<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp692C" name="692C"><slim:About class="header"><slim:Property type="string" name="checkinTime">10/17/2019 12:54</slim:Property><slim:Property type="string" name="taskInfo">1035:04662E9B-92AF-4B05-BBEB-B0AE56795C47</slim:Property><slim:Property type="string" name="version">5</slim:Property></slim:About><slim:TOC><slim:Item idref="sec692C.1" title="692C.1   National criminal history record checks  persons providing child care, elder care, and care for individuals with disabilities."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp692C"><slim:Heading class="heading"><xhtml:span class="identifier">692C</xhtml:span><xhtml:span class="headnote">NATIONAL CRIMINAL HISTORY RECORD CHECKS</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec692C.1"><xhtml:div class="heading"><xhtml:span class="identifier">692C.1</xhtml:span><xhtml:span class="headnote">National criminal history record checks <xhtml:span class="em-dash"/> persons providing child care, elder care, and care for individuals with disabilities.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this section</xhtml:span>: </xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Covered individual”</xhtml:span> means an individual who has, seeks to have, or may have access to children, the elderly, or individuals with disabilities served by a qualified entity and who is employed by, volunteers with, or seeks to volunteer with a qualified entity; or owns or operates or seeks to own or operate, a qualified entity.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Department”</xhtml:span> means the department of public safety.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Qualified entity”</xhtml:span> means a business or organization, whether public, private, for-profit, nonprofit, or voluntary, that provides care or care placement services, including a business or organization that licenses or certifies others to provide care or care placement services. </xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A qualified entity may request a national criminal history record check by the federal bureau of investigation on covered individuals through the department of public safety.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The qualified entity shall submit fingerprints and other identifying information to the division of criminal investigation of the department on a form and in a manner as prescribed by the department. The department shall submit the information through the state criminal history repository to the federal bureau of investigation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The department may use authority conferred under the <xhtml:span class="USActsRef">National Child Protection Act</xhtml:span>, as codified in <xhtml:span class="USCRef">34 U.S.C. §40104</xhtml:span>, in conducting national criminal history record checks on covered individuals.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The department may require a qualified entity to pay a fee associated with a national criminal history record check. The fee shall not exceed the actual cost of the national criminal history record check. </xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">The results of national criminal history record checks are a confidential record under <xhtml:span class="iowaCodeRef">section 22.7</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">The department shall adopt rules as necessary for the administration of <xhtml:span class="iowaCodeRef">this section</xhtml:span> pursuant to <xhtml:span class="iowaCodeRef">chapter 17A</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2019 Acts, ch 60, §1</xhtml:span>; <xhtml:span class="iowaActsRef">2019 Acts, ch 89, §20</xhtml:span></xhtml:div></xhtml:div></slim:Section></slim:Level></slim:Body></slim:Document>
