An appraisal may be classified by subject matter into either a valuation or an analysis. A <xhtml:span class="term">“valuation”</xhtml:span> is an estimate of the value of real estate or real property. An <xhtml:span class="term">“analysis”</xhtml:span> is a study of real estate or real property other than estimating value.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Appraisal assignment”</xhtml:span> means an engagement for which an appraiser is employed or retained to act, or would be perceived by third parties or the public as acting as a disinterested third party in rendering an appraisal, valuation, or analysis.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Appraisal foundation”</xhtml:span> means the appraisal foundation incorporated as an Illinois not-for-profit corporation on November 30, 1987.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Appraisal report”</xhtml:span> means any communication of an appraisal.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Appraisal review”</xhtml:span> means developing and communicating an opinion under the uniform standards of professional appraisal practice review standards regarding the quality of an appraiser’s work product, with or without also providing an opinion of value, prepared as part of an appraisal assignment. <xhtml:span class="term">“Appraisal review”</xhtml:span> does not include quality control solely to assure an appraisal report is complete, or to correct grammatical, typographical, or similar errors.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Associate real estate appraiser”</xhtml:span> means a person who may not yet fully meet the requirements for certification but who is providing significant input into the appraisal development under the direction of a certified appraiser.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Board”</xhtml:span> means the real estate appraiser examining board established pursuant to <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Certified appraisal or certified appraisal report”</xhtml:span> means an appraisal or appraisal report given or signed and certified as an appraisal or appraisal report by an Iowa certified real estate appraiser.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">9</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Certified real estate appraiser”</xhtml:span> means a person who develops and communicates real estate appraisals and who holds a current, valid certificate for appraisals of types of real estate which may include residential, commercial, or rural real estate, as may be established under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">10</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Director”</xhtml:span> means the director of the department of inspections, appeals, and licensing or the director’s designee.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">11</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Federally related transaction”</xhtml:span> means any financial transaction related to real estate which a federal financial institutions regulatory agency engages in, contracts for, or regulates, and which requires the services of an appraiser pursuant to federally related transaction regulations.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">12</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Federally related transaction regulations”</xhtml:span> means regulations established by the comptroller of the currency, the board of governors of the federal reserve system, the federal deposit insurance corporation, or the national credit union administration pursuant to <xhtml:span class="USActsRef">sections 1112, 1113, and 1114 of Tit. XI of the federal Financial Institutions Reform, Recovery, and Enforcement Act</xhtml:span>, <xhtml:span class="USCRef">12 U.S.C. §3341 <xhtml:span class="en-dash"/> 3343</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">13</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Review appraiser”</xhtml:span> means a person who is responsible for conducting an appraisal review.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">14</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Specialized services”</xhtml:span> means a hypothetical or other special valuation, or an analysis or an appraisal which does not fall within the definition of an appraisal assignment.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">89 Acts, ch 290, §2</xhtml:span></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaCodeRef">CS89, §117B.2</xhtml:span></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaCodeRef">C93, §543D.2</xhtml:span></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2001 Acts, ch 49, §1</xhtml:span>; <xhtml:span class="iowaActsRef">2016 Acts, ch 1124, §22, 32</xhtml:span>; <xhtml:span class="iowaActsRef">2021 Acts, ch 159, §2, 3</xhtml:span>; <xhtml:span class="iowaActsRef">2022 Acts, ch 1032, §91</xhtml:span>; <xhtml:span class="iowaActsRef">2023 Acts, ch 19, §1670, 1671</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec543D.3"><xhtml:div class="heading"><xhtml:span class="identifier">543D.3</xhtml:span><xhtml:span class="headnote">Purposes.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The purpose of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> is to establish standards for real estate appraisals and a procedure for the mandatory certification of real estate appraisers performing appraisals for federally related transactions, the voluntary certification of real estate appraisers performing appraisals not related to federally related transactions, and the mandatory registration of associate real estate appraisers.