Many persons who are deaf, hard-of-hearing, or have speech disorders are not able to utilize the telephone system without this type of service. Therefore, it is the purpose of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span> to enable the orderly development, operation, promotion, and funding of a statewide dual party relay service.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">91 Acts, ch 194, §1</xhtml:span>; <xhtml:span class="iowaActsRef">93 Acts, ch 75, §6</xhtml:span>; <xhtml:span class="iowaActsRef">96 Acts, ch 1129, §96</xhtml:span>; <xhtml:span class="iowaActsRef">2020 Acts, ch 1102, §28</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec477C.2"><xhtml:div class="heading"><xhtml:span class="identifier">477C.2</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Communication disorder”</xhtml:span> means the inability to use the telephone for communication without a telecommunications device for the deaf and hard of hearing.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="i">“Dual party relay service”</xhtml:span> or <xhtml:span class="term">“relay service”</xhtml:span> means a communication service which provides persons with communication disorders access to the telephone system functionally equivalent to the access available to persons without communication disorders.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Telecommunications device for the deaf and hard of hearing”</xhtml:span> means any specialized or supplemental telephone equipment used by persons with communication disorders to provide access to the telephone system.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Utilities commission”</xhtml:span> means the Iowa utilities commission created in <xhtml:span class="iowaCodeRef">section 474.1</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">91 Acts, ch 194, §2</xhtml:span>; <xhtml:span class="iowaActsRef">2025 Acts, ch 30, §75</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">Subsection 1 stricken and former subsections 2 – 5 renumbered as 1 – 4</xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec477C.3"><xhtml:div class="heading"><xhtml:span class="identifier">477C.3</xhtml:span><xhtml:span class="headnote">Dual party relay service.</xhtml:span></xhtml:div><xhtml:p class="para">With the advice of the commission on deaf services created in <xhtml:span class="iowaCodeRef">section 216A.113</xhtml:span>, the utilities commission shall plan, establish, administer, and promote a statewide program to provide dual party relay service as follows:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The utilities commission may enter into the necessary contracts and arrangements with private entities to provide for the delivery of relay service.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The relay service, to the extent reasonably possible, shall allow persons with communication disorders to use the telephone system in a manner and at a rate equivalent to persons without communication disorders.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The relay service may be provided on a stand-alone basis within the state, with other states, or with telephone utilities providing relay service in other states.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The utilities commission may employ additional personnel, pursuant to <xhtml:span class="iowaCodeRef">section 476.10</xhtml:span>, to plan, establish, administer, and promote the relay service.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">91 Acts, ch 194, §3</xhtml:span>;
