<?xml version="1.0" encoding="UTF-8"?><slim:Document xmlns:slim="urn:legix:slim" xmlns:xhtml="http://www.w3.org/1999/xhtml" xmlns:atipl="http://www.arbortext.com/namespace/PageLayout" class="codeChapter" id="chp327J" name="327J"><slim:About class="header"><slim:Property type="string" name="version"/></slim:About><slim:TOC><slim:Item idref="sec327J.1" title="327J.1   Definitions."/><slim:Item idref="sec327J.2" title="327J.2   Passenger rail service revolving fund."/><slim:Item idref="sec327J.3" title="327J.3   Administration."/></slim:TOC><slim:Body><slim:Level class="codeChapter" id="chp327J"><slim:Heading class="heading"><xhtml:span class="identifier">327J</xhtml:span><xhtml:span class="headnote">PASSENGER RAIL SERVICE</xhtml:span></slim:Heading><slim:Section class="codeSection" id="sec327J.1"><xhtml:div class="heading"><xhtml:span class="identifier">327J.1</xhtml:span><xhtml:span class="headnote">Definitions.</xhtml:span></xhtml:div><xhtml:p class="para">As used in <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, unless the context otherwise requires:</xhtml:p><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“AMTRAK”</xhtml:span> means the national railroad passenger corporation created under <xhtml:span class="USCRef">45 U.S.C. §24101</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Department”</xhtml:span> means the state department of transportation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Director”</xhtml:span> means the director of transportation.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Fund”</xhtml:span> means the passenger rail service revolving fund created under <xhtml:span class="iowaCodeRef">section 327J.2</xhtml:span>.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Midwest regional rail system”</xhtml:span> means the passenger rail system identified through a multistate planning effort in cooperation with AMTRAK.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">6</xhtml:span></xhtml:div><xhtml:p class="para"><xhtml:span class="term">“Passenger rail service”</xhtml:span> means long-distance, intercity, and commuter passenger transportation, including the midwest regional rail system, which is provided on railroad tracks.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">92 Acts, ch 1210, §2</xhtml:span>; <xhtml:span class="iowaActsRef">2000 Acts, ch 1168, §1</xhtml:span>; <xhtml:span class="iowaActsRef">2009 Acts, ch 97, §16</xhtml:span>; <xhtml:span class="iowaActsRef">2014 Acts, ch 1092, §179</xhtml:span></xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec327J.2"><xhtml:div class="heading"><xhtml:span class="identifier">327J.2</xhtml:span><xhtml:span class="headnote">Passenger rail service revolving fund.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span><xhtml:span class="headnote">Fund created.</xhtml:span></xhtml:div><xhtml:p class="para">The passenger rail service revolving fund is established as a separate fund in the state treasury under the control of the department. Moneys deposited in the fund shall be administered by the director and shall be used to pay the costs associated with the initiation, operation, and maintenance of passenger rail service.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span><xhtml:span class="headnote">Funding.</xhtml:span></xhtml:div><xhtml:p class="para">To achieve the purposes of <xhtml:span class="iowaCodeRef">this chapter</xhtml:span>, moneys shall be credited to the passenger rail service revolving fund by the treasurer of state from the following sources:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Appropriations made by the general assembly.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Private grants and gifts intended for these purposes.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">Federal, state, and local grants and loans intended for these purposes.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span><xhtml:span class="headnote">No reversion.</xhtml:span></xhtml:div><xhtml:p class="para">Notwithstanding <xhtml:span class="iowaCodeRef">section 8.33</xhtml:span>, any balance in the fund on June 30 of any fiscal year shall not revert to the fund from which it was appropriated.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:span class="iowaActsRef">92 Acts, ch 1210, §3</xhtml:span>; <xhtml:span class="iowaActsRef">2009 Acts, ch 97, §17</xhtml:span>; <xhtml:span class="iowaActsRef">2010 Acts, ch 1184, §94</xhtml:span></xhtml:div></xhtml:div><xhtml:div class="footnotes"><xhtml:div class="footnote">Legislative intent that moneys directed to be deposited in road use tax fund under <xhtml:span class="iowaCodeRef">§312.1</xhtml:span> not be used for loans, grants, or other financial assistance for passenger rail service; <xhtml:span class="iowaActsRef">2000 Acts, ch 1168, §4</xhtml:span> </xhtml:div></xhtml:div></slim:Section><slim:Section class="codeSection" id="sec327J.3"><xhtml:div class="heading"><xhtml:span class="identifier">327J.3</xhtml:span><xhtml:span class="headnote">Administration.</xhtml:span></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">1</xhtml:span></xhtml:div><xhtml:p class="para">The director may expend moneys from the fund to pay the costs associated with the initiation, operation, and maintenance of passenger rail service. The director shall report by February 1 of each year to the legislative services agency concerning the status of the fund including anticipated expenditures for the following fiscal year.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">2</xhtml:span></xhtml:div><xhtml:p class="para">The director may enter into agreements with AMTRAK, other rail operators, local jurisdictions, and other states for the purpose of developing passenger rail service serving Iowa. The agreements may include any of the following:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">Cost-sharing agreements associated with initiating service, capital costs, operating subsidies, and other costs necessary to develop and maintain service.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">Joint powers agreements and other institutional arrangements associated with the administration, management, and operation of passenger rail service.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">3</xhtml:span></xhtml:div><xhtml:p class="para">The director shall enter into discussions with members of Iowa’s congressional delegation to foster passenger rail service in this state and the midwest and to maximize the level of federal funding for the service.</xhtml:p></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">4</xhtml:span></xhtml:div><xhtml:p class="para">The director may provide assistance and enter into agreements with local jurisdictions along the proposed route of the midwest regional rail system or other passenger rail service operations serving Iowa to ensure that rail stations and terminals are designed and developed in accordance with the following objectives:</xhtml:p><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">a</xhtml:span></xhtml:div><xhtml:p class="para">To meet safety and efficiency requirements outlined by AMTRAK and the federal railroad administration.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">b</xhtml:span></xhtml:div><xhtml:p class="para">To aid intermodal transportation.</xhtml:p></xhtml:div><xhtml:div class="letteredPara"><xhtml:div class="heading"><xhtml:span class="identifier">c</xhtml:span></xhtml:div><xhtml:p class="para">To encourage economic development.</xhtml:p></xhtml:div></xhtml:div><xhtml:div class="subsection"><xhtml:div class="heading"><xhtml:span class="identifier">5</xhtml:span></xhtml:div><xhtml:p class="para">The director shall report annually to the general assembly concerning the development and operation of the midwest regional rail system and the state’s passenger rail service.</xhtml:p></xhtml:div><xhtml:div class="history"><xhtml:div class="historyItem"><xhtml:p class="p"><xhtml:span class="iowaActsRef">92 Acts, ch 1210, §4</xhtml:span>; <xhtml:span class="iowaActsRef">2000 Acts, ch 1168, §2</xhtml:span>; <xhtml:span class="iowaActsRef">2003 Acts, ch 35, §45, 49</xhtml:span>; <xhtml:span class="iowaActsRef">2009 Acts, ch 97, §18</xhtml:span></xhtml:p></xhtml:div></xhtml:div></slim:Section></slim:Level></slim:Body></slim:Document>