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person who performs an appraisal, other than an appraisal review, for a federally related transaction as it relates to real estate located in this state must be a certified real estate appraiser under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or a registered associate real estate appraiser acting under the direct supervision of a certified real estate appraiser if the services of a certified real estate appraiser are required by federal law or regulation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A person who is not a certified real estate appraiser under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> may appraise real estate for compensation if certification is not required by <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or by federal or state law, rule, or policy. Notwithstanding <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>, in connection with the performance of an appraisal of real estate located in this state, the use of the title “certified real estate appraiser”, “associate real estate appraiser”, or any other like title, including a title that suggests an individual is certified under the laws of this or another state, shall only be used to refer to or by individuals who hold a certificate or registration under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">An employee of the state department of transportation whose duties include appraisals of property pursuant to <xhtml:span class="iowaCodeRef">chapter 6B</xhtml:span> must be a certified real estate appraiser under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or a registered associate real estate appraiser acting under the direct supervision of a certified real estate appraiser.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">A person who is not a certified real estate appraiser under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> but who is licensed under <xhtml:span class="iowaCodeRef">chapter 543B</xhtml:span> may be compensated in the course of business for providing an estimate of the probable selling price or leasing price of a particular parcel of real estate or interest in real estate as a comparative market analysis or a broker price opinion. The board consists of five members, one of whom shall be a public member and four of whom shall be certified real estate appraisers.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The governor shall appoint the members of the board who are subject to confirmation by the senate. The governor may remove a member for cause.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A certified real estate appraiser member of the board shall be actively engaged in practice as a certified real estate appraiser. The governor shall attempt to represent each class of certified appraisers in making the appointments.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The term of each member is three years. Vacancies occurring during a term shall be filled by appointment by the governor for the unexpired term.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Upon expiration of their terms, members of the board shall continue to hold office until the appointment and qualification of their successors. The board shall consider and may incorporate any standards required or recommended by the appraisal foundation or by a federal agency with regulatory authority over appraisal standards or the certification of appraisers for federally related transactions.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The uniform appraisal standards shall meet all of the following requirements:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Require compliance with federal law and appraisal standards adopted by federal authorities as they apply to federally related transactions. This paragraph does not require that an appraiser invoke a jurisdictional exception to the uniform standards of professional appraisal practice in order to comply with federal law and appraisal standards adopted by federal authorities as they apply to federally related transactions, unless federal law requires that the exception be invoked.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Develop standards for the scope of practice for certified real estate appraisers.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Required compliance with the uniform standards of professional appraisal practice in all appraisal assignments.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Appraiser certification requirements shall require a demonstration that the applicant has a working knowledge of current appraisal theories, practices, and techniques which will provide a high degree of service and protection to members of the public dealt with in a professional relationship under authority of the certification. The fees shall include, but are not limited to, amounts to cover the costs for the following items:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Per diem, expenses, and travel expenses for board members, peer review committee persons, or disciplinary panel members.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Salary, per diem, and expenses of staff.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Office facilities, supplies, and equipment.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">All fees collected by the board shall be deposited into the licensing and regulation fund created in section <xhtml:span class="iowaCodeRef">10A.507</xhtml:span> to be used to administer <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, including but not limited to purposes such as examinations, investigations, and administrative staffing. All experience required for initial certification shall be performed as a registered associate real estate appraiser acting under the direct supervision of a certified real estate appraiser who meets the supervisory requirements established by applicable federal authorities or federal law, rule, or policy in effect at the time the hours of experience are claimed, except as the board may provide by rule. Subject to requirements or limitations established by applicable federal authorities or federal law, rule, or policy, hours qualifying for experience in a bordering state will be considered qualifying hours for experience in this state without requiring a waiver or authorization from the board in accordance with rules and standards adopted by the board. Qualifying hours completed in a bordering state shall be under the direct supervision of a certified real estate appraiser with active certification in that bordering state. <xhtml:span class="iowaActsRef">2008 Acts, ch 1059, §5</xhtml:span>; <xhtml:span class="iowaActsRef">2013 Acts, ch 5, §27</xhtml:span>; <xhtml:span class="iowaActsRef">2024 Acts, ch 1169, §41</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec543D.17"><xhtml:div class="heading"><xhtml:span class="identifier">543D.17</xhtml:span><xhtml:span class="headnote">Disciplinary proceedings.