in a batterers’ treatment program. Participation in the batterers’ treatment program shall not require a person to be placed on probation, but a person on probation may participate in the program.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The district departments may contract for services in completing the duties relating to the batterers’ treatment programs. The district departments shall assess the fees for participation in the program, and shall either collect or contract for the collection of the fees to recoup the costs of treatment, but may waive the fee or collect a lesser amount upon a showing of cause. The fees shall be used by each of the district departments or contract service providers for the establishment, administration, coordination, and provision of direct services of the batterers’ treatment programs.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">District departments or contract service providers shall receive upon request peace officers’ investigative reports regarding persons participating in programs under <xhtml:span class="iowaCodeRef">this section</xhtml:span>. The receipt of reports under <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall not waive the confidentiality of the reports under <xhtml:span class="iowaCodeRef">section 22.7</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">91 Acts, ch 218, §28</xhtml:span>; <xhtml:span class="iowaActsRef">95 Acts, ch 90, §2</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec708.2D"><xhtml:div class="heading"><xhtml:span class="identifier">708.2D</xhtml:span><xhtml:span class="headnote">Older individual assault <xhtml:span class="em-dash"/> mandatory minimums, penalties enhanced <xhtml:span class="em-dash"/> extension of no-contact order.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">For the purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Older individual”</xhtml:span> means an individual who is sixty years of age or older. </xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Older individual assault”</xhtml:span> means an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, of an older individual.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">On a first offense of older individual assault, the person commits:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A simple misdemeanor, except as otherwise provided.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A serious misdemeanor, if the older individual assault causes bodily injury or mental illness.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">An aggravated misdemeanor, if the older individual assault is committed with the intent to inflict a serious injury upon an older individual, or if the person uses or displays a dangerous weapon in connection with the assault. This paragraph does not apply if <xhtml:span class="iowaCodeRef">section 708.6</xhtml:span> or <xhtml:span class="iowaCodeRef">708.8</xhtml:span> applies.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">An aggravated misdemeanor, if the older individual assault is committed by knowingly impeding the normal breathing or circulation of the blood of an older individual by applying pressure to the throat or neck of the older individual or by obstructing the nose or mouth of the older individual.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Except as otherwise provided in <xhtml:span class="iowaCodeRef">subsection 2</xhtml:span>, on a second offense of older individual assault, a person commits:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A serious misdemeanor if the first offense was classified as a simple misdemeanor and the second offense would otherwise be classified as a simple misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">An aggravated misdemeanor if the first offense was classified as a simple or aggravated misdemeanor and the second offense would otherwise be classified as a serious misdemeanor, or the first offense was classified as a serious or aggravated misdemeanor, and the second offense would otherwise be classified as a simple or serious misdemeanor.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">On a third or subsequent offense of older individual assault, a person commits a class “D” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">For an older individual assault committed by knowingly impeding the normal breathing or circulation of the blood of an older individual by applying pressure to the throat or neck of the older individual or by obstructing the nose or mouth of the older individual, and causing bodily injury, the person commits a class “D” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A conviction for, deferred judgment for, or plea of guilty to, a violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> which occurred more than twelve years prior to the date of the violation charged shall not be considered in determining that the violation charged is a second or subsequent offense.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">For the purpose of determining if a violation charged is a second or subsequent offense, deferred judgments issued pursuant to <xhtml:span class="iowaCodeRef">section 907.3</xhtml:span> for violations of <xhtml:span class="iowaCodeRef">section 708.2</xhtml:span> or <xhtml:span class="iowaCodeRef">708.2A</xhtml:span>, or <xhtml:span class="iowaCodeRef">this section</xhtml:span>, which were issued on older individual assaults, and convictions or the equivalent of deferred judgments for violations in any other states under statutes substantially corresponding to <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall be counted as previous offenses. The courts shall judicially notice the statutes of other states which define offenses substantially equivalent to the offenses defined in <xhtml:span class="iowaCodeRef">this section</xhtml:span> and can therefore be considered corresponding statutes. Each previous violation on which conviction or deferral of judgment was entered prior to the date of the offense charged shall be considered and counted as a separate previous offense.