"/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp473"><slim:Heading class="heading"><xhtml:span class="identifier">473</xhtml:span><xhtml:span class="headnote">ENERGY DEVELOPMENT AND CONSERVATION</xhtml:span></slim:Heading><xhtml:div class="footnotes"><xhtml:div class="footnote">This chapter not enacted as a part of this title;<xhtml:span class="blank-line"/>transferred from chapter 93 in Code 1993</xhtml:div><xhtml:div class="footnote">For provisions regarding transfer of funds under the control of<xhtml:span class="blank-line"/>the office of energy independence to the economic development authority,<xhtml:span class="blank-line"/>continuation of licenses, permits, or contracts by the economic<xhtml:span class="blank-line"/>development authority, continued administration of grants<xhtml:span class="blank-line"/>or loans awarded from the Iowa power fund,<xhtml:span class="blank-line"/>continued administration of federal grant funds<xhtml:span class="blank-line"/>by the economic development authority, and employment status of<xhtml:span class="blank-line"/>certain office of energy independence employees,<xhtml:span class="blank-line"/>see <xhtml:span class="iowaActsRef">2011 Acts, ch 118, §51, 89</xhtml:span></xhtml:div></xhtml:div><slim:Section class="codeSection" id="sec473.1"><xhtml:div class="heading"><xhtml:span class="identifier">473.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Alternative and renewable energy”</xhtml:span> means energy sources including but not limited to solar, wind turbine, waste management, resource recovery, recovered energy generation, refuse-derived fuel, hydroelectric, agricultural crops or residues, hydrogen produced using renewable fuel sources, and woodburning, or relating to renewable fuel development and distribution.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Authority”</xhtml:span> means the economic development authority created in <xhtml:span class="iowaCodeRef">section 15.105</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Director”</xhtml:span> means the director of the authority or a designee.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="i">“Energy”</xhtml:span> or <xhtml:span class="term">“energy sources”</xhtml:span> means gasoline, fuel oil, natural gas, propane, coal, special fuels, and electricity.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Renewable fuel”</xhtml:span> means a fuel that is all of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">A motor vehicle fuel that is any of the following:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Produced from grain; starch; oilseed; vegetable, animal, or fish materials, including but not limited to fats, greases, and oil; sugar components, grasses, or potatoes; or other biomass.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Natural gas produced from a biogas source including but not limited to a landfill, sewage waste treatment plant, animal feeding operation, or other place where decaying organic material is found.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Used to replace or reduce the quantity of fossil fuel present in a motor fuel mixture used to operate a motor vehicle.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Supplier”</xhtml:span> means any person engaged in the business of selling, importing, storing, or generating energy sources, alternative and renewable energy, or renewable fuel in Iowa.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C75, 77, 79, <xhtml:span class="iowaCodeRef">81, §93.1</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">86 Acts, ch 1245, §1817 – 1819</xhtml:span></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaCodeRef">C93, §473.1</xhtml:span></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2008 Acts, ch 1126, §18, 19, 33</xhtml:span>; <xhtml:span class="iowaActsRef">2020 Acts, ch 1063, §260</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec473.2"><xhtml:div class="heading"><xhtml:span class="identifier">473.2</xhtml:span><xhtml:span class="headnote">Findings.</xhtml:span></xhtml:div><xhtml:p class="para">The general assembly finds that the health, welfare, and prosperity of all Iowans require the provision of adequate, efficient, reliable, environmentally safe, and least-cost energy at prices which accurately reflect the long-term cost of using such energy resources and which are equitable to all Iowans. The goals and objectives of this policy are to ensure the following:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span><xhtml:span class="headnote">Efficiency.</xhtml:span></xhtml:div><xhtml:p class="para">The provision of reliable energy at the least possible cost to Iowans in such manner that:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Physical, human, natural, and financial resources are allocated efficiently.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">All supply and demand options are considered and evaluated using comparable terms and methods in order to determine how best to meet consumers’ demands for energy at the least cost.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span><xhtml:span class="headnote">Environmental quality.