Such ballots shall not be counted, but shall be folded together and kept as hereinafter directed. If the error affects the result of the election, the canvass shall be suspended and a new vote ordered in the precinct where the error occurred. When there is a tie vote due to such an excess, there shall be a new election. A person who was not a registered voter in that precinct at the time of the general election shall not be allowed to vote at the special election. The spoiled ballots shall be preserved for twenty-two months following elections for federal offices and for six months following elections for all other offices. The commissioner shall record the number of ballots sent to the polling places but not voted. The ballots not voted shall be destroyed after the end of the period for contesting the election. A precinct election official may, at the request of the commissioner who is conducting the election, communicate the election results by telephone and shall deliver the election results in person pursuant to <xhtml:span class="iowaCodeRef">section 50.14</xhtml:span> to the commissioner who is conducting the election immediately upon completion of the canvass.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Election results may be transmitted electronically from voting equipment to the commissioner’s office only after the precinct election officials have produced a written report of the election results. The devices used for the electronic transmission of election results shall be approved for use by the board of examiners pursuant to <xhtml:span class="iowaCodeRef">section 52.41</xhtml:span>. The state commissioner of elections shall adopt rules establishing procedures for the electronic transmission of election results.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The commissioner shall remain on duty until such information is communicated to the commissioner from each polling place in the commissioner’s county. The signatures of all board members of the precinct shall be placed across the seal or the opening of the container so that it cannot be opened without breaking the seal. The precinct election officials shall return all the ballots to the commissioner, who shall carefully preserve them for twenty-two months. The unofficial canvass shall report election results for national offices, statewide offices, the office of state representative, the office of state senator, and other offices or public measures at the discretion of the state commissioner of elections. If the commissioner determines that all precincts will not report election results before the office is closed, the commissioner shall report the most complete results available prior to leaving the office at the time the office is closed as provided in <xhtml:span class="iowaCodeRef">section 50.11</xhtml:span>. If the number of provisional ballots cast at any election is not sufficient to require reconvening of the entire election board of the special precinct, the commissioner may reconvene only the number of members required. The board may divide itself into panels of not less than three members each in order to hear and determine two or more challenges simultaneously, but each panel shall meet the requirements of <xhtml:span class="iowaCodeRef">section 49.12</xhtml:span> as regards political party affiliation of the members of each panel.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The decision to count or reject each ballot shall be made upon the basis of the information given on the envelope containing the provisional ballot, the evidence concerning the challenge, the registration and the returned receipts of registration. Ballots submitted to the board pursuant to <xhtml:span class="iowaCodeRef">section 49.78</xhtml:span> or <xhtml:span class="iowaCodeRef">49.81</xhtml:span> that are not cured by the deadline provided in <xhtml:span class="iowaCodeRef">section 49.81, subsection 6</xhtml:span>, shall be rejected.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">If a provisional ballot is rejected, the person casting the ballot shall be notified by the commissioner within ten days of the reason for the rejection, on the form prescribed by the state commissioner pursuant to <xhtml:span class="iowaCodeRef">section 53.25</xhtml:span>, and the envelope containing the provisional ballot shall be preserved unopened and disposed of in the same manner as spoiled ballots. The provisional ballots which are accepted shall be counted in the manner prescribed by <xhtml:span class="iowaCodeRef">section 53.23, subsection 5</xhtml:span>. The commissioner shall make public the number of provisional ballots rejected and not counted, at the time of the canvass of the election.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The special precinct board shall also canvass any absentee ballots which were received after the polls closed in accordance with <xhtml:span class="iowaCodeRef">section 53.17</xhtml:span>. If necessary, they shall reconvene again on the day of the canvass by the board of supervisors to canvass any absentee ballots which were timely received. The expense of securing such tally lists shall be paid by the county.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C51, §270; R60, §505; C73, §634; C97, §1148; C24, 27, 31, 35, 39, §<xhtml:span class="b">862;</xhtml:span> C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, <xhtml:span class="iowaCodeRef">81, §50.23</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">Messenger travel expenses, <xhtml:span class="iowaCodeRef">§50.47</xhtml:span> </xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec50.24"><xhtml:div class="heading"><xhtml:span class="identifier">50.24</xhtml:span><xhtml:span class="headnote">Canvass by board of supervisors.