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">An offense shall be considered a prior offense regardless of whether it was committed upon the same victim.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A person convicted of violating <xhtml:span class="iowaCodeRef">subsection 2 or 3</xhtml:span> shall serve a minimum term of two days of the sentence imposed by law, and shall not be eligible for suspension of the minimum sentence. The minimum term shall be served on consecutive days. The court shall not impose a fine in lieu of the minimum sentence, although a fine may be imposed in addition to the minimum sentence. <xhtml:span class="iowaCodeRef">This section</xhtml:span> does not prohibit the court from sentencing and the person from serving the maximum term of confinement or from paying the maximum fine permitted pursuant to <xhtml:span class="iowaCodeRef">chapters 902</xhtml:span> and <xhtml:span class="iowaCodeRef">903</xhtml:span>, and does not prohibit the court from entering a deferred judgment or sentence pursuant to <xhtml:span class="iowaCodeRef">section 907.3</xhtml:span>, if the person has not previously received a deferred sentence or judgment for a violation of <xhtml:span class="iowaCodeRef">section 708.2</xhtml:span> or <xhtml:span class="iowaCodeRef">708.2A</xhtml:span>, or <xhtml:span class="iowaCodeRef">this section</xhtml:span>, which was issued on an older individual assault.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A person convicted of violating <xhtml:span class="iowaCodeRef">subsection 4</xhtml:span> shall be sentenced as provided under <xhtml:span class="iowaCodeRef">section 902.9, subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“e”</xhtml:span>, and shall be denied parole or work release until the person has served a minimum of one year of the person’s sentence. Notwithstanding <xhtml:span class="iowaCodeRef">section 901.5, subsections 1, 3, and 5</xhtml:span>, and <xhtml:span class="iowaCodeRef">section 907.3</xhtml:span>, the person cannot receive a suspended or deferred sentence or a deferred judgment; however, the person sentenced shall receive credit for any time the person was confined in a jail or detention facility following arrest.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para">If a person is convicted for, receives a deferred judgment for, or pleads guilty to a violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, the court shall modify the no-contact order issued upon initial appearance in the manner provided in <xhtml:span class="iowaCodeRef">section 664A.5</xhtml:span>, regardless of whether the person is placed on probation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">9</xhtml:span></xhtml:div><xhtml:p class="para">The clerk of the district court shall provide notice and copies of a judgment entered under <xhtml:span class="iowaCodeRef">this section</xhtml:span> to the applicable law enforcement agencies and the twenty-four-hour dispatcher for the law enforcement agencies, in the manner provided for protective orders under <xhtml:span class="iowaCodeRef">chapter 235F</xhtml:span>.  The clerk shall provide notice and copies of modifications of the judgment in the same manner.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Assault”</xhtml:span> means any offense defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span> or <xhtml:span class="iowaCodeRef">708.2A</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Protective order”</xhtml:span> means a protective order issued by a court of this state and in effect pursuant to <xhtml:span class="iowaCodeRef">chapter 236</xhtml:span> or <xhtml:span class="iowaCodeRef">chapter 664A</xhtml:span>, or a protective order issued by a court of another state under conditions substantially similar to those provided in <xhtml:span class="iowaCodeRef">chapter 236</xhtml:span> or <xhtml:span class="iowaCodeRef">chapter 664A</xhtml:span> if the order would have been issued in this state.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person against whom a protective order has been issued who commits an assault against a person protected by the same protective order, if the protective order is in effect at the time of the assault, is guilty of a class “D” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">An offense charged under <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall constitute a separate and distinct violation from any other offense charged under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or <xhtml:span class="iowaCodeRef">chapter 664A</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2024 committed is a peace officer, jailer, correctional or juvenile detention staff, member or employee of the board of parole, health care provider, employee of the department of health and human services, employee of the department of inspections, appeals, and licensing who conducts investigations or inspections, employee of the department of revenue, national guard member engaged in national guard duty or state active duty, civilian employee of a law enforcement agency, civilian employee of a fire department, or fire fighter and with the intent to inflict a serious injury upon the peace officer, jailer, correctional or juvenile detention staff, member or employee of the board of parole, health care provider, employee of the department of health and human services, employee of the department of inspections, appeals, and licensing who conducts investigations or inspections, employee of