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The rights of a holder of a certificate as a certified real estate appraiser may be revoked or suspended, or the holder may be otherwise disciplined in accordance with <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>. The board may investigate the actions of a certified real estate appraiser and may revoke or suspend the rights of a holder or otherwise discipline a holder for violation of a provision of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, or <xhtml:span class="iowaCodeRef">chapter 272C</xhtml:span>, or of a rule adopted under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or commission of any of the following acts or omissions:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Procurement or attempt to procure a certificate under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> by knowingly making a false statement, submitting false information, refusing to provide complete information in response to a question in an application for certification, or participating in any form of fraud or misrepresentation.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Failure to meet the minimum qualifications established by <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A conviction, including a conviction based upon a plea of guilty or nolo contendere, of a crime which is substantially related to the qualifications, functions, and duties of a person developing real estate appraisals and communicating real estate appraisals to others.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Violation of any of the standards for the development or communication of real estate appraisals as provided in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Failure or refusal without good cause to exercise reasonable diligence in developing an appraisal, preparing an appraisal report, or communicating an appraisal.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">f</xhtml:span></xhtml:div><xhtml:p class="para">Negligence or incompetence in developing an appraisal, in preparing an appraisal report, or in communicating an appraisal.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">g</xhtml:span></xhtml:div><xhtml:p class="para">Willful disregard or violation of a provision of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or a rule of the board of the administration and enforcement of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">In a disciplinary proceeding based upon a civil judgment a certified real estate appraiser shall be given an opportunity to present matters in mitigation and extenuation, but not to collaterally attack the civil judgment.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Notwithstanding the limitations of <xhtml:span class="iowaCodeRef">section 272C.3, subsection 2</xhtml:span>, paragraph <xhtml:span class="i">“e”</xhtml:span>, the board shall adopt a rule providing for civil penalties in amounts and for the reasons authorized by federal law where federal law requires the board to have the authority to impose the civil penalties in order to obtain or to retain the board’s designation as a qualified state appraiser certifying agency.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">89 Acts, ch 290, §17</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaCodeRef">CS89, §117B.17</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaCodeRef">C93, §543D.17</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec543D.18"><xhtml:div class="heading"><xhtml:span class="identifier">543D.18</xhtml:span><xhtml:span class="headnote">Standards of practice.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A certified real estate appraiser shall comply with the uniform appraisal standards adopted under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>. The reliance of the public in general and of the financial business community in particular on sound, reliable real estate appraisal practices imposes on persons engaged in the practice of real estate appraising as certified real estate appraisers or as registered associate real estate appraisers certain obligations both to their clients and to the public. These obligations include the obligation to maintain independence in thought and action, to adhere to the uniform appraisal standards adopted under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, and to maintain high standards of personal conduct in all matters impacting one’s fitness to practice real estate appraising. A certified real estate appraiser and a registered associate real estate appraiser acting under the direct supervision of a certified real estate appraiser shall perform all appraisal assignments in an honest, disinterested, and impartial manner, with objectivity and independence, and without accommodation to the personal interests or objectives of the appraiser, the client, or any third person.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A certified real estate appraiser shall not accept an appraisal assignment or a fee for an appraisal assignment if the employment itself is contingent upon the appraiser reporting a predetermined estimate, analysis, or opinion or if the fee to be paid is contingent upon the opinion, conclusion, or valuation reached, or upon the consequences resulting from the appraisal assignment.