<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp546B" name="546B"><slim:About class="header"><slim:Property type="string" name="checkinTime">10/16/2018 10:34</slim:Property><slim:Property type="string" name="taskInfo">1035:720ED997-1CBD-456A-B720-A5AC3612071F</slim:Property><slim:Property type="string" name="version">35</slim:Property></slim:About><slim:TOC><slim:Item idref="sec546B.1" title="546B.1   Definitions."/><slim:Item idref="sec546B.2" title="546B.2   Advertising or promotion disclosures."/><slim:Item idref="sec546B.3" title="546B.3   Prohibited acts or practices."/><slim:Item idref="sec546B.4" title="546B.4   Inapplicability of chapter."/><slim:Item idref="sec546B.5" title="546B.5   Unfair practice  penalties."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp546B"><slim:Heading class="heading"><xhtml:span class="identifier">546B</xhtml:span><xhtml:span class="headnote">VETERANS BENEFITS ASSISTANCE</xhtml:span></slim:Heading><xhtml:div class="footnotes"><xhtml:div class="footnote">Former chapter 546B repealed by <xhtml:span class="iowaActsRef">2018 Acts, ch 1115, §7</xhtml:span></xhtml:div></xhtml:div><slim:Section class="codeSection" id="sec546B.1"><xhtml:div class="heading"><xhtml:span class="identifier">546B.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">When used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="def"><xhtml:span class="term">“Compensation”</xhtml:span> means money, property, or anything else of value, which includes but is not limited to exclusive arrangements or agreements for the provision of services or the purchase of products.</xhtml:span></xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="def"><xhtml:span class="term">“Person”</xhtml:span> includes, where applicable, natural persons, corporations, trusts, unincorporated associations, and partnerships.</xhtml:span></xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="def"><xhtml:span class="term">“Trade or commerce”</xhtml:span> includes the marketing or sale of assets, goods, or services, or any commerce directly or indirectly affecting the people of this state.</xhtml:span></xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Veteran”</xhtml:span> means as defined in <xhtml:span class="iowaCodeRef">section 35.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="def"><xhtml:span class="term">“Veterans’ benefit matter”</xhtml:span> means any preparation, presentation, or prosecution of a claim affecting a person who has filed or has expressed an intention to file an application for determination of payment, service, commodity, function, or status, entitlement to which is determined under laws administered by the United States department of veterans affairs or the Iowa department of veterans affairs pertaining to veterans and their dependents or survivors.</xhtml:span></xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2018 Acts, ch 1115, §2</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">Former §546B.1 repealed by <xhtml:span class="iowaActsRef">2018 Acts, ch 1115, §7</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec546B.2"><xhtml:div class="heading"><xhtml:span class="identifier">546B.2</xhtml:span><xhtml:span class="headnote">Advertising or promotion disclosures.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A person who advertises or promotes any event, presentation, seminar, workshop, or other public gathering regarding veterans’ benefits or entitlements shall include a disclosure as provided in <xhtml:span class="iowaCodeRef">this section</xhtml:span> and must disseminate the disclosure, both orally and in writing, at the beginning of the event, presentation, seminar, workshop, or other public gathering. The written disclosure must be in the same type size and font as the term “veteran” or any variation of that term as used in the advertisement or promotional materials for the event, presentation, seminar, workshop, or public gathering.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The disclosure required by <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall be in the following form:<xhtml:div class="form"><xhtml:p class="p">This event is not sponsored by, or affiliated with, the United States Department of Veterans Affairs, the Iowa Department of Veterans Affairs, or any other congressionally chartered or recognized organization of honorably discharged members of the Armed Forces of the United States or any of their auxiliaries. Products or services that may be discussed at this event are not necessarily endorsed by those organizations. You may qualify for benefits other than or in addition to the benefits discussed at this event. </xhtml:p></xhtml:div></xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The requirement to provide a disclosure as provided in <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall not apply under any of the following circumstances:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The United States department of veterans affairs, the Iowa department of veterans affairs, or any other congressionally chartered or recognized organization of honorably discharged members of the armed forces of the United States or any of their auxiliaries have granted written permission to the person for the use of its name, symbol, or insignia to advertise or promote any event, presentation, seminar, workshop, or other public gathering regarding veterans’ benefits or entitlements.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The event, presentation, seminar, workshop, or public gathering is part of an accredited continuing legal education course.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2018 Acts, ch 1115, class="headnote">Prohibited acts or practices.</xhtml:span></xhtml:div><xhtml:p class="para">A person who commits any of the following acts or practices commits a violation of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Receives compensation for advising or assisting another person with a veterans’ benefit matter, except as permitted under <xhtml:span class="USCRef">Tit. 38 of the United States Code</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Uses financial or other personal information gathered in order to prepare documents for, or otherwise represent the interests of, another in a veterans’ benefit matter for purposes of trade or commerce, except as permitted under <xhtml:span class="USCRef">Tit. 38 of the United States Code</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Receives compensation for referring another person to a person accredited by the United States department of veterans affairs.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Represents, either directly or by implication, and either orally or in writing, that the receipt of a certain level of veterans’ benefits is guaranteed.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Fails to provide a disclosure required to be provided pursuant to <xhtml:span class="iowaCodeRef">section class="headnote">Inapplicability of chapter.</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This chapter</xhtml:span> does not apply to officers, employees, or volunteers of the state, or of any county, city, or other political subdivision, or of a federal agency of the United States, who are acting in their official capacity.</xhtml:p><xhtml:div penalties.</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> is a violation of <xhtml:span class="iowaCodeRef">section 714.16, subsection 2</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>.