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The county board of supervisors shall meet to canvass the vote on the first Tuesday after the day of each election to which <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> is applicable, unless the law authorizing the election specifies another date for the canvass. If that Tuesday is a public holiday, <xhtml:span class="iowaCodeRef">section 4.1, subsection 34</xhtml:span>, controls.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Upon convening, the board shall open and canvass the tally lists and shall prepare abstracts stating the number of votes cast in the county, or in that portion of the county in which the election was held, for each office and on each question on the ballot for the election. The board shall contact the chairperson of the special precinct board before adjourning and include in the canvass any write-in votes tallied and recorded by the special precinct board or any absentee ballots which were received after the polls closed in accordance with <xhtml:span class="iowaCodeRef">section 53.17</xhtml:span> and which were canvassed by the special precinct board after election day. The abstract shall further indicate the name of each person who received votes for each office on the ballot, and the number of votes each person named received for that office, and the number of votes for and against each question submitted to the voters at the election. The votes of all write-in candidates who each received less than five percent of the votes cast for an office or who each received fewer than ten votes and was not determined to be elected shall be reported collectively under the heading “scattering”.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The board shall certify an election canvass summary report prepared by the commissioner. The election canvass summary report shall include the results of the election, including scatterings, overvotes, and undervotes, by precinct for each contest and public measure that appeared on the ballot of the election being canvassed. However, if paper ballots are used pursuant to <xhtml:span class="iowaCodeRef">section 49.26</xhtml:span>, the election canvass summary report shall not include overvotes and undervotes.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">For a regular or special city election or a city runoff election, if the city is located in more than one county, the controlling commissioner for that city under <xhtml:span class="iowaCodeRef">section 47.2</xhtml:span> shall conduct a second canvass on the second Tuesday after the day of the election. However, if a recount is requested pursuant to <xhtml:span class="iowaCodeRef">section 50.48</xhtml:span>, the controlling commissioner shall conduct the second canvass within two business days after the conclusion of the recount proceedings. Each commissioner conducting a canvass for the city pursuant to <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> shall transmit abstracts for the offices and public measures of that city to the controlling commissioner for that city, along with individual tallies for each write-in candidate. At the second canvass, the county board of supervisors of the county of the controlling commissioner shall canvass the abstracts received pursuant to <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> and shall prepare a combined city abstract stating the number of votes cast in the city for each office and on each question on the ballot for the city election. The combined city abstract shall further indicate the name of each person who received votes for each office on the ballot, the number of votes each person named received for that office, and the number of votes for and against each question submitted to the voters at the election. The votes of all write-in candidates who each received less than five percent of the total votes cast in the city for an office shall be reported collectively under the heading “scattering”.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">For a regular or special school election, if the school district is located in more than one county, the controlling commissioner for that school district under <xhtml:span class="iowaCodeRef">section 47.2</xhtml:span> shall conduct a second canvass on the second Tuesday after the day of election. The votes of all write-in candidates who each received less than five percent of the total votes cast in the school district for an office shall be reported collectively under the heading “scattering”.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The second canvass of votes for a merged area shall be conducted pursuant to <xhtml:span class="iowaCodeRef">section 260C.15, subsection 5</xhtml:span>, and each commissioner conducting a canvass for the merged area pursuant to <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> shall transmit abstracts for the offices and public measures of that school district to the controlling commissioner for that merged area, along with individual tallies for each write-in candidate.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">Any obvious clerical errors in the tally lists from the precincts shall be corrected by the supervisors. For a city runoff election held pursuant to <xhtml:span class="iowaCodeRef">section 376.9</xhtml:span>, the written request must be made not later than 5:00 p.m. on the day following the county board’s canvass of the city runoff election. The request shall be filed with the commissioner of that county and shall be signed by either of the following:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">A candidate for that office or nomination whose name was printed on the ballot of the precinct or precincts where the recount is requested.