<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp405" name="405"><slim:About class="header"><slim:Property type="string" name="version"/></slim:About><slim:TOC><slim:Item idref="sec405.1" title="405.1   Housing development  tax status  limitation."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp405"><slim:Heading class="heading"><xhtml:span class="identifier">405</xhtml:span><xhtml:span class="headnote">ASSESSMENT OF PROPERTY FOR HOUSING DEVELOPMENT</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec405.1"><xhtml:div class="heading"><xhtml:span class="identifier">405.1</xhtml:span><xhtml:span class="headnote">Housing development <xhtml:span class="em-dash"/> tax status <xhtml:span class="em-dash"/> limitation.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">The board of supervisors of a county may adopt an ordinance providing that property acquired and subdivided for development of housing on or after January 1, 2011, shall continue to be assessed for taxation in the manner that it was prior to the acquisition for housing. Each lot shall continue to be taxed in the manner it was prior to its acquisition for housing until the lot is sold for construction or occupancy of housing or five years from the date of subdivision, whichever is shorter. Upon the sale or the expiration of the five-year period, the property shall be assessed for taxation as residential or commercial multifamily property, whichever is applicable.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Ordinances adopted under <xhtml:span class="iowaCodeRef">this section</xhtml:span>, to the extent such ordinances affect the assessment of property subdivided for development of housing on or after January 1, 2004, but before January 1, 2011, shall remain in effect or otherwise be made effective and such ordinances adopted under <xhtml:span class="iowaCodeRef">section 405.1, subsection 1</xhtml:span>, Code 2011, shall be extended to apply the ordinances to the period of time ending ten years from the date of subdivision, and ordinances adopted under <xhtml:span class="iowaCodeRef">section 405.1, subsection 2</xhtml:span>, Code 2011, shall be extended to apply the ordinances to the period of time ending eight years from the date of subdivision.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">On or after July 27, 2011, the board of supervisors of a county may amend an ordinance adopted or otherwise made effective under <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> to extend the period of time established under <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span> to apply the ordinance to a period of time not to exceed five years beyond the end of the period of time established under <xhtml:span class="iowaCodeRef">subsection 1</xhtml:span>. An extension of an ordinance under <xhtml:span class="iowaCodeRef">this subsection</xhtml:span> may apply to all or a portion of the property that was subject to the original ordinance.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">A city council may adopt an ordinance affecting that portion of the applicable property located within the incorporated area of the city, effectuating an extension of a county ordinance otherwise eligible to be extended under <xhtml:span class="iowaCodeRef">subsection 2</xhtml:span> and not previously extended by the board of supervisors.