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A certified real estate appraiser may provide specialized services to facilitate the client’s or employer’s objectives. Specialized services shall not be communicated as a certified appraisal or as a certified appraisal report. Regardless of the intention of the client or employer, if the appraiser would be perceived by third parties or the public as acting as a disinterested third party in rendering an unbiased analysis or opinion or conclusion, the work is an appraisal assignment rather than an assignment for specialized services. Communication of a valuation under oath is an appraisal assignment.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">A certified real estate appraiser who enters into an agreement to perform specialized services may be paid a fixed fee or a fee that is contingent on the results achieved by the specialized services.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">If a certified real estate appraiser enters into an agreement to perform specialized services for a contingent fee, this fact shall be clearly stated in each written and oral report. In each written report, this fact shall be clearly stated in a prominent location in the report, each letter of transmittal, and the certification statement made by the appraiser in the report.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">A certified real estate appraiser making a significant contribution to the valuation or analysis process in completing an appraisal assignment shall sign the final written report or acknowledge the appraiser’s contribution in a verbal report.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">A certified real estate appraiser who receives significant real property appraisal assistance in the development or reporting of an appraisal assignment shall disclose such assistance in accordance with the uniform appraisal standards adopted under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">89 Acts, ch 290, §18</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaCodeRef">CS89, §117B.18</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaCodeRef">C93, §543D.18</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaActsRef">2007 Acts, ch 72, §3, 4</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec543D.18A"><xhtml:div class="heading"><xhtml:span class="identifier">543D.18A</xhtml:span><xhtml:span class="headnote">Penalties for improper influence of an appraisal assignment.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A mortgage lender, mortgage broker or originator, real estate broker or salesperson, client, party, appraiser, or any other person with an interest in a real estate transaction or the financing of any loan secured by real estate involving an appraisal assignment shall not improperly influence or attempt to improperly influence the development, reporting, result, or review of a real estate appraisal through coercion, extortion, or bribery, or by the withholding or threatened withholding of payment for an appraisal fee, or the conditioning of the payment of an appraisal fee upon the opinion, conclusion, or valuation to be reached, or a request that the appraiser report a predetermined opinion, conclusion, or valuation, or the desired valuation of any person, or by any other act or practice that impairs or attempts to impair an appraiser’s independence, objectivity, and impartiality, as required by <xhtml:span class="iowaCodeRef">section 543D.18, subsections 1 and 2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> is an unlawful practice under <xhtml:span class="iowaCodeRef">section 714.16, subsection 2</xhtml:span>, paragraph <xhtml:span class="i">“a”</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">this section</xhtml:span> is a ground for discipline against any person holding a certificate of registration under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or another license issued under the laws of the state of Iowa, as license is defined in <xhtml:span class="iowaCodeRef">section 17A.2, subsection 6</xhtml:span>, if the practice of the profession, occupation, or business regulated by the license relates to real estate transactions or the financing of loans secured by real estate.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">A person does not violate <xhtml:span class="iowaCodeRef">this section</xhtml:span> solely by asking an appraiser to consider additional, appropriate property information, or to provide further detail, substantiation, or explanation for the appraiser’s value conclusion, or to correct errors in the appraisal report, or by withholding payment of an appraisal fee based on a bona fide dispute regarding the appraiser’s compliance with the appraisal standards adopted by the board under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>. A person does not violate <xhtml:span class="iowaCodeRef">this section</xhtml:span> solely by retaining appraisers from panels or lists on a rotating basis, or by supplying an appraiser with information the appraiser is required to analyze under the appraisal standards adopted by the board under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, such as agreements of sale, options, or listings of the property to be valued.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2007 Acts, ch 72, §5</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec543D.19"><xhtml:div class="heading"><xhtml:span class="identifier">543D.19</xhtml:span><xhtml:span class="headnote">Retention of records.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A certified real estate appraiser shall retain for five years, originals or true copies of all written contracts engaging the appraiser’s services for real estate appraisal work and all reports and supporting data assembled and formulated for use by the appraiser or the associate appraiser in preparing the reports.