the department of revenue, national guard member engaged in national guard duty or state active duty, civilian employee of a law enforcement agency, civilian employee of a fire department, or fire fighter, is guilty of a class “C” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, against a peace officer, jailer, correctional or juvenile detention staff, member or employee of the board of parole, health care provider, employee of the department of health and human services, employee of the department of inspections, appeals, and licensing who conducts investigations or inspections, employee of the department of revenue, national guard member engaged in national guard duty or state active duty, civilian employee of a law enforcement agency, civilian employee of a fire department, or fire fighter, whether paid or volunteer, who knows that the person against whom the assault is committed is a peace officer, jailer, correctional or juvenile detention staff, member or employee of the board of parole, health care provider, employee of the department of health and human services, employee of the department of inspections, appeals, and licensing who conducts investigations or inspections, employee of the department of revenue, national guard member engaged in national guard duty or state active duty, civilian employee of a law enforcement agency, civilian employee of a fire department, or fire fighter and who uses or displays a dangerous weapon in connection with the assault, is guilty of a class “C” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits an assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, against a peace officer, jailer, correctional or juvenile detention staff, member or employee of the board of parole, health care provider, employee of the department of health and human services, employee of the department of inspections, appeals, and licensing who conducts investigations or inspections, employee of the department of revenue, national guard member engaged in national guard duty or state active duty, civilian employee of a law enforcement agency, civilian employee of a fire department, or fire fighter, whether paid or volunteer, who knows that the person against whom the assault is committed is a peace officer, jailer, correctional or juvenile detention staff, member or employee of the board of parole, health care provider, employee of the department of health and human services, employee of the department of inspections, appeals, and licensing who conducts investigations or inspections, employee of the department of revenue, national guard member engaged in national guard duty or state active duty, civilian employee of a law enforcement agency, civilian employee of a fire department, or fire fighter, and who causes bodily injury or mental illness, is guilty of a class “D” felony.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Any other assault, as defined in <xhtml:span class="iowaCodeRef">section 708.1</xhtml:span>, including an assault causing another to come into contact with saliva by throwing, tossing, spitting, or expelling the fluid, committed against a peace officer, jailer, correctional or juvenile detention staff, member or employee of the board of parole, health care provider, employee of the department of health and human services, employee of the department of inspections, appeals, and licensing who conducts investigations or inspections, employee of the department of revenue, national guard member engaged in national guard duty or state active duty, civilian employee of a law enforcement agency, civilian employee of a fire department, or fire fighter, whether paid or volunteer, by a person who knows that the person against whom the assault is committed is a peace officer, jailer, correctional or juvenile detention staff, member or employee of the board of parole, health care provider, employee of the department of health and human services, employee of the department of inspections, appeals, and licensing who conducts investigations or inspections, employee of the department of revenue, national guard member engaged in national guard duty or state active duty, civilian employee of a law enforcement agency, civilian employee of a fire department, or fire fighter, is an aggravated misdemeanor. A person convicted of violating <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall serve a minimum term of seven days of the sentence imposed by law, and shall not be eligible for suspension of the minimum sentence.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this section</xhtml:span>, the following definitions apply:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Correctional staff”</xhtml:span> means a person who is not a peace officer but who is employed by the department of corrections or a judicial district department of correctional services to work at or in a correctional institution, community-based correctional facility, or an institution under the management of the Iowa department of corrections which is used for the purposes of confinement of persons who have committed public offenses.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Employee of the department of health and human services”</xhtml:span> means a person who is an employee of an institution controlled by the director of health and human services that is listed in <xhtml:span class="iowaCodeRef">section 218.1</xhtml:span>, or who is an employee of the civil commitment unit for sex offenders operated by the department of health and human services. A person who commits an assault under <xhtml:span class="iowaCodeRef">this section</xhtml:span> against an employee of the department of health and human services at a department of health and human services institution or unit is presumed to know that the person against whom the assault is committed is an employee of the department of health and human services.