<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp579A" name="579A"><slim:About class="header"><slim:Property type="string" name="version"/></slim:About><slim:TOC><slim:Item idref="sec579A.1" title="579A.1   Definitions."/><slim:Item idref="sec579A.2" title="579A.2   Establishment of lien — priority."/><slim:Item idref="sec579A.3" title="579A.3   Enforcement."/><slim:Item idref="sec579A.4" title="579A.4   Waivers unenforceable."/><slim:Item idref="sec579A.5" title="579A.5   Alternate lien procedure."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp579A"><slim:Heading class="heading"><xhtml:span class="identifier">579A</xhtml:span><xhtml:span class="headnote">CUSTOM CATTLE FEEDLOT LIEN</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec579A.1"><xhtml:div class="heading"><xhtml:span class="identifier">579A.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Cattle”</xhtml:span> means an animal classified as bovine, regardless of the age or sex of the animal.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Custom cattle feedlot”</xhtml:span> means a feedlot where cattle owned by a person are provided feed and care by another person.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Custom cattle feedlot operator”</xhtml:span> means the owner of a custom cattle feedlot or the owner’s personal representative.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Feedlot”</xhtml:span> means a lot, yard, corral, building, or other area in which cattle are confined and fed and maintained for forty-five days or more in any twelve-month period.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Lien”</xhtml:span> means a custom cattle feedlot lien created in <xhtml:span class="iowaCodeRef">section 579A.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Personal representative”</xhtml:span> means a person who is authorized by the owner of a custom cattle feedlot to act on behalf of the owner, including by executing an agreement, managing a custom cattle feedlot, filing a financing statement to perfect a lien, and enforcing a lien under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Processor”</xhtml:span> means the same as defined in <xhtml:span class="iowaCodeRef">section 202B.102</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">95 Acts, ch 59, §2</xhtml:span>; <xhtml:span class="iowaActsRef">99 Acts, ch 169, §7, 8, 22, 24</xhtml:span>; <xhtml:span class="iowaActsRef">2001 Acts, ch 25, §1, 2</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec579A.2"><xhtml:div class="heading"><xhtml:span class="identifier">579A.2</xhtml:span><xhtml:span class="headnote">Establishment of lien — priority.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A custom cattle feedlot lien is created. The lien is an agricultural lien as provided in <xhtml:span class="iowaCodeRef">section 554.9302</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A custom cattle feedlot operator shall have a lien upon the cattle and the identifiable cash proceeds from the sale of the cattle for the amount of the contract price for the feed and care of the cattle at the custom cattle feedlot pursuant to a written or oral agreement by the custom cattle feedlot operator and the person who owns the cattle, which may be enforced as provided in <xhtml:span class="iowaCodeRef">section 579A.3</xhtml:span>. The custom cattle feedlot operator is a secured party and the owner of the cattle is a debtor for purposes of <xhtml:span class="iowaCodeRef">chapter 554, article 9</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A custom cattle feedlot lien becomes effective at the time the cattle arrive at the custom cattle feedlot. In order to perfect the lien, the custom cattle feedlot operator must file a financing statement in the office of the secretary of state as provided in <xhtml:span class="iowaCodeRef">section 554.9308</xhtml:span> within twenty days after the cattle arrive at the custom cattle feedlot.</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The financing statement shall substantially meet the requirements of <xhtml:span class="iowaCodeRef">section 554.9502, subsection 1</xhtml:span>, and include all applicable information described in <xhtml:span class="iowaCodeRef">section 554.9516</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The lien terminates one year after the cattle have left the custom cattle feedlot. The lien may be terminated by the custom cattle feedlot operator who files a termination statement as provided in <xhtml:span class="iowaCodeRef">chapter 554, article 9</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Filing a financing statement as provided in <xhtml:span class="iowaCodeRef">this section</xhtml:span> substantially satisfies all requirements for perfection of an agricultural lien as provided in <xhtml:span class="iowaCodeRef">chapter 554, article 9</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A custom cattle feedlot lien that is perfected under <xhtml:span class="iowaCodeRef">this section</xhtml:span> is superior to and shall have priority over a conflicting lien or security interest in the cattle, including a lien or security interest that was perfected prior to the perfection of the custom cattle feedlot lien.