"/><slim:Item idref="sec581.1A" title="581.1A   Definitions."/><slim:Item idref="sec581.2" title="581.2   Priority."/><slim:Item idref="sec581.2A" title="581.2A   Lien created."/><slim:Item idref="sec581.3" title="581.3   Perfecting the lien — filing requirements."/><slim:Item idref="sec581.4" title="581.4   Enforcement."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp581"><slim:Heading class="heading"><xhtml:span class="identifier">581</xhtml:span><xhtml:span class="headnote">VETERINARIAN’S LIEN</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec581.1"><xhtml:div class="heading"><xhtml:span class="identifier">581.1</xhtml:span><xhtml:span class="headnote">Nature of lien.</xhtml:span></xhtml:div><xhtml:p class="para">Repealed by <xhtml:span class="iowaActsRef">2003 Acts, ch 82, §21</xhtml:span>. </xhtml:p></slim:Section><slim:Section class="codeSection" id="sec581.1A"><xhtml:div class="heading"><xhtml:span class="identifier">581.1A</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Livestock”</xhtml:span> means an animal belonging to the bovine, caprine, equine, ovine, or porcine species, ostriches, rheas, emus, poultry, or fish or shellfish.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Veterinarian”</xhtml:span> means a person who practices veterinary medicine under a valid license or temporary permit as provided in <xhtml:span class="iowaCodeRef">chapter 169</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="i">“Veterinarian’s lien”</xhtml:span> or <xhtml:span class="term">“lien”</xhtml:span> means a veterinarian’s lien created under <xhtml:span class="iowaCodeRef">section 581.2A</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2003 Acts, ch 82, §15</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec581.2"><xhtml:div class="heading"><xhtml:span class="identifier">581.2</xhtml:span><xhtml:span class="headnote">Priority.</xhtml:span></xhtml:div><xhtml:p class="para">Except as provided in <xhtml:span class="iowaCodeRef">this section</xhtml:span>, <xhtml:span class="iowaCodeRef">section 554.9322</xhtml:span> shall govern the priority of a veterinarian’s lien that is effective or perfected as provided in <xhtml:span class="iowaCodeRef">section 581.3</xhtml:span>.</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A veterinarian’s lien that is effective but not perfected under <xhtml:span class="iowaCodeRef">section 581.3</xhtml:span> shall have priority as provided in <xhtml:span class="iowaCodeRef">section 554.9322</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A veterinarian’s lien that is perfected under <xhtml:span class="iowaCodeRef">section 581.3</xhtml:span> shall have priority over any conflicting security interest or lien in livestock treated by a veterinarian, regardless of when such security interest or lien is perfected.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Notwithstanding paragraph <xhtml:span class="i">“a”</xhtml:span>, a veterinarian’s lien shall not be superior to a court-ordered lien provided in <xhtml:span class="iowaCodeRef">section 717.4</xhtml:span>, if such lien is perfected as an agricultural lien.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C35, §10347-f2; <xhtml:span class="iowaActsRef">2011 Acts, ch 81, §4</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec581.2A"><xhtml:div class="heading"><xhtml:span class="identifier">581.2A</xhtml:span><xhtml:span class="headnote">Lien created.</xhtml:span></xhtml:div><xhtml:p class="para">A veterinarian shall have an agricultural lien as provided in <xhtml:span class="iowaCodeRef">section 554.9102</xhtml:span> for the actual and reasonable value of treating livestock, including the cost of any product used and the actual and reasonable value of any professional service rendered by the veterinarian. The veterinarian is a secured party and the owner of the livestock is a debtor for purposes of <xhtml:span class="iowaCodeRef">chapter 554, article 9</xhtml:span>. The lien applies to the livestock treated by the veterinarian.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2003 Acts, ch 82, §17</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec581.3"><xhtml:div class="heading"><xhtml:span class="identifier">581.3</xhtml:span><xhtml:span class="headnote">Perfecting the lien — filing requirements.</xhtml:span></xhtml:div><xhtml:p class="para">Except as provided in <xhtml:span class="iowaCodeRef">this section</xhtml:span>, a financing statement filed to perfect a veterinarian’s lien shall be governed by <xhtml:span class="iowaCodeRef">chapter 554, article 9, part 5</xhtml:span>, in the same manner as any other financing statement.</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The lien becomes effective at the time that the veterinarian treats the livestock.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">In order to perfect the lien, the veterinarian must file a financing statement in the office of the secretary of state as provided in <xhtml:span class="iowaCodeRef">section 554.9308</xhtml:span> within sixty days after the day that the veterinarian treats the livestock. The financing statement shall meet the requirements of <xhtml:span class="iowaCodeRef">section 554.9502, subsection 1</xhtml:span>, and include all applicable information described in <xhtml:span class="iowaCodeRef">section 554.9516</xhtml:span>.
