<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp590" name="590"><slim:About class="header"><slim:Property type="string" name="version"/></slim:About><slim:TOC><slim:Item idref="sec590.1" title="590.1   Notice of appointment of executors."/><slim:Item idref="sec590.2" title="590.2   Notice of hearing in probate."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp590"><slim:Heading class="heading"><xhtml:span class="identifier">590</xhtml:span><xhtml:span class="headnote">WILLS</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec590.1"><xhtml:div class="heading"><xhtml:span class="identifier">590.1</xhtml:span><xhtml:span class="headnote">Notice of appointment of executors.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">In all instances prior to January 1, 1964, where executors or administrators have failed to publish notice of their appointment as required by <xhtml:span class="iowaCodeRef">section 3304, Code of 1897</xhtml:span>, and <xhtml:span class="iowaCodeRef">section 11890, Codes of 1924 </xhtml:span> through <xhtml:span class="iowaCodeRef">1939</xhtml:span>, and <xhtml:span class="iowaCodeRef">section 633.46, Codes 1946</xhtml:span> through <xhtml:span class="iowaCodeRef">1962</xhtml:span>, but have published a notice of appointment, such notice of appointment is hereby legalized and shall have the same force and effect as though the same had been published as directed by the court or clerk.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">In all instances where more than five years have passed since the appointment of a personal representative or probate of a will without administration, where administrators have failed to publish notice of their appointment as required by <xhtml:span class="iowaCodeRef">section 633.230</xhtml:span>, and executors have failed to publish a notice of admission of the will to probate and their appointment as required by <xhtml:span class="iowaCodeRef">sections 633.304</xhtml:span> and <xhtml:span class="iowaCodeRef">633.305</xhtml:span>, but have published a notice of appointment or notice of admission of the will to probate and of the appointment of the executor, such notice of appointment or notice of admission of the will to probate and of the appointment of the executor, is hereby legalized and shall have the same force and effect as though the same had been published as required.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C24, 27, 31, 35, 39, §<xhtml:span class="b">10407;</xhtml:span> C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, <xhtml:span class="iowaCodeRef">81, §590.1</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2021 Acts, ch 76, §139</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec590.2"><xhtml:div class="heading"><xhtml:span class="identifier">590.2</xhtml:span><xhtml:span class="headnote">Notice of hearing in probate.</xhtml:span></xhtml:div><xhtml:p class="para">In all instances prior to January 1, 1964, where the clerk of the district court of any county failed to publish notice of the time fixed for hearing of the probate of any will filed in such county as required by <xhtml:span class="iowaCodeRef">section 11865 of the Code [1924</xhtml:span> through <xhtml:span class="iowaCodeRef">1939</xhtml:span>], and <xhtml:span class="iowaCodeRef">section 633.20, Codes 1946</xhtml:span> through <xhtml:span class="iowaCodeRef">1962</xhtml:span>, but did publish a notice of the time fixed for such hearing signed by the clerk and addressed to whom it may concern in a daily or weekly newspaper printed in the county where the will was filed, such notice of time fixed for the hearing of the probate of such will is hereby legalized and shall have the same force and effect as though the same had been published in strict conformity with the requirements of said section.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, <xhtml:span class="iowaCodeRef">81, §590.2</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2022 Acts, ch 1032, §98</xhtml:span></xhtml:div></xhtml:div></slim:Section></slim:Level></slim:Body></slim:Document>