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Notwithstanding paragraph <xhtml:span class="i">“a”</xhtml:span>, a custom cattle feedlot lien shall not be superior to a court-ordered lien provided in <xhtml:span class="iowaCodeRef">section 717.4</xhtml:span> or a veterinarian’s lien created under <xhtml:span class="iowaCodeRef">chapter 581</xhtml:span>, if such lien is perfected as an agricultural lien as provided in <xhtml:span class="iowaCodeRef">chapter 554, article 9</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading">  <xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A custom cattle feedlot lien that is effective but not perfected under <xhtml:span class="iowaCodeRef">this section</xhtml:span> has priority as provided in <xhtml:span class="iowaCodeRef">section 554.9322</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">95 Acts, ch 59, §3</xhtml:span>; <xhtml:span class="iowaActsRef">99 Acts, ch 169, §9 – 11, 22, 24</xhtml:span>; <xhtml:span class="iowaActsRef">2001 Acts, ch 25, §3</xhtml:span>; <xhtml:span class="iowaActsRef">2005 Acts, ch 136, §38</xhtml:span>; <xhtml:span class="iowaActsRef">2005 Acts, ch 179, §74</xhtml:span>; <xhtml:span class="iowaActsRef">2011 Acts, ch 81, §2</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec579A.3"><xhtml:div class="heading"><xhtml:span class="identifier">579A.3</xhtml:span><xhtml:span class="headnote">Enforcement.</xhtml:span></xhtml:div><xhtml:p class="para">While the cattle are located at the custom cattle feedlot, the custom cattle feedlot operator may enforce a lien created in <xhtml:span class="iowaCodeRef">section 579A.2</xhtml:span> in the manner provided for the enforcement of an agricultural lien as provided in <xhtml:span class="iowaCodeRef">chapter 554, article 9, part 6</xhtml:span>. After the cattle have left the custom cattle feedlot, the custom cattle feedlot operator may enforce the lien by commencing an action at law for the amount of the lien against either of the following:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The holder of the identifiable cash proceeds from the sale of the cattle.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The processor who has purchased the cattle within three days after the cattle have left the custom cattle feedlot.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">95 Acts, ch 59, §4</xhtml:span>; <xhtml:span class="iowaActsRef">2000 Acts, ch 1149, §180, 187</xhtml:span>; <xhtml:span class="iowaActsRef">2002 Acts, ch 1119, §93</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec579A.4"><xhtml:div class="heading"><xhtml:span class="identifier">579A.4</xhtml:span><xhtml:span class="headnote">Waivers unenforceable.</xhtml:span></xhtml:div><xhtml:p class="para">A waiver of a right created by <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, including but not limited to a waiver of the right to file a financing statement pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, is void and unenforceable. <xhtml:span class="iowaCodeRef">This section</xhtml:span> does not affect other provisions of a contract, including a production contract or a related document, policy, or agreement which can be given effect without the voided provision.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">99 Acts, ch 169, §12, 22, 24</xhtml:span>; <xhtml:span class="iowaActsRef">2001 Acts, ch 25, §4</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec579A.5"><xhtml:div class="heading"><xhtml:span class="identifier">579A.5</xhtml:span><xhtml:span class="headnote">Alternate lien procedure.</xhtml:span></xhtml:div><xhtml:p class="para">A person who is a custom cattle feedlot operator may file a financing statement and enforce a lien as a contract producer under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or <xhtml:span class="iowaCodeRef">chapter 579B</xhtml:span>, but not both.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">99 Acts, ch 169, §13, 22, 24</xhtml:span>; <xhtml:span class="iowaActsRef">2001 Acts, ch 25, §5</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section></slim:Level></slim:Body></slim:Document>