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Employee of the department of revenue”</xhtml:span> means a person who is employed as an auditor, agent, tax collector, or any contractor or representative acting in the same capacity. The employee, contractor, or representative shall maintain current identification indicating that the person is an employee, contractor, or representative of the department.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Health care provider”</xhtml:span> means an emergency medical care provider as defined in <xhtml:span class="iowaCodeRef">chapter 147A</xhtml:span> or a person licensed or registered under <xhtml:span class="iowaCodeRef">chapter 148</xhtml:span>, <xhtml:span class="iowaCodeRef">148C</xhtml:span>, <xhtml:span class="iowaCodeRef">148D</xhtml:span>, or <xhtml:span class="iowaCodeRef">152</xhtml:span> who is providing or who is attempting to provide emergency medical services, as defined in <xhtml:span class="iowaCodeRef">section 147A.1</xhtml:span>, or anyone who is working, volunteering, or participating in an educational course of instruction at a hospital or rural emergency hospital as defined in <xhtml:span class="iowaCodeRef">chapter 135B</xhtml:span>, or at a nursing facility as defined in <xhtml:span class="iowaCodeRef">chapter 135C</xhtml:span>.  A person who commits an assault under <xhtml:span class="iowaCodeRef">this section</xhtml:span> against a health care provider in a hospital, or at the scene or during out-of-hospital patient transportation in an ambulance, is presumed to know that the person against whom the assault is committed is a health care provider.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Jailer”</xhtml:span> means a person who is employed by a county or other political subdivision of the state to work at a county jail or other facility used for purposes of the confinement of persons who have committed public offenses, but who is not a peace officer.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“National guard”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 29A.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">g</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“National guard duty”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 29A.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">h</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“State active duty”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 29A.1</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">95 Acts, ch 90, §3</xhtml:span>; <xhtml:span class="iowaActsRef">2002 Acts, ch 1075, §8</xhtml:span>; <xhtml:span class="iowaActsRef">2018 Acts, ch 1041, §127</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec708.7"><xhtml:div class="heading"><xhtml:span class="identifier">708.7</xhtml:span><xhtml:span class="headnote">Harassment.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A person commits harassment when, with intent to intimidate, annoy, or alarm another person, the person does any of the following:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Communicates with another by telephone, telegraph, writing, or via electronic communication without legitimate purpose and in a manner likely to cause the other person annoyance or harm.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Places a simulated explosive or simulated incendiary device in or near a building, vehicle, airplane, railroad engine or railroad car, or boat occupied by another person.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Orders merchandise or services in the name of another, or to be delivered to another, without the other person’s knowledge or consent.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Reports or causes to be reported false information to a law enforcement authority implicating another in some criminal activity, knowing that the information is false, or reports the alleged occurrence of a criminal act, knowing the act did not occur.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Disseminates, publishes, distributes, posts, or causes to be disseminated, published, distributed, or posted a visual depiction as defined in <xhtml:span class="iowaCodeRef">section 728.1</xhtml:span> showing another person in a state of full or partial nudity or engaged in a sex act, to which the other person has not consented to the dissemination, publication, distribution, or posting. Notwithstanding <xhtml:span class="iowaCodeRef">subsection 5</xhtml:span>, a person eighteen years of age or older who commits a violation of this subparagraph shall be required to register as a sex offender pursuant to the provisions of <xhtml:span class="iowaCodeRef">chapter 692A</xhtml:span>. For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, <xhtml:span class="term">“another person”</xhtml:span> includes an individual, recognizable by the person’s face, likeness, or other distinguishing features, whose image is used to create, adapt, or modify a visual depiction to depict that other person in a manner as described in this subparagraph.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A person commits harassment when the person, purposefully and without legitimate purpose, has personal contact with another person, with the intent to threaten, intimidate, or alarm that other person. </xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A person commits harassment in the first degree when the person commits harassment involving any of the following: </xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A threat to commit a forcible felony. </xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>, subparagraph (5).