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Any other person who receives votes for that particular office or nomination in the precinct or precincts where the recount is requested and who is legally qualified to seek and to hold the office in question.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Immediately upon receipt of a request for a recount, the commissioner shall send a copy of the request to the apparent winner by certified mail. The commissioner shall also attempt to contact the apparent winner by telephone. If the apparent winner cannot be reached within four days, the chairperson of the political party or organization which nominated the apparent winner shall be contacted and shall act on behalf of the apparent winner, if necessary. For candidates for state or federal offices, the chairperson of the state party shall be contacted. For candidates for county offices, the county chairperson of the party shall be contacted.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">The state commissioner of elections shall order a recount of the votes cast for the election or nomination of a candidate for a statewide elected office, member of the general assembly, or federal office in each precinct where a vote was cast for the office if a written request for a recount is made not later than 5:00 p.m. on the day following the county board’s canvass of the election in question and the abstracts prepared pursuant to <xhtml:span class="iowaCodeRef">section 50.24</xhtml:span>, or <xhtml:span class="iowaCodeRef">section 43.49</xhtml:span> in the case of a primary election, indicate that the difference between the total number of votes cast for the apparent winner and the total number of votes cast for the candidate requesting the recount is less than fifteen hundredths of one percent for the election or nomination of a candidate for a statewide elected office or federal office, or less than either one percent or fifty votes, whichever is lesser, for all other elections or nominations. Immediately upon receipt of a request for a recount pursuant to this paragraph, the state commissioner of elections shall send a copy of the request to each commissioner of a county where a ballot for the office was cast, who shall conduct a recount as provided by <xhtml:span class="iowaCodeRef">this section</xhtml:span> and on such date as the state commissioner of elections may direct. The state commissioner of elections shall order the start of a recount pursuant to this paragraph within seven days of receipt by the state commissioner of elections of the request for a recount. A candidate for an office filled by the electors of the entire state shall not be required to pay more than one bond for a recount.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">d</xhtml:span></xhtml:div><xhtml:p class="para">Immediately upon receipt of a request for a recount for an office filled by the electors of more than one county, other than from the state commissioner of elections pursuant to paragraph <xhtml:span class="i">“c”</xhtml:span>, the commissioner shall send a copy of the request to each commissioner of a county where a ballot for the office was cast, who shall conduct a recount as provided in <xhtml:span class="iowaCodeRef">this section</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The recount shall be conducted by a board which shall consist of the commissioner and the commissioner’s staff. The commissioner may assign persons employed by the commissioner to tally ballots during the election as members of the recount board. If the commissioner assigns persons employed by the commissioner to tally ballots during the election as members of the recount board to recount an election for a partisan office, the commissioner shall assign an equal number of persons from each political party.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The commissioner shall convene the persons designated under paragraph <xhtml:span class="i">“a”</xhtml:span> not later than 9:00 a.m. on the seventh day following the receipt of a request for the recount of the election in question. </xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">The candidate requesting the recount and the apparent winning candidate of the office subject to the recount may select not more than five persons to observe the conduct of the recount in each county where the recount is being conducted. A candidate may replace an observer appointed by the candidate at any time.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">When all members of the recount board have been convened, the board shall undertake and complete the required recount as expeditiously as reasonably possible. The commissioner or the commissioner’s designee shall supervise the handling of ballots to ensure that the ballots are protected from alteration or damage. The board shall recount all ballots which were voted and counted for the office in question, including any disputed ballots returned as required in <xhtml:span class="iowaCodeRef">section 50.5</xhtml:span>. The same program used for tabulating the votes on election day shall be used at the recount unless the program is believed or known to be flawed. A recount shall be conducted by the use of automatic tabulating equipment, except that the state commissioner, for an election for a member of the general assembly, or commissioner, for a local elective office, may direct that an election be conducted by hand due to extraordinary circumstances. The same method of