</xhtml:span></xhtml:div><xhtml:p class="para">The protection of the environment from the adverse external costs of an energy resource utilization so that:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Environmental costs of proposed actions having a significant impact on the environment and the environmental impact of the alternatives are identified, documented, and considered in the resource development.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">The prudently and reasonably incurred costs of environmental controls are recovered.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">88 Acts, ch 1179, §1</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaCodeRef">C89, §93.2</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaCodeRef">C93, §473.2</xhtml:span></xhtml:p><xhtml:p class="p"><xhtml:span class="iowaActsRef">2008 Acts, ch 1126, §20, 33</xhtml:span></xhtml:p></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">See also <xhtml:span class="iowaCodeRef">chapter 470</xhtml:span> for life cycle cost analysis provisions </xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec473.3"><xhtml:div class="heading"><xhtml:span class="identifier">473.3</xhtml:span><xhtml:span class="headnote">Energy resource management goal.</xhtml:span></xhtml:div><xhtml:p class="para">The goal of this state is to efficiently utilize energy resources to enhance the economy of the state by decreasing the state’s dependence on nonrenewable energy resources from outside the state and by reducing the amount of energy used. Within thirty days of the date of the determination by the director, the governor may issue a proclamation of emergency, which shall be filed with the secretary of state. The proclamation shall state the facts relied upon and the reasons for the proclamation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Pursuant to the proclamation of an emergency or in response to a declaration of an energy emergency by the president of the United States under the federal Emergency Energy Conservation Act of 1979, Pub. L. No. 96-102, the governor by executive order may:</xhtml:p><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">Regulate the operating hours of energy consuming instrumentalities of state government, political subdivisions, private institutions, and business facilities to the extent the regulation is not hazardous or detrimental to the health, safety, or welfare of the people of this state. However, the governor shall have no authority to suspend, amend, or nullify any service being provided by a public utility pursuant to an order or rule of a federal agency that has jurisdiction over the public utility.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">Establish a system for the distribution and supply of energy. The system shall not include a coupon rationing program, unless the program is federally mandated.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">Curtail public and private transportation utilizing energy sources. Curtailment may include measures designed to promote the use of car pools and mass transit systems.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">Delegate any administrative authority vested in the governor to the authority or the director.</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">Provide for the temporary transfer of directors, personnel, or functions of state departments and agencies, for the purpose of performing or facilitating emergency measures pursuant to subparagraphs (1) and (2).</xhtml:p></xhtml:div><xhtml:div class="subpara"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para">Accept the delegation of the authority for other mandatory measures as allowed under the federal <xhtml:span class="USActsRef">Emergency Energy Conservation Act of 1979</xhtml:span>, <xhtml:span class="USCRef">Pub. L. No. 96-102</xhtml:span>, as amended.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">If the general assembly is in session, it may revoke by concurrent resolution any proclamation of emergency issued by the governor. If the general assembly is not in session, the proclamation of emergency by the governor may be revoked by a majority vote of the standing membership of the legislative council. Such revocation shall be effective upon receipt of notice of the revocation by the secretary of state and any functions being performed pursuant to the governor’s proclamation shall cease immediately.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A violation of an executive order of the governor issued pursuant to <xhtml:span class="iowaCodeRef">this section</xhtml:span> is a scheduled violation as provided in <xhtml:span class="iowaCodeRef">section 805.8C, subsection 1</xhtml:span>. The director may release any or all of the fuel required to be reserved by a prime supplier to end-users or to distributors for release through normal retail distribution channels to retail customers. However, the specified fraction required to be reserved shall not exceed three percent for propane, aviation fuel, and residual oil, and five percent for motor gasoline, heating oil, and diesel oil.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The director shall periodically review and may terminate the operation of a set-aside program authorized by the director under <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> when the director finds that the conditions that prompted the authorization no longer exist.