</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Commits harassment and has previously been convicted of harassment three or more times under <xhtml:span class="iowaCodeRef">this section</xhtml:span> or any similar statute during the preceding ten years.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Harassment that occurs against another person who is lawfully in a place of public accommodation as defined in <xhtml:span class="iowaCodeRef">section 216.2</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Harassment in the first degree is an aggravated misdemeanor.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A person commits harassment in the second degree when the person commits harassment involving a threat to commit bodily injury, or commits harassment and has previously been convicted of harassment two times under <xhtml:span class="iowaCodeRef">this section</xhtml:span> or any similar statute during the preceding ten years.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Harassment in the second degree is a serious misdemeanor.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Any other act of harassment is harassment in the third degree.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Harassment in the third degree is a simple misdemeanor.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of determining whether or not the person should register as a sex offender pursuant to the provisions of <xhtml:span class="iowaCodeRef">chapter 692A</xhtml:span>, the fact finder shall make a determination as provided in <xhtml:span class="iowaCodeRef">section 692A.126</xhtml:span>. However, the fact finder shall not make a determination as provided in <xhtml:span class="iowaCodeRef">section 692A.126</xhtml:span> regarding a juvenile convicted of a violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>, subparagraph (5), and the juvenile shall not be required to register as a sex offender with regard to the violation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">The following do not constitute harassment under <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>, subparagraph (5):</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A photograph or film involving voluntary exposure by a person in public or commercial settings.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Disclosures made in the public interest, including but not limited to the reporting of unlawful conduct, disclosures by law enforcement, news reporting, legal proceeding disclosures, or medical treatment disclosures.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Disclosures by an interactive computer service of information provided by another information content provider, as those terms are defined in <xhtml:span class="USCRef">47 U.S.C. §230</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">A person injured by a violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>, subparagraph (4), may bring a civil action against the person whose conduct violated <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>, subparagraph (4).</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this section</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Full or partial nudity”</xhtml:span> means the showing of any part of the human genitals or pubic area or buttocks, or any part of the nipple of the breast of a female, with less than fully opaque covering.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Personal contact”</xhtml:span> means an encounter in which two or more people are in visual or physical proximity to each other. <xhtml:span class="term">“Personal contact”</xhtml:span> does not require a physical touching or oral communication, although it may include these types of contacts.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Photographs or films”</xhtml:span> means the making of any photograph, motion picture film, videotape, or any other recording or transmission of the image of a person.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Sex act”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 702.17</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C71, 73, 75, 77, §714.37, 714.42; Prohibited acts include, but are not limited to, any brutality of a physical nature such as whipping, forced confinement, or any other forced activity which endangers the physical health or safety of the student.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, <xhtml:span class="term">“forced activity”</xhtml:span> means any activity which is a condition of initiation or admission into, or affiliation with, an organization, regardless of a student’s willingness to participate in the activity.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits an act of hazing is guilty of a simple misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits an act of hazing which causes serious bodily injury to another is guilty of a serious misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">89 Acts, ch 41, §1</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec708.11"><xhtml:div class="heading"><xhtml:span class="identifier">708.11</xhtml:span><xhtml:span class="headnote">Stalking.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this section</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Accompanying offense”</xhtml:span> means any public offense committed as part of the course of conduct engaged in while committing the offense of stalking.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Course of conduct”</xhtml:span> means repeatedly maintaining a visual or physical proximity to a person without legitimate purpose, repeatedly utilizing a technological device to locate, listen to, or watch a person without authorization or legitimate purpose, or repeatedly conveying oral or written threats, threats implied by conduct, or a combination thereof, directed at or toward a person.