conducting the recount shall be used in each precinct where the recount is conducted. The commissioner shall make all pieces of automatic tabulating equipment available for use in the recount. For purposes of this paragraph, <xhtml:span class="term">“extraordinary circumstances”</xhtml:span> includes but is not limited to a machine failure during an initial recount, a discrepancy between the results of the initial count and the results of the initial recount, and the number of overvotes for an office exceeding the difference between the number of votes received by the apparent winning candidate for that office and the votes received by the candidate who received the second highest number of votes for that office. </xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The ballots shall be resealed by the recount board before adjournment and shall be preserved as required by <xhtml:span class="iowaCodeRef">section 50.12</xhtml:span>. At the conclusion of the recount, the recount board shall make and file with the commissioner a written report of its findings, which shall be signed by at least two-thirds of the members of the recount board. The recount board shall complete the recount and file its report not later than the eighteenth day following the commissioner’s receipt of a request for the recount of the election in question.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">At the conclusion of a recount, the recount board shall make and file with the commissioner a written report of its findings, signed by a majority of the recount board.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The commissioner or commissioner’s designee may assist in compiling the written report. The written report shall include a full tally and accounting of ballots reviewed by the recount board and shall be reported as required by <xhtml:span class="iowaCodeRef">sections 50.24</xhtml:span> and <xhtml:span class="iowaCodeRef">53.20</xhtml:span>. The written report must allow the commissioner to correct the canvass of voters in the manner required by law, if applicable.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">If the recount board’s report is that the abstracts prepared pursuant to the county board’s canvass were incorrect as to the number of votes cast for the candidates for the office or nomination in question, in that county or district, the commissioner shall at once so notify the county board. The county board shall reconvene within three days after being so notified, but no later than noon on the twenty-seventh day following the election in question for a recount of the offices of president and vice president, and shall correct its previous proceedings.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The commissioner shall promptly notify the state commissioner of any recount of votes for an office to which <xhtml:span class="iowaCodeRef">section 50.30</xhtml:span>, or <xhtml:span class="iowaCodeRef">section 43.60</xhtml:span> in the case of a primary election, is applicable. If necessary, the state canvass required by <xhtml:span class="iowaCodeRef">section 50.38</xhtml:span>, or by <xhtml:span class="iowaCodeRef">section 43.63</xhtml:span>, as the case may be, shall be delayed with respect to the office or the nomination to which the recount pertains. The commissioner shall subsequently inform the state commissioner at the earliest possible time whether any change in the outcome of the election in that county or district resulted from the recount.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">If the election is a city primary election held pursuant to <xhtml:span class="iowaCodeRef">section 376.7</xhtml:span>, the recount shall progress according to the times provided by <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>. If <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> applies the canvass shall be held by the second day after the election, the request for a recount must be made by the third day after the election, the board shall convene to conduct the recount by the sixth day after the election, and the report shall be filed by the eighth day after the election.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">7</xhtml:span></xhtml:div><xhtml:p class="para">When a city council has chosen a runoff election pursuant to <xhtml:span class="iowaCodeRef">section 376.9</xhtml:span>, the recount shall progress according to the times provided by <xhtml:span class="iowaCodeRef">this subsection</xhtml:span>. If <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> applies, the canvass shall be conducted pursuant to <xhtml:span class="iowaCodeRef">section 50.24</xhtml:span>. The request for a recount must be made by the day after the canvass, and the board shall convene for the first time not later than the first Friday following the canvass. The report shall be filed not later than the fourteenth day after the election.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">8</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The recount board shall comply with all guidance issued by the state commissioner of elections pursuant to <xhtml:span class="iowaCodeRef">section 47.1</xhtml:span> during the conduct of a recount. The state commissioner may halt a recount in a county, take custody of all ballots and equipment used in the recount, and appoint staff to conduct a recount if the state commissioner believes that a recount is not being conducted as required by law.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">If the state commissioner believes that a commissioner is purposefully conducting a recount in violation of law, the state commissioner may impose a civil penalty on the commissioner not to exceed twenty-five thousand dollars, to be deposited in the general fund of the state.