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">An appraiser must retain all work files for a period of at least five years after preparation or at least two years after final disposition of any judicial proceeding in which testimony was given, whichever period expires last, and either maintain custody of the appraiser’s work file or make appropriate work file retention, access, and retrieval arrangements with a party having custody of the work file.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">All records required to be maintained under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> shall be made available by a certified real estate appraiser for inspection and copying by the board on reasonable notice to the appraiser.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">89 Acts, ch 290, §19</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaCodeRef">CS89, §117B.19</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaCodeRef">C93, §543D.19</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaActsRef">2003 Acts, ch 43, §2, 3</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec543D.20"><xhtml:div class="heading"><xhtml:span class="identifier">543D.20</xhtml:span><xhtml:span class="headnote">Registration of associate real estate appraisers.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A person shall not assist a certified real estate appraiser in the development or reporting of an appraisal assignment that is required by <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, or by federal or state law, rule, or policy to be performed by a certified real estate appraiser, unless the person meets one or more of the following conditions:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The person is certified under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The person is registered as an associate real estate appraiser and is acting under the direct supervision of a certified real estate appraiser.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">The person is solely providing administrative services, such as taking photographs, preparing charts, or typing reports, and is not providing real estate appraisal assistance in developing the analysis, valuation, opinions, or conclusions associated with the appraisal assignment. Such a person shall only enter a dwelling if supervised by the appraiser.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">The person is providing professional consultation that does not constitute real property appraisal assistance, such as the assistance of a professional engineer or certified public accountant.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The board shall establish by rule the terms and conditions of the registration of associate real estate appraisers, including the educational and other prerequisites to registration, the fees for registration and the renewal of registration, and the continuing education requirements for renewal of registration. The board shall consider and may incorporate any guidelines recommended by the appraiser qualifications board of the appraisal foundation relating to associate real estate appraisers.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The board shall adopt rules governing the manner in which certified real estate appraisers shall directly supervise associate real estate appraisers, the standards of conduct for associate real estate appraisers, and the grounds for imposing discipline against an associate real estate appraiser which shall include all of the grounds provided in <xhtml:span class="iowaCodeRef">section 543D.17</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Associate real estate appraisers shall be bound by the uniform appraisal standards adopted by the board under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Persons who appraise real estate where certification is not required by <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> or by federal or state law, rule, or policy, and who are not assisting a certified real estate appraiser in the development or reporting of an appraisal assignment that is required by <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, or by federal or state law, rule, or policy to be performed by a certified real estate appraiser, are not required to register with the board. Notwithstanding <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>, in connection with the performance, or assistance in the performance, of an appraisal of real estate located in this state, the use of the title “associate real estate appraiser” or any other like title, including a title that suggests an individual is an associate real estate appraiser under the laws of this state or another state, shall only be used to refer to individuals who hold a registration under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2007 Acts, ch 72, §6</xhtml:span>; <xhtml:span class="iowaActsRef">2021 Acts, ch 159, §7</xhtml:span>; <xhtml:span class="iowaActsRef">2024 Acts, ch 1169, §42, 43</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section><slim:Section class="codeSection" id="sec543D.21"><xhtml:div class="heading"><xhtml:span class="identifier">543D.21</xhtml:span><xhtml:span class="headnote">Violations — injunctions — civil penalties.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">If, as the result of a complaint or otherwise, the board believes that a person has engaged, or is about to engage, in an act or practice that constitutes or will constitute a violation of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, the board may make application to the district court for an order enjoining such act or practice. Upon a showing by the board that such person has engaged, or is about to engage, in any such act or practice, an injunction, restraining order, or other order as may be appropriate shall be granted by the district court.