The commission shall consist of three members appointed by the governor and subject to confirmation by the senate, not more than two of whom shall be from the same political party. Each member appointed shall serve for six-year staggered terms beginning and ending as provided by <xhtml:span class="iowaCodeRef">section 69.19</xhtml:span>. Vacancies shall be filled for the unexpired portion of the term in the same manner as full-term appointments are made.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Subject to confirmation by the senate, the governor shall appoint a member as the chairperson of the commission. The chairperson shall be the administrator of the utilities commission. The appointment as chairperson shall be for a two-year term which begins and ends as provided in <xhtml:span class="iowaCodeRef">section 69.19</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The commission shall appoint a chief operating officer to manage the operations of the utilities commission. The commission shall set the salary of the chief operating officer within the limits of the pay plan for exempt positions provided for in <xhtml:span class="iowaCodeRef">section 8A.413, subsection 3</xhtml:span>, unless otherwise provided by the general assembly. The commission may employ additional personnel as it finds necessary.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The utilities commission shall regulate and supervise public utilities operating in the state. The general counsel is the attorney for, and legal advisor of, the commission and is exempt from the merit system provisions of <xhtml:span class="iowaCodeRef">chapter 8A, subchapter IV</xhtml:span>. Assistants to the general counsel are subject to the merit system provisions of <xhtml:span class="iowaCodeRef">chapter 8A, subchapter IV</xhtml:span>.  The general counsel or an assistant to the general counsel shall provide the necessary legal advice to the commission in all matters and represent the commission in all actions instituted in a state or federal court challenging the validity of a rule or order of the commission. The existence of a fact which disqualifies a person from election or from acting as a utilities commission member disqualifies the person from employment as general counsel or assistant general counsel. The general counsel shall devote full time to the duties of the office.