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Immediate family member”</xhtml:span> means a spouse, parent, child, sibling, or any other person who regularly resides in the household of a specific person, or who within the prior six months regularly resided in the household of a specific person.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Repeatedly”</xhtml:span> means on two or more occasions.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Technological device”</xhtml:span> means any computer, cellular phone, smartphone, digital camera, video camera, audio recording device, global positioning device, or other electronic device that can be used for creating, storing, or transmitting information in the form of electronic data.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person commits stalking when all of the following occur:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The person purposefully engages in a course of conduct directed at a specific person that would cause a reasonable person to feel terrorized, frightened, intimidated, or threatened or to fear that the person intends to cause bodily injury to, or the death of, that specific person or a member of the specific person’s immediate family.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The person has knowledge or should have knowledge that a reasonable person would feel terrorized, frightened, intimidated, or threatened or fear that the person intends to cause bodily injury to, or the death of, that specific person or a member of the specific person’s immediate family by the course of conduct.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits stalking in violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> commits a class “C” felony if any of the following apply:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The person commits stalking while subject to restrictions contained in a criminal or civil protective order or injunction, or any other court order which prohibits contact between the person and the victim, or while subject to restrictions contained in a criminal or civil protective order or injunction, or any other court order which prohibits contact between the person and another person against whom the person has committed a public offense.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The person commits stalking while in possession of a dangerous weapon, as defined in <xhtml:span class="iowaCodeRef">section 702.7</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The person commits stalking by directing a course of conduct at a specific person who is under eighteen years of age.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The person utilizes a technological device while committing stalking.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">For a third or subsequent offense.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits stalking in violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> commits a class “D” felony if the offense is a second offense which is not included in paragraph <xhtml:span class="i">“a”</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits stalking in violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> commits an aggravated misdemeanor if the offense is a first offense which is not included in paragraph <xhtml:span class="i">“a”</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Violations of <xhtml:span class="iowaCodeRef">this section</xhtml:span> and accompanying offenses shall be considered prior offenses for the purpose of determining whether an offense is a second or subsequent offense. A conviction for, deferred judgment for, or plea of guilty to a violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> or an accompanying offense which occurred at any time prior to the date of the violation charged shall be considered in determining that the violation charged is a second or subsequent offense. Deferred judgments pursuant to <xhtml:span class="iowaCodeRef">section 907.3</xhtml:span> for violations of <xhtml:span class="iowaCodeRef">this section</xhtml:span> or accompanying offenses and convictions or the equivalent of deferred judgments for violations in any other states under statutes substantially corresponding to <xhtml:span class="iowaCodeRef">this section</xhtml:span> or accompanying offenses shall be counted as previous offenses. The courts shall judicially notice the statutes of other states which define offenses substantially equivalent to the offenses defined in <xhtml:span class="iowaCodeRef">this section</xhtml:span> and its accompanying offenses and can therefore be considered corresponding statutes. Each previous violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> or an accompanying offense on which conviction or deferral of judgment was entered prior to the date of the violation charged shall be considered and counted as a separate previous offense. In addition, however, accompanying offenses committed as part of the course of conduct engaged in while committing the violation of stalking charged shall be considered prior offenses for the purpose of that violation, even though the accompanying offenses occurred at approximately the same time. An offense shall be considered a second or subsequent offense regardless of whether it was committed upon the same person who was the victim of any other previous offense.