<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp412" name="412"><slim:About class="header"><slim:Property type="string" name="version"/></slim:About><slim:TOC><slim:Item idref="sec412.1" title="412.1   Authority to establish system."/><slim:Item idref="sec412.2" title="412.2   Source of funds."/><slim:Item idref="sec412.3" title="412.3   Rules."/><slim:Item idref="sec412.4" title="412.4   Payments and investments."/><slim:Item idref="sec412.5" title="412.5   Public utility defined."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp412"><slim:Heading class="heading"><xhtml:span class="identifier">412</xhtml:span><xhtml:span class="headnote">MUNICIPAL UTILITY RETIREMENT SYSTEM</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec412.1"><xhtml:div class="heading"><xhtml:span class="identifier">412.1</xhtml:span><xhtml:span class="headnote">Authority to establish system.</xhtml:span></xhtml:div><xhtml:p class="para">The council, board of waterworks trustees, or other board or commission, whichever is authorized by law to manage and operate any municipally owned waterworks system, or other municipally owned and operated public utility, may establish a pension and annuity retirement system for the employees of any such waterworks system, or other municipally owned and operated public utility.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, <xhtml:span class="iowaCodeRef">81, §412.1</xhtml:span>]</xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec412.2"><xhtml:div class="heading"><xhtml:span class="identifier">412.2</xhtml:span><xhtml:span class="headnote">Source of funds.</xhtml:span></xhtml:div><xhtml:p class="para">The fund for such pension and annuity retirement system shall be created from any or all of the following sources:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">From the proceeds of the assessments on the wages and salaries of employees, of any such waterworks system, or other municipally owned and operated public utility, eligible to receive the benefits thereof. </xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">From the interest on any permanent fund which may be created by gift, bequest, or otherwise.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">From moneys derived from the operation of such waterworks, or other municipally owned and operated public utility, available and appropriated therefor by the council, board of waterworks trustees, or other board or commission, whichever is authorized by law to manage and operate such waterworks or other municipally owned and operated public utility. Such money so expended shall constitute an operating expense of such utility.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, <xhtml:span class="iowaCodeRef">81, §412.2</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">2009 Acts, ch 179, §129</xhtml:span>; <xhtml:span class="iowaActsRef">2017 Acts, ch 2, §23, 26, 27</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec412.3"><xhtml:div class="heading"><xhtml:span class="identifier">412.3</xhtml:span><xhtml:span class="headnote">Rules.</xhtml:span></xhtml:div><xhtml:p class="para">The council, board of waterworks trustees, or other board or commission, whichever is authorized by law to manage and operate such waterworks, or other municipally owned and operated public utility, may formulate and establish such pension and annuity retirement system, and may make and establish such rules for the operation thereof as may be deemed necessary or appropriate, subject to the provision of <xhtml:span class="iowaCodeRef">section 412.2, subsection 1</xhtml:span>.</xhtml:p><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p">[C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, <xhtml:span class="iowaCodeRef">81, §412.3</xhtml:span>]</xhtml:p></xhtml:div><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">2009 Acts, ch 179, §130</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec412.4"><xhtml:div class="heading"><xhtml:span class="identifier">412.4</xhtml:span><xhtml:span class="headnote">Payments and investments.</xhtml:span></xhtml:div><xhtml:p class="para">The council, board of waterworks trustees, or other board or commission, whichever is authorized by law to manage and operate any such waterworks, or other municipally owned and operated public utility, shall have the right and power to contract with any legal reserve insurance company authorized to conduct its business in the state, or any bank located in Iowa having trust powers for the investment of funds contributed to an annuity or pension system, for the payment of the pensions or annuities provided in such pension or annuity retirement system, and may pay the premiums or make the contribution of such contract out of the fund provided in <xhtml:span class="iowaCodeRef">section 412.2</xhtml:span>. Funds shall be invested in accordance with the investment policy for the retirement fund, as established by the governing body of the public utility.