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The board may investigate complaints or initiate complaints against persons who are not certified or registered under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> solely to determine whether grounds exist to make application to the district court pursuant to <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> or to issue an order pursuant to <xhtml:span class="iowaCodeRef">subsection 3</xhtml:span>, and in connection with such complaints or investigations may issue subpoenas to compel witnesses to testify or persons to produce evidence consistent with the provisions of <xhtml:span class="iowaCodeRef">section 272C.6, subsection 3</xhtml:span>, as needed to determine whether probable cause exists to initiate proceedings under <xhtml:span class="iowaCodeRef">this section</xhtml:span> or to make application to the district court for an order enjoining violations of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">In addition to or as an alternative to making application to the district court for an injunction, the board may issue an order to a person who is not certified or registered under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> to require compliance with <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> and may impose a civil penalty against such person for any violation of <xhtml:span class="iowaCodeRef">subsection 4</xhtml:span> in an amount up to one thousand dollars for each violation. All civil penalties collected pursuant to <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> shall be deposited in the housing trust fund created in <xhtml:span class="iowaCodeRef">section 16.181</xhtml:span>. An order issued pursuant to <xhtml:span class="iowaCodeRef">this section</xhtml:span> may prohibit a person from applying for certification or registration under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The board may impose civil penalties against a person who is not certified or registered under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> for any of the following acts:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">section 543D.3, subsections 2, 3, or 4</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">section 543D.15</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">section 543D.18A, subsection 1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">A violation of <xhtml:span class="iowaCodeRef">section 543D.20, subsection 1 or 5</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Fraud, deceit, or deception, through act or omission, in connection with an application for certification or registration under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The board, before issuing an order under <xhtml:span class="iowaCodeRef">this section</xhtml:span>, shall provide the person written notice and the opportunity to request a hearing. The hearing must be requested within thirty days after receipt of the notice and shall be conducted in the same manner as provided for disciplinary proceedings involving a licensee under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">A person aggrieved by the imposition of a civil penalty under <xhtml:span class="iowaCodeRef">this section</xhtml:span> may seek judicial review pursuant to <xhtml:span class="iowaCodeRef">section 17A.19</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">If a person fails to pay a civil penalty within thirty days after entry of an order imposing the civil penalty, or if the order is stayed pending an appeal, within ten days after the court enters a final judgment in favor of the board, the board shall notify the attorney general. The attorney general may commence an action to recover the amount of the penalty, including reasonable attorney fees and costs.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:p class="para">An action to enforce an order under <xhtml:span class="iowaCodeRef">this section</xhtml:span> may be joined with an action for an injunction.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2007 Acts, ch 72, §7</xhtml:span>; <xhtml:span class="iowaActsRef">2021 Acts, ch 159, §8, 9</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec543D.22"><xhtml:div class="heading"><xhtml:span class="identifier">543D.22</xhtml:span><xhtml:span class="headnote">Criminal background checks.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Subject to paragraphs <xhtml:span class="i">“b”</xhtml:span> and <xhtml:span class="i">“c”</xhtml:span>, the board may require a national criminal history check through the federal bureau of investigation for applicants for certification or registration, or for persons certified or registered under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, if needed for credibility, to comply with federal law or regulation, or the policies of the appraiser qualifications board of the appraisal foundation. The board may alternatively require a national criminal history check through the nationwide mortgage licensing system and registry, as defined in <xhtml:span class="iowaCodeRef">section 535D.3</xhtml:span>, when conducting background investigations under <xhtml:span class="iowaCodeRef">this section</xhtml:span>, if authorized by applicable federal law or regulation.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The board shall not require a national criminal history check through the federal bureau of investigation for applicants for upgraded certification or registration if the applicant applies for the upgraded certification or registration within twenty-four months following the date the applicant obtained their original certification or registration under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">By signing and submitting to the board a statement declaring that there have been no changes to the applicant’s criminal history since the date of the waiver specified in <xhtml:span class="iowaCodeRef">subsection 4</xhtml:span>, and that there are no active or pending complaints in any state against the applicant, any of the following individuals may seek a waiver of the board’s requirement to undergo a national criminal history check:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">An applicant for upgraded certification or registration who obtained their original certification or registration under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> more than twenty-four months prior to applying for the upgraded certification or registration.