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Notwithstanding <xhtml:span class="iowaCodeRef">section 804.1</xhtml:span>, <xhtml:span class="iowaCourtRulesRef">rule of criminal procedure 2.7</xhtml:span>, Iowa court rules, or any other provision of law to the contrary, upon the filing of a complaint and a finding of probable cause to believe an offense has been committed in violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, or after the filing of an indictment or information alleging a violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span>, the court shall issue an arrest warrant, rather than a citation or summons. A peace officer shall not issue a citation in lieu of arrest for a violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span>. Notwithstanding <xhtml:span class="iowaCodeRef">section 804.21</xhtml:span> or any other provision of law to the contrary, a person arrested for stalking shall be immediately taken into custody and shall not be released pursuant to pretrial release guidelines, a bond schedule, or any similar device, until after the initial appearance before a magistrate. In establishing the conditions of release, the magistrate may consider the defendant’s prior criminal history, in addition to the other factors provided in <xhtml:span class="iowaCodeRef">section 811.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of determining whether or not the person should register as a sex offender pursuant to the provisions of <xhtml:span class="iowaCodeRef">chapter 692A</xhtml:span>, the fact finder shall make a determination as provided in <xhtml:span class="iowaCodeRef">section 692A.126</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span the person, without the consent of the other person, places a global positioning device on the other person or an object in order to track the movements of the other person without a legitimate class="term">“officer”</xhtml:span> means peace officer as defined in <xhtml:span class="iowaCodeRef">section 724.2A</xhtml:span> or a correctional officer.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person who knowingly or intentionally removes or attempts to remove a communication device or any device used for control from the possession of an officer, when the officer is in the performance of any act which is within the scope of the lawful duty or authority of that officer and the person knew or should have known the individual to be an officer, commits the offense of removal of an officer’s communication or control device.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A person who removes or attempts to remove an officer’s communication or control device is guilty of a simple misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A person who knowingly or intentionally removes or attempts to remove a communication or control device from the possession of an officer with the intent to interfere with the communications or duties of the officer, is guilty of a serious misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">If a violation of paragraph <xhtml:span class="i">“a”</xhtml:span> results in bodily injury to the officer the person is guilty of a serious misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">If a violation of paragraph <xhtml:span class="i">“a”</xhtml:span> results in serious injury to the officer the person is guilty of an aggravated misdemeanor.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">If a violation of paragraph <xhtml:span class="i">“a”</xhtml:span> occurs and the person knowingly or intentionally causes bodily class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A person who knowingly or intentionally removes or attempts to remove a dangerous weapon, as defined in <xhtml:span class="iowaCodeRef">section 702.7</xhtml:span>, from the possession of a peace officer, as defined in <xhtml:span class="iowaCodeRef">section 724.2A</xhtml:span>, when the officer is in the performance of any act which is within the scope of the lawful duty or authority of that officer and the person knew or should have known the individual to be a peace officer, commits the offense of required to register as a sex offender pursuant to the provisions of <xhtml:span class="iowaCodeRef">chapter 692A</xhtml:span>, if the offense was committed against a minor and the fact finder makes a determination that the offense was sexually motivated pursuant to <xhtml:span class="iowaCodeRef">section 692A.126</xhtml:span>.</xhtml:p><xhtml:div class="history"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Except as otherwise provided in <xhtml:span class="iowaCodeRef">subsection 2</xhtml:span>, a person who knowingly circumcises, excises, or infibulates, in whole or in part, the labia majora, labia minora, or clitoris of a minor commits a class “D” felony. </xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A surgical procedure is not a violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> if the procedure is performed by a medical professional who holds a current license in this state necessary to perform the surgical procedure under any of the following circumstances:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">When necessary to protect the health of the minor on whom the procedure is performed.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">When performed on a minor who is in labor or who has just given birth and is performed for medical purposes connected with that labor or birth.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">In determining whether a surgical procedure performed pursuant to <xhtml:span class="iowaCodeRef">subsection 2</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>, is a violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>, consideration shall not be given to any belief the minor or any other person holds that the surgical procedure is required based on custom or ritual.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">A person who knowingly transports a minor within or outside of this state for the purpose of performing a procedure that would be a violation of <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> if the procedure occurred in this
