"/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp535A"><slim:Heading class="heading"><xhtml:span class="identifier">535A</xhtml:span><xhtml:span class="headnote">MORTGAGE LOANS — RED-LINING</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec535A.1"><xhtml:div class="heading"><xhtml:span class="identifier">535A.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">For purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Financial institution”</xhtml:span> means any bank, credit union, insurance company, mortgage banking company or savings and loan association, industrial loan company, or like institution or any other person who makes mortgage loans and which operates or has a place of business in this state. <xhtml:span class="term">“Financial institution”</xhtml:span> does not include an individual who makes less than five mortgage loans a year.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Mortgage loan”</xhtml:span> means a loan for the purchase, construction, improvement, or rehabilitation of residential property containing or to contain four or fewer family dwelling units in which the property is used as security for the loan.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Red-lining”</xhtml:span> means the practice by which a financial institution may designate certain areas as unsuitable for the making of mortgage loans and reject applications for mortgage loans or vary the terms of a mortgage loan upon property within that area because of the prevailing income, racial, or ethnic characteristics of the area, or because of the age of the structures in the area.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Vary the terms of a mortgage loan”</xhtml:span> includes but is not limited to the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Requiring a greater than average down payment than is usual for the particular type of mortgage loan involved.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Requiring a shorter period of amortization than is usual for the particular type of mortgage loan involved.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Charging a higher interest rate or higher loan origination fees than is usual for the particular type of mortgage loan involved.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">An unreasonable underappraisal of real estate or item of property offered as security.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C79, <xhtml:span class="iowaCodeRef">81, §535A.1</xhtml:span>; <xhtml:span class="iowaActsRef">81 Acts, ch 174, §4, 5</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">85 Acts, ch 238, §1</xhtml:span>; <xhtml:span class="iowaActsRef">2010 Acts, ch 1114, §1</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec535A.2"><xhtml:div class="heading"><xhtml:span class="identifier">535A.2</xhtml:span><xhtml:span class="headnote">Discriminatory <xhtml:span class="em-dash"/> real estate mortgages.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">It is a discriminatory practice for any financial institution accepting mortgage loan applications to engage in the practice of red-lining as defined in <xhtml:span class="iowaCodeRef">section 535A.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="iowaCodeRef">This section</xhtml:span> shall be administered and enforced by the following agencies:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The superintendent of banking or the superintendent’s designee in regard to banks, persons licensed under <xhtml:span class="iowaCodeRef">chapter 536A</xhtml:span>, and mortgage banking companies.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The commissioner of insurance or the commissioner’s designee pursuant to <xhtml:span class="iowaCodeRef">chapter 505</xhtml:span> in regard to all insurance companies.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">The superintendent of credit unions or the superintendent’s designee in regard to all credit unions.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C79, <xhtml:span class="iowaCodeRef">81, §535A.2</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2010 Acts, ch 1114, §2</xhtml:span>;