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">An applicant for upgraded certification applying to the board under a reciprocity agreement.</xhtml:p></xhtml:div></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The board may require applicants, certificate holders, or registrants to provide a full set of fingerprints, in a form and manner prescribed by the board. Such fingerprints, if required, shall be submitted to the federal bureau of investigation through the state criminal history repository for purposes of the national criminal history check.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Subject to paragraphs <xhtml:span class="i">“b”</xhtml:span> and <xhtml:span class="i">“c”</xhtml:span>, the board may also request and obtain, notwithstanding <xhtml:span class="iowaCodeRef">section 692.2, subsection 5</xhtml:span>, criminal history data for applicants, certificate holders, and registrants. A request for criminal history data shall be submitted to the department of public safety, division of criminal investigation, pursuant to <xhtml:span class="iowaCodeRef">section 692.2, subsection 1</xhtml:span>. </xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The board shall not request or obtain criminal history data for applicants for upgraded certification or registration if the applicant applies for the upgraded certification or registration within twenty-four months following the date the applicant obtained their original certification or registration under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">By signing and submitting to the board a statement declaring that there have been no changes to the applicant’s criminal history data since the date of the waiver specified in <xhtml:span class="iowaCodeRef">subsection 4</xhtml:span>, and that there are no active or pending complaints in any state against the applicant, any of the following individuals may seek a waiver of the board’s request to obtain criminal history data:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">An applicant for upgraded certification or registration who obtained their original certification or registration under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> more than twenty-four months prior to applying for the upgraded certification or registration.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">An applicant for upgraded certification applying to the board under a reciprocity agreement.</xhtml:p></xhtml:div></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The board shall inform the applicant, certificate holder, or registrant of the requirement of a national criminal history check or request for criminal history data and obtain a signed waiver from the applicant, certificate holder, or registrant prior to requesting the check or data.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The board may, in addition to any other fees, charge and collect such amounts as may be incurred by the board, the department of public safety, or federal bureau of investigation in obtaining criminal history information. Amounts collected shall be considered appropriated receipts as defined in <xhtml:span class="iowaCodeRef">section 8.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">Criminal history data and other criminal history information relating to an applicant, certificate holder, or registrant obtained by the board pursuant to <xhtml:span class="iowaCodeRef">this section</xhtml:span> is confidential. The director may exercise all authority conferred upon the board under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> and shall have access to all records and information to which the board has access. In supervising the board, the director shall independently evaluate the substantive merits of actions recommended or proposed by the board which may be anticompetitive and shall have the authority to review, approve, modify, or reject all board actions including but not limited to those taken in connection with any of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Initial or reciprocal certification of real estate appraisers, registration of associate real estate appraisers, and temporary practice permits.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Disciplinary investigations and proceedings.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Investigations and proceedings under <xhtml:span class="iowaCodeRef">section 543D.21</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Rulemaking under <xhtml:span class="iowaCodeRef">chapter 17A</xhtml:span>, including orders on petitions for rulemaking.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">e</xhtml:span></xhtml:div><xhtml:p class="para">Orders on petitions for declaratory orders or waivers.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">A person aggrieved by any final action of the board taken under <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> shall not have exhausted administrative remedies until the person has appealed the action to the director and the director has issued a final decision or order.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The director shall adopt rules to implement <xhtml:span class="iowaCodeRef">this section</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2016 Acts, ch 1124, §28, 32</xhtml:span>; <xhtml:span class="iowaActsRef">2021 Acts, ch 80, §344</xhtml:span>; <xhtml:span class="iowaActsRef">2023 Acts, ch 19, §1675</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"/></slim:Section></slim:Level></slim:Body></slim:Document>