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">9</xhtml:span></xhtml:div><xhtml:p class="para">Before a recount board has issued its final report, the candidate or person who requested the recount may reach an agreement with the apparent winner to accept the results of the original canvass by submitting the agreement in writing to each recount board that is conducting the recount. The petition shall be signed by the greater of not less than ten eligible electors or a number of eligible electors equaling one percent of the total number of votes cast upon the public measure. Each petitioner must be a person who was entitled to vote on the public measure in question or would have been so entitled if registered to vote.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The recount shall be conducted by a board which shall consist of:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A designee named in the petition requesting the recount.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">A designee named by the commissioner at or before the time the board is required to convene.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">A person chosen jointly by the members designated under paragraphs <xhtml:span class="i">“a”</xhtml:span> and <xhtml:span class="i">“b”</xhtml:span>.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The commissioner shall convene the persons designated under <xhtml:span class="iowaCodeRef">subsection 2</xhtml:span>, paragraphs <xhtml:span class="i">“a”</xhtml:span> and <xhtml:span class="i">“b”</xhtml:span>, not later than 9:00 a.m. on the seventh day following the canvass of the election in question. An administrative audit shall be conducted by the board of the special precinct established by <xhtml:span class="iowaCodeRef">section 53.23</xhtml:span>. The state commissioner may adopt rules for administrative audits.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Each political party, as defined in <xhtml:span class="iowaCodeRef">section 43.2</xhtml:span>, may appoint up to five observers to witness an audit conducted pursuant to <xhtml:span class="iowaCodeRef">this section</xhtml:span>. The observers shall be appointed by the county chairperson or, if the county chairperson fails to make an appointment, by the state chairperson. The absentee ballot and special voters precinct for each county, established pursuant to <xhtml:span class="iowaCodeRef">section 53.20</xhtml:span>, shall be included with all other precincts of the county for selection by lot. In every precinct selected, the commissioner shall conduct a hand count of ballots cast in the preceding general election for president of the United States or governor, as the case may be. The hand count may be of less than all ballots cast, in accordance with rules adopted by the state commissioner.</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A representative selected by each of the two political parties whose candidates received the highest number of votes statewide in the preceding general election shall be invited to observe the hand count. The commissioner shall notify the county chairperson of each political party a minimum of two days before the hand count of the time and place of the hand count.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">If an invited representative does not appear at the hand count, the commissioner shall notify the state commissioner.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The commissioner may order an administrative recount pursuant to <xhtml:span class="iowaCodeRef">section 50.50</xhtml:span> if the commissioner determines the results of an audit require an administrative recount.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">If selected to conduct an audit, the commissioner shall provide an audit report to the county board of supervisors and shall transmit the audit report to the state commissioner no later than twenty days following the election.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The results of an audit conducted pursuant to <xhtml:span class="iowaCodeRef">this section</xhtml:span> shall not change the results, or invalidate the certification, of an election. </xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">In advance of all other elections, the state commissioner shall order an audit of the election in the manner provided in <xhtml:span class="iowaCodeRef">this section</xhtml:span>. </xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">The state commissioner shall adopt rules, pursuant to <xhtml:span class="iowaCodeRef">chapter 17A</xhtml:span>, to implement <xhtml:span class="iowaCodeRef">this section</xhtml:span>, which may include the establishment of pilot programs related to post-election audits.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2017 Acts, ch 110, §43</xhtml:span>; <xhtml:span class="iowaActsRef">2018 Acts, ch 1149, §8, 12</xhtml:span>; <xhtml:span class="iowaActsRef">2019 Acts, ch 148, §29, 33</xhtml:span>; <xhtml:span class="iowaActsRef">2021 Acts, ch 147, §38, 54</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec50.52"><xhtml:div class="heading"><xhtml:span class="identifier">50.52</xhtml:span><xhtml:span class="headnote">Enforcement.</xhtml:span></xhtml:div><xhtml:p class="para">Members of local law enforcement agencies and the state patrol are authorized to take all reasonable actions to prevent violations of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2021 Acts, ch 12, §42, 73</xhtml:span></xhtml:div></xhtml:div></slim:Section></slim:Level></slim:Body></slim:Document>
